IT Specialist Who Set Up Hillary Clinton's Illegal Email Ignores Congressional Subpeona; Two Workers From Company That Hosted Her Server Plead the Fifth Rather Than Answer Questions Truthfully

Nothing to see here, folks. Just lots of Hillary's cronies saying their lawyers have advised them not to answer questions, as the answers may expose them to legal peril.

Just another day of Clinton's pre-Administration.

Pagliano, Clinton's illegal IT guy at State, can't invoke the Fifth, as he was granted immunity by the FBI. He therefore cannot be prosecuted for anything he told them (and if he repeats the same thing to Congress, he can't be prosecuted for that, either).

So he just decided to defy the subpoena and not show up at all.

1 and how precisely is he allowed to do this given he has immunity?

The House should hold him in contempt and jail him.

You can see it here, plain as day. Plead the fifth. Keep your mouth and we'll take care of you and your family. Squeal and you'll be punished.

I think if Hill kicks and/or loses the election, this will all start coming apart. Just like in a Mafia family, it's all based on personal loyalty to the Godfather and fear of retribution. Those two things keep everybody in line. Once the Godfather kicks off, or is thought to be too old or not powerful enough to punish anybody or honor promises of reward, the soldiers start to ignore orders, stop kicking up money, and rebel.

If Hill loses, she won't be able to protect any of these people anymore, her promises of pardons and fake kangaroo investigation leading to acquittals will be forfeit.

That's why they are so desperate to keep her alive and get her to the finish line, even with her last breath. She has promises to fulfill, and if it looks like she can't come through anymore, there will be a vacuum at the top and it will all start falling apart.

It's scary how far and how far up the chain this has reached. (See: Comey) They will do ANYTHING to win this, and I mean ANYTHING. This could get bad.

No. The Marshals Service is part of the DOJ. There are two paths. One is to send the Sergeant-at-Arms to arrest him for contempt. The second is to refer it to the US Attorney for DC. The first hasn't been attempted by the House in almost a century, the second was done for both Lerner and and Holder and we know how that worked out.

Before anything happens there has to be a vote of the whole committee to go after him and then a vote on the House floor.

Everyone will be out campaigning in October so nothing is going to happen anytime soon.

What does the constitution say about... ok never mind.

What was that Quote about 'justice delayed is justice denied'?

So the crimes were committed four years ago, and nothing will happen until there is a Republican president, (if then), and there will have to be a through investigation, and it will take a year or two (after we get a new president) just to get the investigation started, a couple of years for the actual election, and then years to wade through the delays at court, and by then we will have another president (probably democrat) who might well squash the whole thing, some twenty years after the crime was committed. Hell, people could die of old age before that.

I think you'll find that a substantial and increasing proportion of Ford passenger-car production has been in Mexico for a long time.

Very few Ford passenger cars are built in the US. Some larger ones are built in Canada.

Modified for small/hybrid/electric with much hullabaloo, but that didn't pan out, so they're shifting that production to Mexico, and retrofitting (again) for CUV/small SUV production.

211 One thing you have to give the Clintons: they've won.

Even if they don't win another election, they've won.

Nothing will ever happen to them. And they have shown the way forward, from Billy Jeff staring down an impeachment and refusing to resign, to today, they've broken ice and plowed a new channel straight through the Constitution; they've lost none of those who have broken laws to do their bidding.

We've had evidence stuffed in pants, destroyed in front of our faces. I'm surprised they don't just go ahead and tell the truth--it would be easier than lying, and still nothing is going to happen.

It's a safer bet to be on the side of the Clintons than on the side of the law. Seriously. If you were in the State Department when Hillary was there, you would be in far more danger following the actual law than you would be breaking it at her direction. At her implication even.

I think you could make an argument that the Clintons have become more powerful than the Federal Government itself. Name one fight the Feds have won with the Clintons. Plus more than half of the Feds are on their side anyway.

It is funny because the "chicken tax" was basically a protectionist tax that made the Japanese start producing trucks and SUVs in the United States. And they now make them here in droves.

I'm not for all "protectionist" type legislation, but this idea that anything that protects domestic manufacturing is "bad" is a weird, libertarian strain primarily pushed by elite globalists on both sides of the aisle.

We've tried free trade and it's a United States owing China trillions of dollars and manufacturing has largely left the United States.

256 Congress will cite him for contempt. They will then ask the DOJ to bring those contempt charges against Pagliano in court. The DOJ will stonewall. Nothing will happen.

Old school Congress would have had the Sergeant-at-arms arrest Pagliano and throw him into the Congressional jail cell (there used to be one in the Congress building), until he would testify. But that hasn't been used in decades (or longer) and you would still need to have Pagliano be brought into Congress for that to happen.

