Ok. Said I was leaving but this is a little asinine. 55 Meh, technically yes, its assault but its kind of the "technical legal" version of assault, not the kind you'd particularly think of just hearing the word. For me assault is being hit in the teeth with a beer bottle, not being grabbed and shoved.

I don't care for anyone treating a lady like that, but seriously, as assaults go this one is on the low end, and I'm confident 90% of reporters covering political campaigns are going "What? That's just a Tuesday."

Were it not Trump-related, it probably wouldn't be. Campaign staff charged with assaulting a woman just helps that.

Posted by: RawDogRevolution at March 29, 2016 02:25 PM (10hEu)

99 I agree with those who suggest this is a fairly minor incident.

From what I remember, Fields only asked for an apology from Lewandowski. That's it. No big deal, right? All he had to do was say "I'm sorry, I was trying to clear the way for Mr. Trump and I should have left that to the security team. Please forgive me, Ms. Fields, it was nothing personal." How hard is that.

Instead, Lewandowski went on to deny that he ever touched Ms. Fields and then apparently there were some funny things that went on in the gossipy world of Breitbart and their friends in the Trump campaign.

And then there is the war-of-words that results from any contact with the Trump campaign that isn't fawning. So she gets upset at all this and turns the volume to 11 on it and files charges and then people get involved and post audio and video clips and it becomes a proxy war.

And here we continue.

But all that had to happen was for Lewandowski to just apologize for something that actually happened instead of lie and then demean Fields. Bad choice.

101 Appears to me that he was rushing to catch up to Trump, but as he approached her, he saw that he would have to pivot sideways to get between her and another guy whose back was to the both of them. So he grabbed her arm as he went past as opposed to just bowling her over.

The guy should have said "excuse me" or "sorry" when he made the move, and once she complained, he should have said that he grabbed her elbow as he went to squeeze between her and the other guy, didn't realize that he impeded her as much as he did, and then publicly apologized.

Yeah. Because they would never use WAR ON WIMMENZ tactics on a guy with a higher moral and ethical standards than DT. A family man committed to his beliefs and his morality. A man of character.

If we had a guy like that , there would be no way that the Progtards could attack him and cause a General Election defeat due to false "woman-hater" allegations.

A public apology as demanded would be the worst possible PR reaction. An apology is proof of guilt. The next step is that Trump must FIRE Corey. If he doesn't, then the apology is used to hammer him. If he does, then a new event is sought to attack the campaign.

Trump and his campaign are playing this "game" correctly. Which shows they are the most qualified to be sent into the fray against the Democrats + Media for the GE.

142 Looking at the video it's clear that he grabbed her left upper arm as you can see his hand and her sleeve being held. While it appears that he pulled her backwards, I think that's actually an effect of her being held in place while everyone else moves forward. If you look at her feet you can see that they stay in the same area. As for her almost falling to the ground, it looks like her feet might have gotten tangled up or twisted, probably from her lower body still trying to move forward while being impeded. IMO this could jive with her claim of almost falling, particularly since she was wearing heels, but it doesn't jive with being pulled down. Some of the trouble I had was distinguishing her yellow shoes from the light colored pattern on the carpet, but it does look to me like her feet are in an awkward position.

More problematic for me is that the bruises from her twitter photo are on her forearm while the video shows her upper arm being grabbed. Now it may be that he grabbed her forearm first but I couldn't really tell from this video if he did and I'm not bothered enough to go look at the other videos for comparison.

Can you honestly say that you see battery in that video? I see and individual who was grabbed in the midst of a crowd at a political gathering. Not violently attacked.
We have enough real crime in this country that chokes our courts, real crime that needs attention and needs to be dealt with by the courts. This is political theater at it's finest.

187 Like it or not, he did commit a crime. Agree with it or not, he's getting charged. The police charged him. If there was no crime, they wouldn't have charged him.

Sure, but prosecutors have discretion whether they'll file charges on every crime or not, and typically in this context with this kind of situation and this kind of event, they won't. Usually, people don't even file, because it happens all the time any time security is involved in an event.

That guy that tried to grab Trump's leg and yank him down? Got treated pretty badly. He could have filed for assault - and technically he was assaulted. But any sane prosecutor would have shrugged at it.

