Sefton: sefton at cutjibnewsletter.com | John Schindler: We Now Have Incontrovertible Proof That the FBI's "Investigation" of Hillary and Her Henchmen Was a Sham From the StartYou're saying the system is rigged by the Washington insiders, then? How shabbily populist! From the moment the EmailGate scandal went public more than a year ago, it was obvious that the Federal Bureau of Investigation never had much enthusiasm for prosecuting Hillary Clinton or her friends. Under President Obama, the FBI grew so politicized that it became impossible for the Bureau to do its job – at least where high-ranking Democrats are concerned. ...Yes, let's talk about Cheryl Mills -- and ponder, briefly, why on earth James Comey of all people would grant her immunity, except if the Fix was in. Let's talk about that immunity deal. Comey wanted documents on her laptop. He could have compelled them by the simple and routine expedient of a subpeona. Instead, he granted her immunity for any documents he found on her system. And what was on her system? Classified documents which are illegal for any non-authorized person to have copies of. Instead of prosecuting her, he made the problem go away by fixing her up with immunity for the very crime she was red-handedly guilty of. Comments(Jump to bottom of comments)1

Bottom line - the FBI, the DOJ, the State Department - they are all headed by one person - President Obama. He himself was fully aware of this, and so he had no intention of taking Hillary down on this. I wonder if he tried to force her out and get Biden in - but a deal just couldn't be struck. She may have said, I won't go quietly.

You give immunity in return for testimony against a bigger lawbreaker. You don't give out immunity as a way of avoiding prosecuting someone.
If any person given immunity does not give valuable testimony, that immunity needs to be revoked. So what did Mills give up that earns her immunity? Immunity is not supposed to be a pre-emptive pardon. Posted by: Qoheleth at September 26, 2016 12:29 PM (iIzG7) 39

Slash the FBI's budget by half to three-quarters.
Even better would be to use the left's playbook. Hold protests outside FBI offices. Refer to the whole organization as corrupt. Hell, conservatives should encourage Americans to shun anyone working for the FBI and their families. Make it hurt. You can even argue from a law-and-order perspective. You can't have law and order with corrupt institutions, and if the FBI is willing to overlook criminal activity by the powerful, they're more than willing to railroad innocent men and women who challenge the powerful. This cannot be allowed to stand. Posted by: Colorado Alex In Exile at September 26, 2016 12:32 PM (FYrz1) 52

I have long maintained that government employees - as part of their employment - should not be afforded protections like the 5th Amendment or, in this case, Immunity, when it comes to charges involving the conduct of their government duties.
Those protections are fine if what they are accused of has nothing to do with the execution of their duties, e.g., robbing a 7-11 in their off time, but when the charge is malfeasance in performing the job that we, the taxpayers, pay them for, the normal protections should not be in play. When I was a soldier I surrendered some of my constitutional rights. So too should members of our pampered "ruling class". Posted by: LGoPs at September 26, 2016 12:34 PM (AtCmq) 58

Obama using a pseudonym email account is about the *least* surprising revelation so far. I was kinda expecting that it would be that the emails between them would show that it's been Valerie running things all along. Then again, the email account was said to be Obamas - he may have shared it with Val just as Hillary shared hers with Huma. Think of that: acting SoS Huma communicating with acting POTUS Valerie. The investigation was a sham. That really is the only reasonable conclusion one can make after following this story. Hillary was never going to be indicted. She knew it. Obama knew it. Lynch knew it.

