We're Living In The United States Of Calvinball. It's Time The Right Got In The Game.

"Other kids' games are all such a bore!
They've gotta have rules and they gotta keep score!
Calvinball is better by far!
It's never the same! It's always bizarre!
You don't need a team or a referee!
Excerpt from the Calvinball theme song"

The imaginary game from the great Calvin and Hobbes comic strip series seems eerily like what liberals have made of what is supposed to be our constitutional republic.

The right is behind in this game because we don't want to admit we're playing it but we are. I'll admit I'm late to the game. While I still don't think it's time to go full Obama it is time to embrace a hybrid game that allows us to live within the Constitution while fighting back. Well, we could if there was a party willing to play for us.

Let's pretend for a moment the GOP wakes up one morning and realizes it stands for something beyond "win seats, hire loyalists, and pay consultants" (hey it's Calvinball, anything is possible), what would want them to do?

Assuming there is a GOP Congress and President come 2017 there are a few things they can do that would shake up the fundamental nature of our current political system while still staying with the Constitutional system we cherish.

1- Eliminate the filibuster.
It is neither ordained by God nor required by the Constitution. Mostly what it serves to do is lock Democratic wins into place and make it impossible for conservatives to pass anything.

The GOP has never held a filibuster proof majority in the Senate so it's not a positive tool for passing things and locking them in. Yes, the Democrats will some day have a majority and pass spectacularly horrible things but they do that anyway. All the filibuster really does is make it easier for liberal Republicans to collaborate with Democrats to create and save programs.

Removing the filibuster would create a balance of terror that is lacking now. Democrats know they can pass programs and there's nothing the GOP can do in response. Make them fear what the next GOP majority will pass when they are helpless.

Once the filibuster is gone, what should the GOP do?

2- Create two or four new Supreme Court seats.
Yes, pack the court to the gills. Again, there's nothing magical about having nine justices at a time. If the Court is going to serve as a Super-Legislature it should be larger.

Liberals want to play games and make SCOTUS the center of the government, fine. That's there move now it's our turn to play come Calvinball and change the rules.

Harry Reid nuked the filibuster to pack the DC Court of appeals so the precedent,
not that government by Calvinball requires one, has been set. Game on.

None of the new justices should be older than 50 or so and all should be
unabashed conservatives. They don't even have to be lawyers. Justice Charles C.W. Cooke has a nice ring to it, no?

3- Eliminate withholding.
Again, there's nothing sacred about the way we collect our taxes. If people want big, crushing government, fine. Make them feel it and let them see how much it costs them.

I think hiking taxes is bad policy and economics but it can be good politics, so if as a sop to independents and even Democrats I'd support a 15 or 20% surcharge on the net worth of the top 1% to sweeten the pot. The "donor class" has been spending lots of money pushing big government types. Fine, pony up even more.

4- Repeal ObamaCare and a whole host of other laws.
Hey it's Calvinball, you can do whatever you want! Have at it.

Will the GOP, especially a Mitch McConnell led Senate, do any of these things? No.

Even if the GOP wins the presidency, the Senate majority will probably be smaller. Faced with the usual mid-term losses of the party in power, McConnell will retreat even further into a shell to protect his useless members. For them, it's about winning to stay in office,, not to do anything with those wins.

Even if the GOP was willing to "pack the Court" there's no reason to believe a GOP President wouldn't just appoint a bunch of Souter, Kennedy and Roberts types.

Could all of this backfire at some point in the future even if it payed dividends in the short and/or medium term? Sure but we know for a fact that if we keep playing by the rules of the game as they exist we'll lose more now AND in the future.

I understand these ideas are not temperamentally conservative. One should not rush to throw old systems away on a whim. The problem is the old systems we love have been thrown away. We simply need to accept that.

Everything I've advocated, while disruptive are within the bounds of the Constitution. They don't require us to ignore laws or invent new rights. We just need to be willing to take advantage of the moves we are allowed to make now.

But the GOP will do none of this. They will either promise you unattainable Constitutional amendments or suggest you meekly assent to liberal usurpations.

And my guess is, that will be good enough for most conservatives.

Enjoy the decline. But hey...Go GOP, right?

1 The reenactment at Gettysburg has been postponed. Very wet grounds are
the reason. Probably a relief for many, with all the Confederate flag
bans.
Some other groups said they wouldn't display the flag.
You
won't find it at the official visitors center, but there should be some
displayed at all the souvenir shops. Of course the City of Gettysburg
could ban the sale.

