A treaty is "an agreement between two countries".

If Congress wants to pretend this Iran deal is not a treaty, it's only for their own purposes.

And if the Corker bill DID treat this like a treaty, then the House would not have been involved at all, and the Senate would need 2/3 votes to APPROVE the deal with no veto possible by Obama.

Instead of that, the Corker bill essentially said, "yep, this is not a treaty. But we're approving it anyways, and to unapprove it, we'll need enough people to override a veto to do so."

They do need the money.

Contributions to candidates have statutory maximums ($3600 maybe?) and it's technically illegal for candidates campaigns to coordinate with their super PACs.

So while the donor class can donate millions to PACs, they can't donate more than the $3600 directly to candidates.

Then there is the whole bundler thing, which sort of circumvents the law but not really.

But anyways, yes, they need SOME money from the people for the actual campaign, even if the big money being spent is by the PACs

Even Mighty Obama with his magic pen can't EO that LAW off the books.

Thanks, I have no problems other than the long standing heart issues. Uncle fell down and broke his femur and had a lot of other medical issues that the doctors wanted to keep him in the hospital for.

He checked himself out of the hospital despite doctor's orders to stay in. I guess when when you get old you get more contrary.

But the treaty/not a treaty question is not new, not particularly an Obama issue either. What's even worse, in this case, is that the structure of sanctions erected against Iran over almosta decade was - quite understandably and normally - done via a series of executive orders and international understandings, some but not all codified in legislation by Congress. With reporting requirements and certification/waiver provisions - as ALL such legislation has been written, at least for 3 or 4 decades now.

What's different, distinct, in this case (besides the stakes) is that you have a bad-faith executive branch. Many previous presidents could have tossed away a sound successful policy that had wide congressional support and even some legislative teeth, when such policies were inconvenient. It happened, just for starters, with non-proliferation policy (Syminton Amendment etc.) WRT Pakistan. But the president then didn't just discard a policy using dishonest certifications and waivers.

But they didn't. In fact more often than not they would use Congress as the "bad cop" in further efforts to influence the foreign party.

But we are in a completely different era. Reckless, clueless president, cretinized Beltway elites, useless Democratic Party. It's not even so much the GOP, pathetic as it is, that's the problem *this* time. Even a real opposition party would probably be fairly powerless, in this particular case.

The law is written such that it keeps the Sanctions Law.

Obama then vetoes it and the Sanctions stop being law.

The only way to keep the Sanctions LAW is for Congress to override Obama's veto. Which won't happen as that takes 2/3s vote to override.

I'll say no more on the subject, and am perfectly content to have it labelled a side-issue, or an academic point - but it is simply the case that the treaty/not-treaty question here is not novel, nor is this case even that clean of an example for those who believe there should be fewer exec. agreements and more treaties.

Congress was content to build the sanctions over the years with a combo of exec. orders and legislation because that was easy and practical - and it assumed a competent good-faith executive on an issue are in which there had been almost no daylight between the two parties in a generation (since the embassy seizure in 1979). All that context is key. It's everything.

That's why I try to give people the benefit of the doubt online or when I meet them in person. who knows what they are dealing with or just went through? In any case, this debacle is truly sickening. Revolutionary Iran is, by far, the most blood-soaked (American and ally blood) adversary we have faced since WWII (I'm excluding North Vietnam, North Korea/China, as conventional enemies in more/less conventional wars, which were not essentially unprovoked nor carried out beyond a very limited theater).

They are, by far, the most aggressive yet the most careful and clever terror-supporting state (bygone regimes like Saddam's Iraq, Qaddhafi's Libya, now-disintegrating Ba'athist Syria, and the old PLO constellation were all nasty, but none as serious, aggressive, or skilled).

One of the unheralded accomplishments of the Bush years was a scaffolding of fairly effective sanctions (prob. as effective as you could ever get against a country that size with that geography and a trading tradition as ancient as any on the planet). Yes, Dubya dropped the ball by not finally acknowledging the war being waged on us and taking it much more aggressively to Tehran (separate discussion).

But I can't think of any foreign policy/national security reversal/disaster like this since the abandonment of South Vietnam. And this one has far more wide-spread implications and potential than that one.

Congress passed several laws which imposed sanctions on Iran and froze assets. President Obama started negotiation with Iran to reverse that. The GOP in Congress didn't have to do anything because it was all in his court to get the laws changed. Instead they did this idiotic deal with made it so they had to have a 2/3rds majority to stop his deal from going through.

He is 2nd in line for the presidency, he has a huge staff, offices, planes at his disposal, he has essentially complete control over the House of Representatives, and is perfectly set up to become extremely wealthy when he leaves.

My point was exactly that Iran represented a uniquely bad and real (not potential) enemy/threat to the US and our allies, unique since WWII. Different than a mostly conventional/Cold War-framework situation like Vietnam (or Korea), obviously.

And I left out that this is entirely unforced, self-inflicted damage. You could say that about Vietnam, but at least .... decade ..... casualties ... social upheaval .... political turmoil .... blah blah blah. Iran? Simple, indefensible, reckless reversal of policy, not the outcome of a national process or trauma.

There's a time and a place for strategic losses (which he argues this is), sure, if it's in service a bigger win. The supposed difference between a Treaty, which must be ratified by the Senate, and an executive Agreement, which does not.... is that a Treaty would need supporting legislation to accomplish its goals... while an Executive agreement can be done by JUST the Executive.

One recent disclosure of this treaty, is that we will PAY the Iranians to inspect their own program... millions per year through the IAEA...

As this is taxpayer money, and thus HAS to be appropriated, this will, by default, necessitate legislation....

Thus, making this a full on TREATY...

GOP is TRYING to fail... they are not even TRYING to argue this... it is all Kabuki theatre.