Serious question:
If someone refuses to testify, can we claw back immunity? Posted by: TexasDan at September 26, 2016 12:39 PM (FnuZG) --It depends on the immunity agreement. It seems that the FBI was issuing limited-use immunities to these people, which isn't the same thing as a blanket grant of immunity. It also gives them the fig leaf of being able to continue to plead the Fifth, because they are still, in theory, in danger of being prosecuted. In the case of Cheryl Mills, she will probably also argue that everything is covered by the attorney-client privilege. That claim is garbage too -- but its been handled with kid gloves by the DOJ, and if the DOJ doens't challenge it, there is nothing that Congress is going to be able to do about it. 57 I have long maintained that government employees - as part of their employment - should not be afforded protections like the 5th Amendment or, in this case, Immunity, when it comes to charges involving the conduct of their government duties.
Posted by: LGoPs at September 26, 2016 12:34 PM (AtCmq) THIS. Posted by: SH at September 26, 2016 12:48 PM (gmeXX) --He certainly would bring that up. He would also bandy around the notion of Presidential Immunity (I believe that there is some case law support for the idea that the person of the president has some kind of absolute legal immunity. IIRC, the contours of that immunity are fairly vague). You would need the Court to decide, I suppose. But you would also need the president to agree to go along with the Court's decision, whatever that may be. There is a textual argument that the only way to get the President out of office is to convict him on a bill of impeachment (with the implication being that regular criminal charges would not suffice). These things get messy because they devolve into political issues, and are not strict matters of law. The corruption of every federal agency that's capable of harassing or intimidating US while covering up the outrageous perfidies of THEM is just too far gone; after 4-8 years of Baba Yaga (or her surviving successor) we'll have reached full banana republic status, if we're not already there. *** Because he's standing between Hillary and her coronation. The same thing happened with left of center technocrat Romney in 2012, and "principled, maverick" McCain in 2008. An objective analysis of Trump is that he's an asshole and green when it comes to global and national politics. The notion that he's the second coming of Woodrow Wilson (our first fascist president) is laughable. Of course, you can't judge Trump without comparing him to her opponent. And if no, does that flow through to his chief agents? Posted by: SH at September 26, 2016 01:05 PM (Ms9Gm) --This is pretty much the argument they would make. It would essentially say that FOIA (and other federal statutes) are unconstitutional to the extent they purport to prevent the president from executing his core plenary powers under the constitution. That's the separation of powers argument. There would be others too. The Courts would muddle the whole thing up so as to give wiggle room to both sides. The resolution of these kinds of power struggles lies in the exercise of naked political power. Congress needs to have the political willpower to effectively impeach and convict the President. That necessarily means that the people have already turned on the President, otherwise Congress would never stick its neck out. Since those conditions are so hard to reach, Presidents centralize more and more power in the executive branch. As executive powers expand, and the people accept the expansion, the difficulty in Congress checking the President continues to grow.Ultimately, you need to have the people willing to enforce a clear separation of power. You need the people to have a willingness to toss Presidents who abuse their authority (even in ways that seem minor) out when they come up for reelection. The people don't care that much. His superiors were turning a blind eye to the brutality brought down upon this suspect, and the suspect had the nerve to ask for justice. The response, coming from his interrogators was: "Justice? Ace: "He could have compelled them by the simple and routine expedient of a subpeona."
That would require a grand jury empanelled by the DOJ/US Attorney. The FBI cannot issue a subpoena. Nor can the FBI empanel a grand jury. Insufficient attention has been paid to the role of the DOJ in actually blocking the investigation by refusing to cooperate with the FBI. The DOJ has acted as the protector of the Clintons and the Obama Administration FROM the FBI. The DOJ was essentially operating as Hillary's own lawyers. That is why she confidently declared early on that she was relying on the "career prosecutors" in the DOJ to come to the "right" conclusion. Unsurprisingly, the media refuses to examine the role of the DOJ or to contrast what the DOJ would have done had this been an investigation free of corruption. And the GOP-E leadership in Congress was in on the fix. There is an obvious conflict of interest in having Lynch control an investigation into Hillary. When there is a conflict of interest, DOJ regulations call for an independent lawyer to be placed in charge of the matter. Congress never insisted on DOJ following this procedure. She is agent of President and officer of the US. I think she could avail herself of this type of defense just as if she were the Preident. Particularly if she was acting on behalf of he president or with his approval.

Posted by: AlaBAMA at September 26, 2016 01:04 PM (2PHKP) I wonder if we're missing where he succeeds. Yes, his debates suck and it all descends into a shitshow - or is that the perspective of informed principled politically active viewers, and to the average Joe Blow he looks confident and takes the fight to opponents and gets at the truth (some of his famous digs at the other candidates hit the mark)? I don't know, but he won the primaries and lasted through all the debates with terrible performances (terrible at least on an intellectual level). Maybe - MAYBE - as a salesman, he's making the sale on an emotional level? Like yes he's an asshole and vulgar and loud and doesn't know a ton of details, BUT he projects confidence and determination and optimism and maybe that's what people want to hear? A tough candidate for tough times who'll dick punch our enemies and make us great again? My prediction is he will be loud and stupid and make me cringe - but that he will also puncture Hillary's balloon and start closing the sale. My understanding is that the FBI investigates at the direction of others, mostly the DOJ. i.e. it can't do investigatory frolics on its own. The article linked here is OK/meh, in that it understates the issues it raises. The catalog-sized set of felonious violations of the Espionage Act and obstruction of justice statutes is just touched on.
So the dereliction here is even worse than it appears. There has long been a mostly wrong widespread belief that some at the top are above the law. CIA director Deutsch lost his position over what by comparison was a minor (if still inexplicably reckless) violation of security procedures. There wasn't the slightest surprise that his comparatively minor failure ended Deutsch's career (and he wasn't being hounded by any political or govt. faction over any length of time prior). So many of what were near-universal popular/populist shibboleths just 15 years ago are now reality. America IS degraded, noticeably and meaningfully, in many subtle but key ways, that simply weren't true even recently. Posted by: rhomboid at September 26, 2016 01:32 PM (QDnY+) 283