Exactly. Bruises + video + witness = prima facie case for battery. When you add in the libel against Fields that followed, what you have are the ingredients for a defamation lawsuit.

Indeed. ISIS is cutting off heads, crucifying people, and blowing themselves up to advance their cause. Meanwhile, we're devouring our own because of a supposed crime when I personally suffer far worse nearly every weekend while getting bumped on the basketball court. I've tried to tell myself that I must be missing something or that I'm somehow unreasonably biased but I've reviewed every camera angle out there and I just don't see it.

Not much hope for western civilization here either if this is what now rises to the level of battery. We've become way too insular and soft.

Wow, that's great -- he's almost at 50%...of 50% of the electorate. Why, that's a whopping 25% of the electorate that could bring themselves to vote for Trump, over a still-warm dog turd.

He'll coast to victory over Hillary with that crushing 25% to 50% advantage of his.

And yeah, I realize Cruz has only 30% of 50% of the electorate currently in his corner. But Cruz is someone every actual conservative could get behind. Trump is not. That's why he's the Chosen One, chosen by our betters in the media and the left, just as were McCain and Romney.

So it's possible that instead of just saying that they didn't remember, or denying it, they responded in their usual brusque fashion.

I don't know. If they are as aware as we are about most reporters being dem operatives with bylines, AND the pnchat for Crazy to come out around politics AND wealth, this isn't likely the first time it's happened.

The issue is that Lewandowski is not an agent although he appears to have permission to be within an area secured by the Secret Service. Jim Hoft tends to be, shall we say, on the _overexcitable_ side. And not inclined to spend time on fact-checking.

I recall during the looting in Ferguson, when Hoft put up a photo of an armored vehicle at Gateway Pundit and very luridly headlined it something like U.S. ARMY TANKS DEPLOYING TO FERGUSON STREETS / MASS SLAUGHTER IMPENDS.

The photo was not even of an actual tank. But rather of an Army self-propelled gun on the back of a trailer, being hauled along an interstate highway some distance from Ferguson proper, transferring between depots. Needless to say, no armored units showed up.

Those are all true statements.

Do you see Fields almost collapsing to the floor, barely recovering her balance through acrobatic feats? She said she "almost fell to the gorund". She took a step back.

Do you see her arm pulled out its socket, blood flying everywhere? No, it wasn't that bad.

Having lied about not wanting to be the story, and about the facts of the story, and having demanded a public apology where none is merited ... I look forward to seeing what happens in the legal process.

386 The only defense that the Trump fans seem to offer are straw men consisting of wild exaggerations of what Michelle Fields claims happened which they knock down to the applause of the other Trump fanbois.

What the video shows is that Michelle Fields modest claims seem to be the truth. The event itself does not reflect badly on Trump who was probably not even aware of it at the time. It does not even reflect that badly on Cory Lewendansky who was just doing his job a bit too enthusiastically.

What does reflect badly on Lewendansky is that he lied and he was not willing to fall on his sword to protect his candidate. If Trump keeps Lewendansky on after this video has come out, it indicates that he endorses lying or that he has really bad judgment in hiring.

Trump really has no other option but to tell Cory Lewendansky"You're fired".

I imagine that she thinks she is unforgettable in her own mind, but his closest staff have to deal with people like her all the time. 3) This who thing is stupid on all sides. They should have just apologized, and the refusal to do so is one of several items that hardened my opposition to Trump. Mostly I blame Brietbart for turning this into a circus, and not settling this thing privately.

4) He won't lose any votes over this, but he won't gain any either. This incident, combined with the Heidi Cruz tweet is hardening his ceiling. Ultimately, this has been poor campaign strategy.

There are excellent arguments to make against Trump. Things he really is weak on and that matter.
His campaign manager being an oaf isn't one of them. Even if don't like the way the snafu was managed. Its a process argument for pete's sake.
There are solid fundamental reasons why people should consider whether or not to vote for Trump. What are his positions, will he do what he says, can he do what he says, can he even win? What other options are out there. . . .allof thesethings are important things to talk about.
Mr. Lewandowski and Ms Fields are not among these things. Asdelightful asit is to delay thinking about hard stuff in favor of wallowingin socialscandal, it ain't gonna help my babies . . . .

