Let a Thousand Treasons Bloom: Our Nation's Attorney General Refuses to Say If The Law Means What It Says When It Says That Giving Secret Information to a Non-Cleared Person is Illegal

To save Hillary Clinton, they had to put flamethrowers to the whole village.

Sometimes it takes a village to free a felon.

John Sexton digests the incredible exchange from the House panel's quizzing of Lynch earlier today:

Chaffetz: Does an individual need a security clearance to review or have access to classified material?

Lynch: Well, congressman, that issue would be dependent upon the agency for whom they worked and the nature of the work that they did with respect to…

Chaffetz: Can you give me an example where you don’t need a security clearance to view classified material?

Lynch: No, I believe as I was going to say, they would, but the type of clearance varies with every agency and the agency would make that decision and determination.

Chaffetz: Is it legal or illegal to share classified information with somebody who doesn’t have a security clearance?

Lynch: Congressman, it depends on the facts of every situation. You’d have to determine how that sharing occurred. You’d have to determine the means. You’d have to determine the reason, the intent, um, certainly depending on how you view the statute it could go any number of ways.

Chaffetz: So you think there is a scenario in which you could share classified information with somebody who doesn’t have the requisite security clearance?

Lynch: No, I would not draw that conclusion. I would say that I’m not able to answer it as a hypothetical but there are a number of factors that would go into the decision and one could have any number of results.

"This exchange continued for several more minutes," Sexton adds dryly.

At every turn, Lynch reverted to her scripted, mob-lawyer-vetted non-answer and refused to say if it is still a crime to disclose secret information to a person unauthorized to receive it.

I can understand her confusion -- the law is very vague. Secret documents are routinely stamped, "It is a felony imprisonable by up to ten years to disclose this information to any unauthorized person."

I can understand this unqualified hack's confusion on the issue.

I'm frustrated beyond anything I've been in these past 7 years and the only comfort I can find is religion, specifically throwing my hands up and assuring myself that God will fix this in the end, but my inner justice meter is pegged at eleven and I'm itching for someone to take a stand in a way that will actually be effective.

Fuck, I am tired of this. Hopeless doesn't even being to describe our situation. To those putting their hopes in Trump, I mean no offense, but I can't see him being able to do anything, once all of our disposable laws are once again rigid and firm, backed by the full strength of the justice system. Trump would simply be 1/3 of our system, unable to use the magical phone and pen that apparently only works for King Obama.

All I say say, sir, is that you are not alone. I had hopes, once, that the military might stand up and set things right. But alas, it seems the leadership of that organization has become politicized as well. One might suspect state secession or a popular uprising might be in order. My money is on the latter and boy will it get messy. Given the events of the past few weeks, there is a sense of growing unease in this country the likes of which I have never seen that seems to point in that direction. Granted, I was born in the early 70's, but still!

If only God, karma, or whatever would give us a positive sign that things can be turned around. That's the hope; I'm prepping for the worst.

Who's authorized? How are they authorized? If someone works for someone who's authorized does that provide and umbrella of coverage or not?

See it all depends on a Bureaucratic rule. I don't believe the statute defines who is authorized other than perhaps stating that the Department that classified the information may be the one who can authorize the people allowed to see it but it may not be that straight forward.

There may be blanket authorizations.


It's not as clear as some would think and as the movies show. (God, Hollywood has a lot to answer for how we perceive how our country works, hell, how the universe works)

Anyway Lynch actually may be correct that the rules of who is authorized under what conditions may vary depending on who classified the particular information, who or what Department received it and from who or what Department and for what purpose and who saw it or allowed it to be seen.

It's a tangled mess as classified information rules are made mostly by whoever classifies it as classified information.

To reiterate what Don Q. said, there are rules and your scenario violates how classified material is supposed to be handled. It's just that this administration has made a decision that Hillary! will not be punished for violating those rules.

To have access to classified material you have to have a security clearance of the appropriate level and a "need to know." If you don't meet those two requirements, then no classified material for you.

You never ask a question to which you do not already know the answer.

You never answer a hypothetical question because that answer will then be used outside of the hypothetical.


The hypothetical question tactic is what is used to back a witness into a corner and to move that witness from the general to the specific. So if this than that, right? So if that than this, right? So if this and that, then why does that not apply to this specific set of facts?

That is exactly what was going on here and exactly why Lynch was being evasive. The trick, and what I was whinging about, is to be evasive in your answers without coming across as twisting yourself into a pretzel too obviously.

The problem with muslem nations is not that they don't let women vote. Muslem nations don't let anyone vote for anything, generally. But even that isn't the issue since when they do vote they vote for insane jihadi parties and lunatic dictators.

That aside, it is very clear that universal suffrage is a sort of retarded idea that has not yielded any positive results. There should be some minimal knowledge of the structure one is voting within and there should be a requirement that the voter is not living off of the structure he is voting to give a voice in how it is run.

There really doesn't have to be a civil war. Just a secession. At this point, does any actually not believe that the country is irreparably split, no matter what side your on or why?

I did.

I learned that if us white racists would just STFU and stop being racist and trying to arrest poor black men for crimes, then maybe crazy black folks wouldn't have to shoot so many cops and white people.

I also learned that guns (in addition to being available at any grocery store, right next to the adapters that make them fire faster) are more accessible to teens than books or computers (did all the libraries burn down?).

Most of all, I learned that we have disappointed Obama again. Why can't he just eat his waffle and hang out in Europe with interesting Italians? He's had to go to way too many of these things.