She is going to go full Joe Biden against Paul Ryan on him. Talk about his "lies". Laugh and cackle. Shake her head. That's what they've set up in the media. She'll spout one or two talking points so the MSM can swoon over her command of "the facts" and experience. And with Holt providing comfort and cover for any mistakes on her part, it will be tough. Trump better be ready to be "Trump" and hit her hard. Particularly, using her cake against her as she tries to laugh away serious matters like jobs, illegal aliens, muslim violence, Benghazi- if Trump is smart and aggressive, he can ram that right back down her throat. >>>doesn't know a ton of details
This reminds me of the dynamic between Carter and Reagan. Reagan was portrayed in the media as not having command of details, and Carter was portrayed as a super policy-wonk who knew everything about everything. But average Americans got the impression that Carter's executive ability was not very good, and that it was less important to know the details than to be able to delegate properly, to exercise good judgment and to have the best interests of the country at heart and not be constrained by one's own liberal shibboleths. When it was learned that Jimmy Carter actually himself did the schedule for the White House tennis courts, that became representative of his over attention to detail and lack of overall executive ability. US Attorneys from the DOJ had to be involved in the FBI investigation. They are the ones who controlled whether to bring an indictment, and they would be the ones who would open any court proceeding (for, say, a motion to compel compliance with a subpoena). The FBI's job is to investigate and produce a recommendation to prosecute for the DOJ, but the DOJ is involved in the investigative process too, and, in a big case like this, almost certainly right from the beginning. It's not great but not necessarily a smoking gun of abject corruption. They could justify the grants of immunity as a effort to expedite the investigation prior to the election. Otherwise the objects would not have cooperated and the items would not have been obtained prior to election. Yes a political reason. I mean clearly the politics of the situation were the most important thing. If this were a drug investigation or RICO for mobsters, with no election "deadline" those immunities wouldn't have been granted. Its pretty clear one of the main considerations was political and actually upholding the criminal law was made secondary. Its not pretty. Its probably within discretion with the Justice Department to do such things. The Clintons are just gross, and whatever they get involved with gets mud on it. Question for the lawyers out there. It's been my understanding that because the FBI is a law enforcement agency, it couldn't actually prosecute anything. The most they COULD do is recommend prosecution when they hand over evidence to the DOJ. So if that is true, how is it then that the FBI is able to grant immunity from prosecution if they have no actual authority to prosecute?
- That's correct. The DOJ makes charging decisions and grants immunity. And we all know that the DOJ is incorruptible. Posted by: Anonosaurus Wrecks, Now With More Je Ne Sais Quoi! at September 26, 2016 01:43 PM (Nwg0u) 327

But average Americans got the impression that Carter's executive ability was not very good, and that it was less important to know the details than to be able to delegate properly, to exercise good judgment and to have the best interests of the country at heart and not be constrained by one's own liberal shibboleths.
Only an idiot would even ATTEMPT to do more than a small fraction of the tasks under the President's purview. He's there to make decisions, see things get done, and to hold people accountable - i.e., to delegate - not to actually do all this shit himself. No one expects the SecDef to be able to field strip a weapon. The measure of an executive is his ability to select good people, and to delegate to them. While Obama and Hillary have studied Alinsky, I think that Alinsky was a true student of Goebbels, and more specifically the principal of the Big Lie.
Lie so colossally and do it so brazenly that no one will dare call it out as a lie. Use a private server when its grossly inappropriate, but flaunt it in front of everyone, so you can claim there was "obviously" nothing wrong with it. Cover your tracks by conspiring to protect those around you with blatant Get Out of Jail Free passes, and no one will call you on it because the truth (the lie) can't be that obvious. And so, they continue complaining about "no smoking gun" when there's a corpse with an ice pick sticking out of its head. I become physically nauseated thinking about the state of our Republic, and the blatant manipulation of our Constitution and laws. And I feel not a little shame for having done so little in response, but instead going about my business quietly (if with occasional complaint). >>>It's not great but not necessarily a smoking gun of abject corruption.
The smoking gun of abject corruption to my mind is the failure by the DOJ to use a grand jury in this case. This is a very serious and complicated case involving the compromise of sensitive national security information and numerous persons and organizations, and having a grand jury investigate and be able to seize evidence like servers at Platte River, Cheryl Mills' laptop, etc. instead of relying on the voluntary cooperation of people involved is incomprehensible absent corruption. The failure to use a grand jury meant that if the FBI wanted a particular piece of evidence, it allowed the DOJ to hand out immunity to various people the DOJ wished to protect in order to obtain the evidence. And despite all of the baggage, unexplained deaths, corruption and on and on, how is it we still cannot get rid of the cancer that are the clintons? The scam basically works like this, and mainly involves Medicare and Medicaid. The crooks set up a sham health care company - home health, DME, whatever - and get it enrolled with Medicare and/or Medicaid as a provider/supplier of services. They obtain, either through purchase or identity theft, the Medicare and Medicaid enrollee numbers of a large number of people. Then they start filing fabricated electronic claims using these numbers. The claims get paid electronically. They keep this up until the enforcement authorities start to catch on. They take the money and run, then start up another one.