The DOJ controls the keys. The administrative state rules this country, not our elected officials.

I think the urge is for politicians and frankly people who don't understand free market economics in all countries is to ask big brother government to make things "fair" for them. It has never worked. It will never work. It's a temporary feel good thing that guarantees only one thing, higher prices for consumers. It's not just the US, all counties do this, but as the largest economy in the world by far I'd rather see us lead in a different direction.

335 That's what I figured, but I'm not sure how it applies to a normal

Congress the power to require me to testify in front of them.

Posted by: SH at September 14, 2016 12:27 PM (gmeXX)
--Congressional subpoenas are usually tied to oversight over acts of Congress. For example, Congress passes the Clean Water Act and delegates the authority to administer that Act to an administrative agency, like the EPA. Congress, through the "necessary and proper" clause of the Constitution has the implied authority to subpoena EPA officials, etc., to monitor the administration of the Clean Water Act.If Congress was just issuing a subpoena to a private citizen without regard to its governmental oversight role, I think its on shakier legal ground. But, as in the case when Congress subpoenaed the testimony of major league baseball players (because Congress has the implied power to issue subpoenas in furtherance of its express power to regulate the commerce of narcotics and performance enhancing drugs), Congressional authority may touch more conduct than you would expect at first glance.

At this risk of sounding trollish, Republicans used to do this, too. During the Bush years, some Democrat-controlled congressional committee would run an interminable "investigation" to figure out how to blame stuff on Republicans, and issue subpoenas to Republican officials in the Bush White House, which would be ignored. I don't think Trump or the majority of his supporters are giving up on free trade. All we want is fair trade.

When deals are made to allow a country to use us as a market, we should be able to sell our goods and services in that country. Up till now, none of the genius negotiators have been able to accomplish that deal.

You didn't answer my question, you just gave platitudes.

"Real" free trade for the US would be zero restrictions or tariffs on imports.

So a foreign country could say "100% tariffs for the Unites States!!!" and the US could not retaliate with their own quotas and restrictions. That would be "protectionist".

Things like "trade deficits" would be a meaningless number.

And many of the same arguments for the completely free movement of goods is also there for people.

This might be some fantasy of a few global elites, but the US is more than an economic trading zone.

If you haven't seen the video I posted above he is primarily arguing with a pro-protectionist economist from Berkley. You can probably guess his politics. And they are specifically arguing the history as well as the current use of protectionism in the US economy.

I've got that one in my files, but thanks! That's one my late Dad would still not discuss in detail, other than to wryly observe the SHTF reactions at Mare Island, with both the Brass and civilian contractors.

As for Japanese vehicles. Honda is unique, in that it came into being after WWII, without "deriving" from an established industrial powerhouse.

Mitsubishi is (justly) famous for it's WWII aircraft, Subaru comes from a major shipbuilder, Toyota made lots of Japan's WWII war material, etc.

Honda started by making high-quality piston rings, as the post WWII "Made in Japan" sources thereof, were crap. Where they got the crap to make the rings, I don't know, cause we'd already bombed the crap out of all of their factories that used to make the high-quality rings that went into fighter engines, etc.

Anyway, Honda's making piston rings led to making engines, making engines led to making and selling motorized bicycles, which led to motorcycles, which took over the world, and paved the way for the Honda automotive empire of today.

And quality has always been at the core of Honda's production, ever since those first piston rings.

Someone upthread mentioned Mitsubishi's crash test weakness. Concur. Visit any auto-body repair shop, and they'll tell ya the same.

Alas, Nissan isn't "Nissan" at heart and soul any more. Not since the French bought a controlling interest in the company in the '90s, when they were near bankruptcy.

If you've ever wondered why Nissans began to show so many design quirks around the early 2000s? Just look at a "French curve" on a protractor, and at French cars in general.

Oh, and one other thing. Honda has always kept more of a "fun to drive" quotient in their mechanical souls. G/F's 2013 Accord is an amazingly competent handling vehicle, and I've got just a wee bit of high-performance driving school in my past, so I can qualify that remark with a bit more than just "nice ride" kind of commentary.

I've put that Accord into a very difficult, decreasing radius, off camber turn, at a high entry speed, heavy braking till the suspension compressed into the turn, and smooth, part throttle through the turn to keep the torque pulling the front wheel drive, just enough to keep the suspension in a steady-compressed-state through the turn. The Accord handled it without a wobble or complaint.

Which couldn't be said of the Camry or Hyundai Elantra on their test drives through the same curve.

Fun though, to watch the salesman (and one saleswoman) blanch in fear and clench the door handles in OMG reactions. And no, I never risked catastrophe, just pushed the cars enough to get a tiny chirp of protest from the tires.

