FBI Expanding Hillary Email Probe To Include Investigation into "Materially False" Statements

A Clinton? Making materially false statements to avoid conviction on other matters?

Surely you must be mistaken.

But I'm not happy. I'll tell you why in a moment.

The FBI has expanded its probe of former Secretary of State Hillary Clinton's emails beyond a provision involving "gross negligence" with national defense information, Fox News reports.

Agents are now also looking at whether statements that have been made violate a federal statute on providing "materially false" information, according to Fox.

"The agents involved are under a lot of pressure and are busting a--," an unidentified intelligence source told the network, which noted that the statute can be broadly applied.

Here's what I feel in my gut:

This is just clearing the decks of all possible charges, so they can say "nothing here can be charged against her."

I remember during the OJ Simpson trial. During deliberation, the jurors asked to have the transcript of a particularly damning bit of evidence against OJ -- I believe it was the hired car driver who reported OJ's lateness to come to the door, state of agitation when he got there, and strange driving instructions afterwards.

I remember people saying "That means they're going to convict him."

I felt in my bones that what they were doing was looking at this as the last, damning piece of evidence they had failed to yet dismiss entirely, and they were re-reading the transcript just to see how they could dismiss this testimony, too.

Which is, alas, exactly what they were doing.

I think the FBI is corrupt at highest levels -- not at the agent level, but at the level of the political brass, and they are sifting through each charge to find a way to say Hillary did nothing wrong. Oh, they'll do what they always do with the Clintons; they'll come up with a "compromise" that gives the Clintons what they want. They'll say what she did was "reckless" and "against all security protocols," which they'll offer up to prove this wasn't a whitewash.

But in the final analysis, in the last paragraph, they'll say: "Despite some serious misgivings about Secretary Clinton's handling of the information and her candor in describing her actions, the panel can find no actual breaches of the law in anything she did."

Then the Clintons will do what they always do, and say, "If we're not convicted and in jail, that means we're innocent. We have been cleared of any possible wrongdoing. These questions have all be asked and answered. This was always a right-wing witch hunt and now we have the proof. This is old news. It's time to MoveOn.org."

I just don't feel like we live in a Republic anymore. We live in a gangster country, and the top of each agency knows they have to curry favor with the reigning gang.

7 That's why the GOP strategy of focusing on the illegality of her actions is misplaced. Instead, they should be focusing on the lack of judgement and what that says about her fitness to be President. This angle isn't dependent on a corrupt DOJ or FBI to prosecute, and it goes to the issue that matters most: do voters feel comfortable with some one as stupid and reckless and Clinton in the White House.

I have several friends who've had FBI run ins due to their pro-life work.

One is the son in law of Jill Stanek, the nurse who testified in favor of BAIPA several times and who really, really pissed off Obama on a personal level.

Anyway, her son in law is from New Zealand. Her daughter used to work for President Bush both as a speech writer and later for his library. Obviously the family was zero threat to the security of the nation.

Even so, the FBI visited their house and told the husband that if he ever showed up at an abortion clinic in the Dallas area again, he would be deported and never again allowed entry into the country.

We may never see where the real action is:  Clinton Cash pay-for-play.  Peter Schweizer, author of Clinton  Cash, has laid out a prima facie case that Hillary traded favors as Secretary of State to shakedown fees for Bills speeches and donations to Chelsea Clinton Legacy Foundation.  Schweizer recently made the point that we still don't know the names of 1,076 donors which were funneled through a Canadian affiliate of the Clinton Foundation.  There's your smoking gun.

Evidence of pay-for-play could be on Hillary's server. But will the FBI go there?

ace you are absolutely right about the "no longer a republic part" but the problem is that it is not uniformly so, and the disastrous consequences of this do not equally affect all. So you get this diffused sense of disaster, as opposed to a clear and unifying one.

The very plausible suggestion of corruption at the highest levels is also key. That's the kind of special poison that most distinguishes (well, distinguished) the US from the majority of awful and inferior governments the world over.

You go to a Mexico, or a post-Soviet Georgia, or a Nigeria, and you look at things, and you don't know where to begin. Because every lever you try to create and push on to improve things is termite-eaten by the lack of integrity at key locations.

Very hard to pinpoint the main causes. But in a practical spirit, one could focus on judicial tyranny/lawlessness and congressional surrender of constitutional balance as a start.

Ignoramus adds a key if only further dispiriting point. The pay-for-play, from the 7th floor of State, involving the actual policy of formerly the world's sole super-power, has no analogue in US history, and is firmly in the Third World category.

Superlatives fail in describing the corruption and idiocy that now swamp this country. Though it's academic. Only a small and clearly non-controlling portion of the electorate cares or understands.

