Trump: Flag Burning Should be Illegal, Maybe Punished by a Year in Jail or Forfeiture of Citizenship


The media is screaming about this, but failing to note that Hillary Clinton proposed outlawing flag burning in 2005.

Below, Chris Cuomo lectures a Trump aide on the unconstitutionality of anti-flag-burning laws -- completely forgetting that he notoriously claimed that a "Chaplinsky rule" in the Constitution made it okey-dokey to criminalize speech if it offended someone.

It's amazing that this illiterate dum-dum dares to lecture people on what the Constitution says. He's so damn smug in his towering ignorance.

Update: AllahPundit notes that a lot of Trump defenders are offering (as we once did for Bush) a lot of 11th-dimensional chess-type explanations for Trump's outburst, claiming he's playing the long game from wicked angles you can't even see -- trying to deflect from this, prepare the battlespace for that, and generally troll and bait his opponents into making some sort of error.

The most obvious explanation (which Allah notes) is that Trump saw something on "the shows" about flag-burning, decided he didn't like it on a purely gut level, and tossed out his tweet to the world.

Well, it turns out that Trump tweeted at about the time FoxNews had on a segment about flag-burning.

Now, I don't buy the "Trying to Deflect from News He Doesn't Want You to Pay Attention To" explanation (given that a much simpler explanation exists and accords with what was on TV at the time). But it's wrong to say there's no bad news to deflect attention away from -- probably.

Chris Christie is giving a press announcement today, without taking any questions from the media.

I am guessing -- without knowing -- that this has something to do with Bridgegate, or simply noting that he's decided not to seek re-election in 2017.

Eh, would Trump care about that? Probably not really. Still, it does seem there is likely to be some indirectly-affecting-Trump bad news later.

Am I the only one who thinks taking a knee is kind of a mixed message. Kneeling is a sign of fealty or submission. One could argue, in a different context that to kneel during the anthem is actually paying it respect (although one could also argue that given American History and culture, we would not cotton to those kinds of display, but rather show respect by standing tall, with the head up.)

They've done so many over the years it's hard to pick a favorite but I've always been partially to the giant ballon they hid under Harvard football stadium. It was during the annual Harvard Yale game which is a huge rivalry and packed to the rafters with students and alumni of both schools.

Somehow, they managed to not only bury a giant ballon with with MIT all over it but they waited until the middle of the game and then inflated it. It rose out of the ground like some giant black death star and then exploded.

First, Trump isn't even President yet. Hate Bush or like Bush--people could follow the logic of Bush.

You've borrowed a lot of enemies for Trump. Mitt Romney Republicans, Bush Republicans, Cruz Republicans, Reagan Republicans.

That brings up another point. Bush was attacked for being a RINO because of spending. Spending to get the nation back on track after the devastation of 9/11 and two of the worst national disasters. He also did a pharmaceutical benefit and that was to try to keep seniors on board and voting Republican during a war but also as a compromise to stave off HillaryCare which later morphed into ObamaCare.

In fact many of the same bloggers extolled the wins of supposed Jacksonian Democrats--ala Jim Webb because everyone stupidly believed that Democrats suddenly cared about deficits--Jim Webb never once stood up against any of Obama's Cash for Clunkers or multibillion dollar stimulus plans--he should go down as one of the biggest liars in current history.

Now Trump's Organization is telling people that he has a huge infrastructure spending plan and that was hardly debated during the primary. In fact when spending ideas were talked about on the campaign trail by Trump--he would get upset that people didn't cheer enough and then tell them if they didn't cheer louder he might not spend money on their local infrastructure.

The Trump Organization is telling everyone it is now--The Trump Party.

What does that get you? The guy is old--once he dies what happens?

Does it get you a Cult of Personality like Obama's?

How did that work out for Obama? The Democrat party is decimated. The Democrats got rid of--and refused to work with Blue Dog Democrats. That didn't work out too well now did it?

