On Way Out the Door, Obama Administration Changes Rule So That Now Those Who Receive SSI Payments Will be Categorized Officially as "Mental Defectives" and Thus Flagged on Gun-Purchase Background Checks as Ineligible to Buy Guns

The Administration says that it suddenly realized it was required to do this to comport with the law.

Very odd that they're reversing a previous ruling, that they didn't have to automatically categorize SSI recipients as "mental defectives," after letting that ruling stand until three weeks before this clownish ideologue was booted out of public housing.

The point of gun control groups are to specifically deny segments of the American population their civil rights.

The government routinely goes after other such groups for violating other civil rights.

There is no reason that Trump can't sic a new FBI agency on the gun grabbers....

The next step is to have a "disability." The most popular one is bioplar disorder. You get a doctor to sign off, throw a bunch of money at lawyers, and voila! Uncle Sugar is sending you checks for the rest of your life when you can easily work.

I fully accept that there are lots of people out there that have genuine reasons for getting SSI, and have no problem with them receiving it, but as the economy has stagnated, this has become the new path to a life of ease.

Actually it is even worse then that.

We've imported 20-40M people to take low skill jobs and pushed a lot of Americans into a position where it is hard to find that sort of job anymore.

In return the government purposely turned a blind eye to fake SSI claims.

We are importing illegals to "work for less" then Americans, so the Americans that would have been doing those jobs can go on SSI instead. Which, of course, is paid for out of taxes. Which of course costs a lot more then paying a "living wage" for carpentry, house cleaning, landscaping, etc.

These rules change assumptions about PTSD treatments and people who have assistance in managing their affairs. It's not (yet) a blanket prohibition for those disabled and/or on assistance.

IIRC, there was a push to say that anyone being prescribed medication for depression or anxiety or the like be reported as well. Which means that, hey, go to the VA for PTSD or, if you're me, go to the doctor and get a prescription for xanax as needed to help with panic attacks and BOOM you get flagged. That didn't get rammed through but I fully expect that will be one of the midnight regs as well.

The only reason I'm harping on this is because I had to learn the difference between SSI, SSDI, Medicare and Medicaid in order to be sure we paid the right amount of lien back to the right agency and, hmm, how to put this that won't get me a visit from the nice folks with the sunglasses and earpieces, hmm, I would not be unhappy should chupacabras eat all of the people involved with promulgating all of these regulations and running all of these programs. That is false. Or, at least, it is only true for a subset of people.

The SSA also insisted that it was not stigmatizing those who receive disability insurance or SSI for mental health conditions, arguing that the names of the beneficiaries reported to NICS would not be made public. What the administration ignores is that it would stigmatize the entire category of beneficiaries subject to reporting.

That is, people who are receiving disability / SSI for mental health problems will be prohibited from owning guns. It is a matter for concern. However, for someone who is receiving disability / SSI as a result of a non-mental health illness, their 2nd amendment rights are unaffected.

College boyfriend had a cousin who died of aggressive melanoma at age 20. He was the youngest child and his mother was utterly distraught. She died six days after his funeral and not a person in the family was surprised. Her husband said point blank that he expected her to die of a broken heart and she did.

IIRC The Hat is uncharacteriscally wrong here. Regs (like laws) can be rescinded, but you'd have to go through the process to do it, which is unwieldy.

Now, reading the actual regulation it's....weird. It's not an automatic "you're on SSI you're out." it's saying they have to turn over names the SSA determined were mentally defective. But that's redundant no? After all, that finding would be actually made by someone else (i.e. a psychiatrist or court) who would have to report it anyway.

We do in the case of felons. And we also don't allow them to purchase firearms in many cases.

I'm rabidly pro-2nd Amendment, mass shootings have nothing to do with gun control or assault weapons but everything to do with crazy people.

If someone is voluntarily saying "I'm crazy" and getting a check for it for life with a doctor agreeing with them, I'm not exactly jumping up and down to make sure they can buy guns.

This isn't just regular "disability" claims, it's mentally disabled.

If I'm understanding this correctly, SSI recipients are having their gun rights taken away, but not SSDI recipients. The difference between the two is one is means-tested, and the other is not. SSI benefits are based on income. SSDI acts more like Medicare, and is not based on income.


So poor people with chronic depression cannot own guns, but better-off people with chronic depression can. This doesn't make sense to me.