And the cherry on top: even when, in a feeble spasm of the corpse, a mid-term election (or several) and sub-federal elections deliver a decisive rebuke to the destructive policies being pursued, not much happens. The electorate is largely OK with idiotic policies - and on the few areas where they show some sense, as with O-care and amnesty, the non-republic crams these policies down, relying on outright executive lawlessness and wildly lawless judicial usurpations.

Not true. Many retire, I know a couple. They can still sit in a retired status, but if they don't want to they do not have to.

You might be right. The FBI just might be clearing the decks to release a finding of: "Clinton was somewhat reckless. But no law was broken, here."
- I think the intuition you're sharing seems disturbingly plausible.

But consider what the FBI would be risking if they did that. They wouldn't just be setting an atrocious precedent that could embolden other malicious assholes to similarly jeopardize national security in the future. (And make it harder to prosecute them.)

The FBI would also be risking their credibility and standing with the public at a fundamental level.
No, most Americans are paying close attention to conclude the FBI is corrupt if it fails to prosecute obvious criminal activity.
But enough Americans are closely watching that if the FBI exonerates the obvious criminal behavior and corruption of Clinton in plain sight of God and everyone that they run the risk of turning themselves into a sick national joke. - An enduring punchline.

The O.J. jury was disbanded and largely forgotten after the acquittal. - It was not a long-enduring organization with a professional purpose.

But the FBI will have to live with pushing an obvious lie on the American public. Worse, it's a lie that declares: "We don't take national security all that seriously."

That's a tall, nasty order. And it's not clear what they would get in exchange for fulfilling it either.

Will the upper echelon of the FBI really be willing to risk that a huge and outspoken swath of the American public would PERMANENTLY lose all confidence in them as an organization? Will they risk being forever dismissed as a corrupt arm of the left? Worthy of defiance on political grounds?
That'd be a dangerous game to play and to encourage others to play.

Maybe they'll do it. But it still seems at least unlikely.

The same reason that each state requires you to take a bar exam before you can practice law in that state.



Each state's laws are different. The laws in NY may not be the same in SC, etc. A state judge commenting on Federal issues would have no more authority than you do. Huge over site on Fox's part.

For years Mark Felt's role as Whitewater Deep Throat was kept secret. His motivation was to respond to Nixon's appointing an outsider to head the FBI upon J. Edgar Hoover's death, and personal revenge for being passed over for the top spot.

252 My 'experience' with the FBI was living around Boston when the Whitey Bulger stuff broke . I read the Globe every day , but only for the sports section , snark snark . As that unfolded ( sic ), more and more the sense grew these FBI guys are dirty as sin . So beginning with The Departed , the rest of the world knows that a couple of FBI guys were dirty , very dirty . And now anyone paying attention knows that it was not just the two lead mutts that were dirty, the whole office knew that the FBI was in bed with Bulger . Regarding comment #255:
It's funny. Optmizer's blow-by-blow answers to my posits and questions gives me even more confidence that the FBI is not likely to be doing the Clintons any favors.

Especially the part where Optimizer says that what the corrupt members of the FBI would get out of it is that they would: "...get to keep there cushy jobs, for a start..."

That gave me serious confidence. Who is gonna fire them? Hillary Clinton as she forced to exit the presidential sweepstakes to lawyer up against an FBI prosecution? Riiiiiiight.
Oh, not Hillary? Well then, perhaps Barrack Obama would fire them in his LAST YEAR IN OFFICE - utterly destroying his legacy as the House and Sentate GOP filed impeachment charges against him for what the entire nation would see as a blatant effort to thwart a legitimate FBI investigation/prosecution.
If the FBI recommends prosecution of the criminal Hillary Clinton: THE ENTIRE COUNTRY WILL LOOK UP AND NOTICE.
It simply won't work for Obama to pretend he's as smart as Trump and say: "You're fired." Nixon tired that. And it didn't work for him. (And Nixon won two of the biggest landslide elections in US history.)

That leaves bribes. It's interesting that Optimizer didn't mention that possibility. And that's because that would require a special kind of mass-conspiracy corruption (grassy knoll JFK kind of crap) that is even more implausible.

The fact is, if the FBI corruptly refuses to recommend prosecution, it won't be for any quid pro quo. It will be because some SEVERAL somebodies at the top already really love Clinton or are already really beholden to her.
That's possible. But unlikely.
And barring one of those two unlikely scenarios: the FBI won't be getting ANYTHING out of utterly ruining its standing with the American public.

So, yeah. The FBI might end up passing on going after Clinton. - It's plausible.
But no, it's not likely.

Now isn't that precious.