I agree, and I agree with the Bush analogy. What works for Donald Trump really only works for him, and you can't build a movement or party around that. He's the candidate of the nation yelling F--- YOU at the left and the establishment, and that's fine as far as it goes.

But its nothing to build a future on. We have to hope that while he has the reins he can steer the nation somewhere less catastrophic in the process, and maybe we can rebuild from the basis of that.

That might be true but this is not the first time Trump has brought the flag into his campaign and watched the media mock him. He was known to hug the flag during his rallies to great mocking from Colbert to Mediate.

I do think Trump likes to set the agenda with some of his statements. It's possible that he doesn't know that burning the flag has been decided as lawful by the SC over a decade ago but given his actions including going to court over displaying the flag and 1st Amendment rights I'd be surprised.

Allahpundit has been wrong about almost everything for the last two years.

Why did Trump do it? Prime immediate reason number one: He is trying to bait the left into a flag burning rampage, which will once again draw people to Trump, not the reverse, and at the lest get a big thumbs up from his supporters. He does get off baiting people, so if there is a "gut level" it is that, not what AP thinks.

Trump may say and do stupid things sometimes, but the idea that Trump just does this because he sees some news story and decided to tweet it goes against the accumulated evidence we have seen the last two years out of Trump.

But there are other reasons...

Trump has been rather silent on Twitter until the last couple of days. Then he broke out about illegals voting in the election (granted partly in response to Hillary wanting a recount), then this about burning the American flag. Combined with the fact that a Jihadist, who was a refugee from Somalia, went on a rampage at Ohio State yesterday.

Remember Steve Bannon is with Trump now, so are a few other people who would not mind seeing the left get over aggressive and confrontational in a mass freak out. Everyone in the end needs a "Casus belli"...even Trump & Co.

Note: Personally I am not against this either. The left has spent years trying to bait conservatives, our military, and anyone who actually loves this country into doing stupid idiotic things. I think our side has done a remarkable job not taking the bait. Lets see if the left has that kind of patience.

433 Sorry, but I side with the idea that burning a flag (that you own ...) is free speech. And I've been a Boy Scout leader for 24 years and have taught 100's of Scouts how to respect the flag (including burning it in a dignified fashion when it is too damaged for further display). But respect coerced is not respect, it is fear. If we are to preserve freedom and liberty and the concepts of private property, then burning a flag in protest must be legal (however reprehensible the act may be).

434 "Hilary's bill" was mentioned up thread. In 2005 Sen. Cilinton co-sponsored a bill with Sen. Bennett (R Utah) that would have criminalized flag burning. The Flag Protection Act of 2005. It would have outlawed flag burning, with a penalty of one year in jail and a fine of $100,000. Has a Wiki entry all its own.

The man has built his brand for 30+ years. He knows exactly what he's doing. He knows all he has to do is tweet something controversial and his Legions of Centipedes will joyously pounce at the opportunity to highlight the hypocrisy of those freaking out about his controversial tweet. He knows he has to keep the elan of his supporters high for the trench warfare that will be his entire presidency.

True story: Many years ago, during the Reagan administration, I was chatting with a co-working who was a foam-flecked-lips leftist. I happened to mention a news item (I forget what, exactly) and said that I'd seen it in the Washington Times. My co-worker's face screwed up in rage and disdain, when I corrected myself and said that the story had appeared in the Washington Post; and his face immediately relaxed into an expression of benign acceptance. The change was so striking that, just for grins, I said that no, I was right the first time, it was the Times: and his face immediately reverted to the expression of rage. And then I again reversed myself and said, Oops! My bad - it was the Post, and his expression relaxed again.

I swear to you, I did this three more times, and each time it was like seeing one of Pavlov's dogs react to the bell: Washington Times, rage; Washington Post, smiles. Never mind the content of the story: its origin was enough to trigger the reaction.

That was the last day that I took the Left - or a political fanatic of any stripe - seriously.

As for Trump, he's not playing 11-dimensional chess: trolling fanatics doesn't require subtlety.