(1)(a) The offense of battery occurs when a person:

What Lewandowski did was misdemeanor battery under (1)(a)1. And whad'd'ya know, that's exactly what he was charged with. And he could've avoided it by simply apologizing to Fields at the time. But the Trumps are smarter than everyone and better than everyone; they never apologize, never take a step back and consider options.

Who's trying him in the court of public opinion? Jesus. The police department in Florida felt there was sufficient evidence to charge him with battery. He's been charged, and now owns a notice to appear for a crime which can carry up to a year in prison. They looked at the tape, recognized him, saw him commit an act, charged him with the crime and here we are.

515 it's kind of astounding how so many people willfully miss the point. All the Trump campaign has to do that night is say "we're sorry, it was an oversight, here's a free dinner on me" or something and this disappears. Just act like a normal human being after the fact and this is gone.

But no, the entire campaign has got to act like Trump, and any challenge is seen as a direct challenge to his virility and the Purity of his Bodily Essence. So everything, even the tiniest challenge, is met with Absolute Denial and stonewalling - EVEN THINGS THAT ARE TOTALLY TRIVIAL.

It's not about the grab; the issue is that the response clearly demonstrates that Trump is a functional psychopath who is unfit to his core to lead this country. And his fans are the equivalent of those sad women who write letters to Charlie Manson begging to marry him. Police departments don't file charges. He's not appearing for a crime, he's been accused of one and will then be tried in a court to determine if he is guilty or not guilty.

They looked at the tape, recognized him, saw him commit an act, charged him with the crime and here we are.

520 To all the Trump people saying the grab is no big deal: you're right, it wasn't.

And then the Trump campaign made it a big deal because they're a bunch of incompetent, impulsive liars. Cory'so dumbassery turned it into a big story. A story that played into one of Trump's biggest weaknesses and the favorite DNC media attack (#waronwomen).

And then he doubled down on stupid and got criminally charged.

But no, Trump's gonna be a great President because he's going to use his business skills to hire only the best and brightest. Like Cory Liardowsky

This stupid thing flipped a lot of people (including Ace) from Trump friendly to never Trump. It caused a small scandal and employee rebellion at one of his biggest media boosters. AND it was all a punch from nothing due to sheer incompetence from Trump's top guy. It single handedly disproves the idea that Trump is some sort of master of media manipulation. He's not--he's just a master at getting attention.

Trump's big vaunted "medIA advantage" is a freaking joke. Like when Lizard Mair's package scored an own goal with that dumbass melanin ad, and Trump managed to spin the situation to be more damaging to HIM.

521 Y'all need to get your facts straight. Lewandowski is charged with battery - an intentional, unwanted touching- and not assault - a threat of harm or unwanted touching. He may be guilty of nothing more than moving her aside while striding on his way across the room. No intent of harm has been shown or proven.

Posted by: Factcheck at March 29, 2016 04:18 PM (XRCeV)

522 The way I see all this:

- Every person involved in this incident has given some false statement
- Every observer has already decided what's happened. Videos will only reinforce what they already believed.
- It's fine with me any decision you've reached based on the evidence presented. The only thing that isn't allowed is believing the resolution in court is a minor issue.
- If Corey gets any kind of punishment, nothing can be salvaged. Maybe Trump wins enough delegates, but it will be president Hillary.
- If Corey gets exonerated, Trump team gets a big win. He'll claim to be the target of a political persecution, he gets cred for standing by his guy instead of taking the easy road and it will be milked for months. It obviously doesn't necessarily mean he'll beat Hillary.
- Piers Morgan is a shitlord, Ben Shapiro calls him sexist, a circle has four sides.

523 "Since the Secret Service has said Fields touched Trump twice as they
were walking (and was told to step back) should Trump look to file
simple battery charges against her? Seems her touching meets the
statute, and against a protected Presidential candidate no less!"