The Toyota wasn't bad, just wasn't steady. The Huyndai, with it's electric-assist power steering, is best left to grocery-getting duties, and steady interstate travel. A twisty road tool, it is not.

You could be right and I'm not trying to start an argument. I actually believe that you are right about the timelessness of the free market principles that Freidman was so great at clarifying. My point though is that this (the system we have now) is not the system he was defending. By-in-large, the true constituents of our political system are no longer the American people, but are the global corporatist powers that the Brexiters were attempting to be rid of. This isn't protectionism that protects a country from what might be portrayed as unfair advantages, but it is rather a system that protects global interests from ANY competition.

That's my perspective.

This relates to a story about me being an idiot.

So, when I was in business school all the smart kids were taking a one credit pass/fail statistics course. I didn't know why, and why should I bother with a one credit pass/fail course? And why were they? They all had good GPAs.

Yeah, of course, I found out too late that it was taught by Deming. I console myself with the thought that I was taught by Deming disciples.

Posted by: joe, living deplorably at September 14, 2016 12:40 PM (KUaJL)

It looks like there is a system in place with some States, where the Dems have direct access to the voter registration databases, and have the ability to update and change them.

There is anecdotal evidence that the voter registration of many Bernie supporters, was changed so they could not vote in Closed Primaries.

Given the existence of the Catalyst database, which is a progressive database with fields for what you views on issues are, it is not a stretch to think it also tracks who you support. Facebook is known to give information to this database...

So it works like this... you talk about Bernie on your Facebook page, or other social media... it gets noted and sent to Catalyst...

The DNC then takes known Bernie supporters, and changes their voter registration to Repub, Green, or Independent, using their ability to update the State Voter Registration database, so they cannot vote in the closed primary.

Systems are all in place to make this happen...

If you've noticed that multicultural internationalists, who don't give a rip about Americans, have taken over both parties and are setting policies at our expense, and you want to put an end to their influence, collapsing international trade is the way to go.

There will be a contraction here as a result. There will also be a substantially greater contraction in the enemy nations (China and Mexico for example) we currently trade with.

Here's a guess - feel free to correct any faulty assumptions:

--If they can update voter rolls, they could possibly register a person to vote in more than one county or state to facilitate voter fraud. This could be especially effective in states where there are mail-in ballots because they wouldn't have to hustle around to various polling places on 11/8.

--If they can update voter rolls, they can possibly mess up the registration of declared Republicans/Independents so that they have difficulty voting on election day. If they could change someone's party affiliation they may have the ability to update non-declared Democrats' registration, right?

--Maybe they could also use this to pass on registrations for illegals, dead, and/or fake people? All depends on this was update only, or it included the ability to *add* new registrations.

459 The problem with unlimited, open borders trade with the third world is that the United States of 2016 is a welfare state.

As we have seen (if we allow it) there is hardly any economic activity undertaken by American citizens that cannot be done cheaper either by moving facilities to third world countries with dirt wages and no environmental and labor regulations or by importing foreign nationals by the tens of millions to do the jobs in the United States.

What about the native-born American citizens whose jobs are replaced by cheaper, unregulated foreign nationals?

Well, we have a locked-in cradle-to-grave welfare state. Even as people are removed from the labor force, they move onto one aspect or another of the welfare regime, even, if necessary, under questionable disability status.

As the tax base erodes from higher value-added economic activity moving to where costs are cheaper, we find government increasingly resorting to deficit spending to continue to try to provide the same benefits, especially budget-busting First World health care and education, to the population.

Meanwhile, eroding real wages prompts the government to expand credit in all forms, including printing money and encouraging mortgage, student, auto, etc. debt in order to keep consumer and business spending at the previous levels to mask the economic weakening.

Free trade economic analysis tends to focus on the economic benefit from reduced prices for goods and services by cheaper foreign nationals performing this economic activity. But they don't fully account for the cost side of trying to continue to have a First World welfare state even as native-born American citizens move down the value-added chain or out of the realm of economic productivity altogether.

They have a basically globalist outlook, in which they implicitly treat the world as a single country, and presumably native-born Americans who are priced out of economic activity by regulatory arbitrage or labor cost arbitrage could move to regions of the world where economic activity is growing due to less regulation or low wages.

We still have a huge domestic market that we can use as a carrot in negotiating our trade deals. We should do so in a way that evens the playing field with unregulated, low wage countries while we still have this market and before the de-industrialization of our work force gets further advanced.

460 Actually it predates Keynes. At one point the US had no income tax and was funded by tariffs...
Posted by: Jollyroger

Exactly

Now tariffs make up like 1% of the federal revenue. And income taxes on domestic companies and individuals have been created instead.

And the globalists love this because guess where they now headquarter all their operations? Not in the US.

I would like to see a dramatic increase in tariffs but it would be offset with a lowering of taxes on actual US companies.