That is the key, it's not people who say took something for their depression.

Could it go there? With additional laws it could, it's all up to our Supreme Court.

But we're basically now admitting large swaths of these people actually are mentally competent, they just don't want to work anymore. And that we shouldn't take their guns because they are lying about being mentally incompetent.

As defined by diagnostic criteria, PTSD is NOT a spectrum type disorder, but one that has a threshold.

You can have some symptoms associated with PTSD, but without the full scope of symptoms, you are not diagnosed with the condition.

Yes we are. The DSM (V, by the way) is not designed to be used by amateurs. It's a tool for mental health providers, to diagnose patients.

1-3 were primarily attempts to describe broadly diagnostic possibilities with significant prudence left up to the provider (i.e. doc).

IV started to go a bit nuts with specificity and categories that were a bit strong, V is off it's fucking rocker and might as well be a Web MD script the way it's being used.

You are right that it is not an EO. However, you are wrong to call a regulation a law. It is not.

And while it is true that Trump will not be able to use an EO of his own to overturn a regulation, there are other things that can be done. First, the agency itself can go through the process to issue a new reg overturning the previous reg. Also, Congress can overturn them as well.

My prediction is that with a Republican House / Senate / President, many of these last minute regs are going to get overturned pretty quickly.

I may have misunderstood you but a 'regulation' that is codified is in fact a law and you can be fined, have license or a certificate revoked or even jailed for violation. For example: all those "federal aviation regulations" in 14 CFR parts 21, 23, 25...etc.

Failure to follow posted signs and placards, or instructions from the flight crew in a commercial airplane will get you fined or jailed depending on the transgression and the circumstances.

389 FYI, SSI is not a life of ease. I think max is $1660 a month. I have a cousin in OK that is bipolar. He is on SSI and in Section 8 housing. He says that he couldn't afford to live in another state. (And his brother is on dialysis and just lost his disability. He's 65 and trying to get onto regular SS.)

And you are right about folks that do abuse disability. It's hard to find a job when in your 50s and the unemployment runs out. I think most of these folks would rather work.

In my defense, I've been irritated by the entire field of psychiatry of late. At some point they just said "fuck it" and left the entirety of anything not purely pharmacological to psychology, which IMHO hinders the integrated care necessary for mental health.

To that end, I think this is why the DSM-V tends to be over interpreted by them (psychiatrists) as a nearly mathematical document. (Or a better descriptor may be any other disease treatise with hard and fast symptoms.)

Granted Kubler-Ross warned of this EXACT problem in "On Death and Dying" noting that we were choosing scientists to be the next generation of doctors not clinicians. Nobody listened though.

Nope. Executive Orders and agency regulations are not the same. Agencies have the authority to promulgate regulations based on the law. For instance, instead of Congress defining an acceptable level of every single kind of pollutant in the water or air, or whatever, they will give the EPA or whatever agency directions to go through the process of determining the appropriate levels based on safety, cost, etc. The EPA will go through the process laid out in the law to come up with the regulations. Once those regs are in place, the President can't just come along and order them changed. If there is reason for a change, the agency has to go through the process of issuing revised regs.

Of course, the president can fire the head of the EPA and put in someone who will run the agency more to his liking, but it takes more than a pen and a phone.

.It's not a law, it's a regulation that was determined by the Head of the SSA. There is a tremendous difference. Regulations can be cancelled or simply ignored once they are published in the Federal Register by the Head of whatever Agency made them. Enforcement or lack thereof of various Immigration regulations are a good example. Laws can only be "made" by Congress and they most certainly did not make this one.

They did punt on their duties by allowing various Secretaries and Department heads to make what can amount to laws without any oversight, but that is an argument for a different day.

Congress passes laws, agencies promulgate regulations based on the authority given them by those laws. Congress can also make it either a civil or criminal offense to violate the regulations that an agency has put forth.

You might see it as a distinction without a difference, but laws have to go through a specific process to be passed (or overturned), while there is a different process when it comes to regulations. They are not the same.

Thus, the beneficiary must have a documented mental condition which would render them ineligible to own a firearm under current NICS regulations, AND be incapacitated enough that they are incapable of managing their own financial affairs.

I am not saying that it is a *good* thing that the feds are restricting gun ownership, but it isn't as random and far-reaching as the headlines would suggest.