Casual contact does not meet the statute, to violate the statute the accused must have the proper "mens rea", or guilty intent. In the case of Lewandowski, it was the intent to physically control her positioning through aggressive physical grabbing. Casually bumping someone while in a crowd is not battery, otherwise everyone at every sporting event in any stadium ever could be charged. And Trump killed his chances for making any claims against her by stating publicly for more than a week that nothing of any kind had ever happened. His own words from the last week can always be used in any courtroom to show that in his opinion, nothing untoward had happened that night.

But it is also astounding that so many seem to be ignoring the fact that she only pressed charges because the Trump campaign was saying "you're lying, if you were telling the truth why don't you press charges?" So she does what they ask for, and now the Trumpbots are all butthurt and whining "oh you're such a big meanie, why did you press charges?"

Because you literally and specifically asked for it. Doesn't get any more simple than that.

525 I've seen worse "batteries" on Black Friday at the mall.

Michelle Fields violated the Trump Secret Service circle. That's a felony right there (if the SS decided to charge her).
Trump's SS detail has confirmed that she touched Trump twice (that's 2 simple batteries) and was warned by SS to get back.
The pictures of her alleged bruises are on her forearm she claimed were from the incident are brown (indicating at least a week old), yet Corey is clearly touching her upper arm, not her forearm.
She claimed point blank that she was jerked back with such force she almost fell down -- that didn't happen and not anti-Trump hysteria changes that. And that is what Corey was denying when he said he didn't "touch her" -- he didn't jerk anyone so hard she almost fell. Expecting him to remember this quick brush-aside is bogus.
Trump supplied this tape we're seeing today to the police -- it's from his facility. If you think he didn't have lawyers review it before that, you're crazy. The Dem Hillary supporting police chief couldn't help bringing these bogus charges which will be quietly dropped after the campaign season is over.

The MSM didn't give a shit about our ambassador and 3 others being murdered in Benghazi, nor about our ATF officer being murdered in Fast and Furious, nor about Hillary's email server. THIS they're setting their hair on fire over.

Anyone who really thinks they're on the right side to be joining the MSM on this -- you're wrong. You're supporting using the police to punish your political enemies on trumped up charges (no pun intended).

533 Factcheck - you don't quite understand what the separate charges of Assault and Battery constitute, although you get kinda close.

Assault is the threat of an act, with the intent to control someone's actions by means of the threat.

Battery is the actual act, with the intent to control someone's action by means of physical coercion. Pushing someone out of the way, if that action is unwanted, qualifies as battery. So does unwanted grabbing, or hitting, or any of a host of physical actions.

Although these two often happen together, assault can happen with no actual touching, and battery can take place with no words spoken at all. Usually the question is only whether or not the touching took place. Since the tape exists, and clearly shows that the touching happened, then the applicable legal phrase would be "res ipsat loquiter". Or to put it in laymans terms, Lewandowsky better cop a plea and take probation.

"He may be guilty of nothing more than moving her aside while striding on his way across the room."

You have just described an actionable act of battery, especially in a case of a man shoving or grabbing a woman.

There is no requirement to show any level of harm from a battery, the only legal requirements are to show that the physical contact took place, that it was done intentionally (mens rea), and that it was unwanted. A man lightly squeezing a woman's breast area, for example, can be charged with battery as well as sexual assault if the touching was unwanted. In this case, the bruising simply confirms the level of severity of the touching; but no physical evidence of harm is required for the law to have been violated.

And it is no legal defense to state that the injured party was initially reluctant to file charges; that is considered the default position of a reasonable person. As we keep saying, she only pressed charges because Team Trump pushed her into doing so.

Reluctant to file charges is a very different thing than planning to brush off the charges because it was so minor of an offense.

Defending a thug who hurt a woman and then lied about it even though there were security cameras everywhere is bound to do wonders for Trump with female voters.

I know because the same thing happened to me. One day, I was walking through Brentwood wearing a ski-mask and gloves, innocently holding my Bowie knife when some woman and her boyfriend tried to knock it out of my hand. Five times. With their throats.

Bitch had it comin'.

Forget it, they only see what they want to see, they only remember what they want to remember. That's why they keep saying things that nobody but them have been claiming for the last few weeks. Their story keeps changing so they say THE story keeps changing.