What is "unfair"?

if a country sells more to us than we sell to them by a factor of a 1000 to 1, is that unfair?

I think so, but some think that's just dandy.

Posted by: Maritime at September 14, 2016 01:07 PM (RbF5Z)

464 after listening to Friedman and the happy talk of the 80's "free trade",
here is a list from a more realistic view, of articles that deal with the Friedman position, and the several limitations on the theory of "comparative advantage".

Free trade has to consider how much we value the burdens on our own industry, in regards to pollution or worker rights or currency manipulation, and other things that we make part of producing our products, but that can be bypassed by giving our dollars to foreigners.

That's true Dirks, and just because the US can no longer compete doesn't mean that it's a result of unfair trade practices by the countries who are eating it's lunch.

It may be that the US has hobbled itself with regulations and costs that inhibit its ability to compete and that is the reason why its being beaten like a rented red-headed step donkey.

The real answer is its both, and fortunately President Trump has indicating a desire to address both elements.

An open trading regime works fairly well with other similar welfare states with comparable levels of environmental and labor and safety burdens, such as Canada and Germany.

Where we are getting creamed is by requiring economic activity to meet high standards within the United States but at the same time allowing that same economic activity to move to places like China with low standards and yet still enjoy unrestricted access to sell the same goods and services into the same huge US consumer and business market.

In the Army (Airborne infantry), we would joke about the easy lives of sailors but always admitted to enormous respect for bubbleheads. Doing that kind of work under those conditions is as ballsy as it gets.

My late Stepfather was a Pacific sailor in WWII. He said there was nothing sadder than the empty mess halls reserved forsubmarine crews at Pearl. An empty mess hall for a given boat meant they didn't come back, none of them.

Brave men.

--The European socialist systems aren't doing well either. And "low standards" is a comparative advantage in some ways. The answer isn't to force poor countries to adopt US-standards of regulation as the price of doing business in the US. It's to give fair consideration to the value of our regulations in the first place.Do we really want to have OSHA, if we can get rid of it, and employ far more people and have a more dynamic manufacturing sector? Do we really want to price people's labor out of the market by having minimum wage laws?Want to get rid of economic stagnation? Get rid of the regulation. More of the jobs that are "fleeing the country" will stay here. More people here will have jobs. No, the compensation will not be the same -- it will decline. But the current amount of consumption by the US is unsustainable. One look at the projected red ink for our mandatory entitlement programs tells that story.Americans need to adjust to a lower standard of living. We need to get people working, and off the public dole. We need to fairly assess the immense hindrance caused by our massive regulatory/entitlement state, and we need to cut accordingly. We run up the country's credit card and that keeps us from having to make these tough decisions. Its time for that to stop.

Okay, let's talk about free trade again after Congress and state legislatures remove the US regulatory/welfare state.

Except they won't. It's a pipe dream. We need to start the analysis with the existing fact of the US regulatory/welfare state and proceed from there, and not assuming it is not there as so much free trade economic analysis does.

There is no point allowing the American nation to bleed out economically on a point of unrealistic principle.

Posted by: Scalia's Ghost at September 14, 2016 01:26 PM (fgOnp)

Will they even do that?

Sure they will do more than stamp their feet. They will taunt Pagliano about his elderberry scented father and they will fart in his general direction.

The sectors that have too high prices and/or too high wages are those with high levels of government interference: health care, education, housing

The rest of the economy could do fine with deflation and lower wages if this weren't the case.

--I agree. Deregulating/defunding health care (i.e., ending Medicare/Medicaid, repealing Obamacare, etc); ending Housing subsidies (including Fannie and Freddie, the notion of "mortgage repurchasing" by the government and FHA loans), and ending government issued student loans (and making student loans dischargable in bankruptcy), would be a great start.

--The existing fact is that America is a cancer patient and that protectionism is a snake oil remedy (or, at best, a species of palliative care). This particular lymphoma is a society who has been conditioned through normalcy bias for so long to expect a certain standard of living, coupled with a government that increasingly struggles to provide welfare/entitlement benefits and easy credit to people to continue the illusion that their preferred standard of living can be maintained.Perhaps, at this point, the patient is too far gone to take the cure, and will instead choose the snake oil. But that doesn't mean that we should expect good results from it.

Posted by: Revenant at September 14, 2016 01:42 PM (3DSAh)

479 Snake oil gets such a bad rap. In fact, it is high in healthy Omega-3 EFAs.

I'm fine with reducing the regulatory state and agree that it needs to be done.

But until we do, we need to have a counter-balancing mechanism so that goods and services from unregulated countries imported into the US market carry the same economic burden as what is required of US companies.

Otherwise, we are just cutting off our nose to spite our face.