I'm a bit old fashioned in that regard.

HAHA! Some poster on Gateway Pundit said Trump should pull a page from A Few Good Men. Ask Hillary if she ordered the Code Red on Vince Foster.
She might actually want to admit it. She's psycho enough. Hillary: "YOU CAN'T HANDLE THE TRUTH! Yes. Yes I did order the Code Red!" "Oops". Posted by: rickb223 at September 26, 2016 01:54 PM (Hb9w3) 376
If people don't actively stand up to the ClintonSlime, it eventually corrupts them, too, just like any other Organized Crime family.
Compare Comey to Jerry Zeifman, Counsel to the House Judiciary Committee. Zeifman fired Hillary from the Watergate investigation for lying, stealing documents, breaking promises, manipulating the investigation for Ted Kennedy's presidential ambitions, violating legal and Constitutional norms and breaching confidentiality. He fired her, refused to write her a letter of recommendation--and wished he'd referred her for prosecution. btw, she was a nobody then. Much later, when she ran for Senate, he called her a liar and warned voters. Hillary was the only Democrat fired in Watergate, and for the exact same reason as Nixon & Co.--for being a corrupt liar. Zeifman stood up to the ClintonSlime. Comey caved, and now his reputation is dirt, a shabby little footnote to the Above the Law- annals of Clinton Stench. "The DOJ makes charging decisions and grants immunity."
I'm pretty sure immunity requires the DOJ to get an order from a court. Was there a court involved? If so, off the usual grid? Else it was the DOJ just making it up, no? - My experience is state, not federal, but in my experience the usually the prosecutor himself grants immunity. Occasionally the court becomes involved either interpreting an immunity agreement or ordering immunity for the purpose of requiring testimony over a witness's objection. The Clinton body count. Many of these seem tenuous, but there they are. At best, it suggests that any association with the Clintons at all may beget cosmic bad karma
Yeah there is a reasonable amount of deaths that a very powerful, rich person is going to collect over the years. Associates, bodyguards, people you work with in sensitive areas. As you age, the number increases rather radically. But the Clintons... that's way too many for even coincidence. Especially how many deaths are of people who could do them political harm. I looked it up in the DOJ Attorney's Manual (takes a minute online). Lays out the procedure but says its by order to a court. May not matter much, but could be another sign that Hillary & Co got special treatment. The bigger issue is that ordinarily you work to flip minions, not give them a pass up front. Yeah well this is the FBI that gave Henry Hill a pass then found out he was more criminal than Hillary Clinton. They worked with Whitey Bulger for like 15 years letting him get away literally with murder as he used them to take out rivals and troublemakers. Let's just say that since Hoover's death at least, the FBI has not exactly covered its self in glory.

380- Country Boy- like Reagan said, this is the last stand on Earth- there is no where else to go and start over and if they are embedded here, not sure how you get them out and start something new...
There is a great video presentation on government on a website called wimp.com It talks about the differences between a democracy, republic, oligarchy etc. The takeaway from that video that most people don't know or gloss over is that we are a republic and that left and right are false narratives- there is only total government control (see Soviet Union/China) to total anarchy. A republic on the spectrum is somewhere in the middle. But a republic, or a nation of laws, only works if the laws are enforced and applied equally. So yeah...again I don't know how the clintons are able to willfully break so many laws and skate by. i just don't get it which is why i think, Divine intervention. I do not have cable, but 80% of on-air ads are for some kind of health care. Most of those use what you 'deserve' in there or 'it's free' as a hook. I can't figure out if they are just advertising for the SS#s or for their own Medicare/Medicaid hooks.

Insurance fraud has always been a big winner for organized crime. They have been doing it with car insurance for decades, home insurance, business insurance (fings burn, don'ay?) and so on. Any time you can get paid for doing nothing yourself, criminals will find a way to tap into it.
My favorite mob crime was the gas tax fraud the mob was doing in the 80s. They would buy a gas station, run it, collect the taxes, not report it, and keep the money. When the feds started snooping, they shut down the gas station. Back then it wasn't all hooked up and computerized, so they were much harder to track down. It made the mob guy who ran it so rich his bosses wanted to whack him because they were worried he was getting too rich and powerful. Of course the fix was in. They weren't really protecting Clinton. They were protecting Obama. It's completely evident in the way the White House and the media pretend the President never emailed his Secretary of State. The White House knew and did nothing about Hillary or they didn't, and she ran State as a her own fiefdom. Either possibility is damning for Obama.