Bottom line, Trump is a dishonest douchebag that attracts people who identify with him. That's fine, but it's also going to get either Hillary or Bernie into the White House because the rest of us don't see enough difference to support him under any circumstance.

563 "Reluctant to file charges is a very different thing than planning to

You're taking other people's words and imputing them to Ms. Fields, but in fact there is no record of her ever saying that she considered it a minor offense, just that she was originally reluctant to file charges. You can't use other peoples remarks against her.

From a lawyers point of view, (or from the DA's), Ms. Fields has been the perfect client, in that she has acted consistently from the beginning and has never changed her story. On the other hand, Lewandowsky is a defense lawyers nightmare, since he publicly lied in an undeniable way several times. That's why he's gonna have to take a plea and probation, if it goes to a jury they'll give him jail time for the arrogance alone, and also because of the man vs. woman thing. Juries are like that.

I was discussing someone else's hypothetical, and explaining to him that it's a bad idea to say, "I was going to brush it off because it was so minor before changing my mind."

Great job proving how grievious of an incident this is...

As for what Fields has actually said, her initial story does not match the current video evidence, and I look forward to her charges getting shot down in court.

At best, she might get a tiny wristslap of a penalty on Corey ... but now the precedent is set that her battery on Trump needs to be prosecuted.

You know there seems to be some mild type of insanity that's running through the right. It's this bizarre belief that if you can only get the invocation right, that if you can just say the words in a very specific manner, then the media will not call you a misogynist, racist. That if you play fair then they by extension will be shamed into playing fair. How has that worked out for you so far?

But I know, that's weak and the liberals will win and we must never, ever, ever show any error. Because they are mean and cheat.

Submitting and losing to liars is not a principle, nor is it a decent thing to do.

Fields lied about what happened. Her account of what happened, In Her Own Words, does not match the video evidence.

She is welcome to press charges and see this through the legal process.

If she was actually wronged, you should be delighted that Corey is about to get fined and punished, rather than complaining about how so many people are mean and indecent.

That wouldn't have stopped this. This is all they've got left. Well, that and his own tendency to stick his foot in his mouth. However, they've about pushed it too far, and now this blown up bunch of crap is about to go positive for Trump thanks to the loyalty he's showing to his employee. I'm pleasantly surprised that he's got the sand to stick with the guy.

577 Reporters are always trying to access Presidential candidates, and it's part of the job of the campaign manager to essentially act as "bouncers" towards them, and that's all this looks like.

This shows the narcissism of Fields in her "how dare you handle ME that way" attitude (when they're all treated the same way), in her exaggerated initial account of having almost been knocked down (which is laughable), and especially in her getting enraged at nobody even remembering this "nothingburger" incident with a nobody - and pressing charges. Then quiting when her bosses wouldn't climb on board he Special Snowflake train (a few other special snowflakes followed). Gimme a break!

It also shows the media bias (even on Fox, which seemed to have warmed up to Trump after Rubio faltered) which is focusing on Trump's people "lying" for apparently not having remembered a non-event with somebody they'd never heard of, rather than the obvious fact that Field made a big fuss over nothing, to the point of lying about it herself, saying she had almost been knocked down.

I can't imagine anybody - especially a male person - agreeing to be interviewed by this kind of drama queen. Ordinarily, her career would be over, but perhaps this will somehow make her a Darling of the Left and she can go work for MSNBC, if Megyn Kelly doesn't beat her to it.

578 This SHOULD have been a nothing story.

Lewandowski (I probably misspelled, but I'm not going back to get it right) should have immediately said that he didn't intend to harm her, he was just protecting his candidate and he's sorry that hurt her.

And then nothing else would have come of this. It's a NOTHING story...

Instead, he doubled down on "I DIDN'T DO NOTHING, NEVER TOUCHED YOU, NEVER SEEN YOU, YOU'RE JUST NUTS!"

When the video backs up her story that he did grab her and move her around, and not his of "I didn't do nothing!" it's now about how Trump and his supporters will not apologize for anything.

Except now the Trump supporters are trying to say that "it's just a nothing story! He didn't really hurt her all that bad".

Great, that means that a simple apology should have been the response from Lewandowski and the Trump camp, right?

Sooooo.... where is it?