16 You're still to close to following the old rules.

The New Rule is this:
#1 Laws mean whatever you say the "intent" is. That includes the
Constitution.
#2 Rights are whatever you feel like are good and nice.

Let me get you started:

Good--The intent of the 10th Amendment was that the federal courts could not rule on any matter not specifically granted under the Constitution--they can't rule on abortion, voting rights, marriage, discrimination, immigration, taxes, drugs, etc. In short: The power of the federal court is limited to those cases between federal agencies and branches of the federal government. And no State or citizen is bound to recognize their authority otherwise.

Better--The intent of the 4th, 5th, and 6th Amendments was that no citizen should pay any money to the federal government unless convicted of a crime by a jury of his pears. And that the federal government cannot enact nor enforce any criminal laws.

Best--The intent of the 2nd Amendment was that States are required to provide weapons, of all sorts, to their citizens.

Nuclear--The intent of the Constitution means that each state is free to set the number of congressmen and senators they send to represent them in the federal government.

Remember: The words don't fucking matter---only whatever you make up as the intent matters now.

I think the impracticality and very slim chances of everything being proposed reflects our lack of useful options - not the quality or sincerity of the proposals, BTW. When your electorate is (sufficiently) ignorant irresponsible and bereft of historical American values and mindset; when there is no real opposition party; when the very language of the civic culture has been undone (words mean nothing, oaths mean nothing, unlimited bad faith from key actors) - then one's options are not readily apparent.

Note: the same reason much of this has happened is the reason we here represent a small slice of the populace. Not our views, the very fact we are even thinking and aware of most of these things. That inertia of indifference and distraction is at least as big a daunting problem as the others.

You could go half way on it.

End automatic withholding, but have the government offer linking your bank account so the IRS can automatically withdraw.

Now you get that $2k pay stub but the feds take their $500 or so before you see it - so all you see is a $1500 deposit.

Under this plan you'd see $2k deposited and the feds immediately taking $500 as a withdrawal.

Might get a little more focus on how much you are actually paying...

72 This better not be tongue-in-cheek because I rarely agree with Drew, this, though, I can live with.

There has to be a better way with the filibuster, though. Can't they, with a majority vote, (at least in Calvinball) do away with the filibuster only when there is a President in office who stands more than 6'5" or something like that? How about more than 6'4" and/or weighs more than 270 pounds? Let's start getting Presidents that look like Kings, after all they are acting like them.

What would be funny, if they really wanted to play Calvinball, is to suspend the filibuster with a Republican Majority, then say, "Whoops, we realized how bad that was, sorry!" when the Democrats inevitably regain control over one or both chambers (say, the day after the election, while still in control).

Then, when the Democrats move to remove the filibuster, they can go on all the TV outlets claiming how they were shown the error of their ways by the People - and now Democrats are trying to subvert the Will of the People, yada yada.

Of course, this would require an actual opposition party, which we don't have.

There is a lot you can do against Leviathan without even sticking your neck out. Some thoughts in no particular order:

1 Stop buying stuff
2 Do only what the government directly compels you to do.
3 Pay in cash with a winkwink
4 Cheat the government whenever possible
5 Steal all your entertainment
6 If you know of tax cheating, keep your mouth shut
7 If called to jury, refuse to convict
8 Discriminate in all your private dealings, without openly saying so
9 If you see a CoC sticker on a business, go elsewhere
10 Vote against all tax levies, particularly school levies
11 Buy firearms and ammo. It's not simply a just-in-case, it's a good financial investment of small sums when savings are yielding 1/4 of a percent.

Good Citizens are chumps.

It's simply about who's willing to use the power while they have it.

If we want anything approaching, the society and gov't we had before, we have to play the Left's game and play it hard.(And yes, I realize the irony of that statement.)

If the Reps can manage not to screw the pooch and elect a Conservative Federalist.

He has to be willing on Day One to pass laws that will return Fed agencies such as the EPA to the states(all states have their own EPAs anyway), etc.

As well as other laws that defund and horrify the Left.
Wide open fracking and building of nuke plants is a good start. We need cheap, reliable energy if we're to compete with other countries and still pay good wages and bring manufacturing back.

Also, taking a good hard look at all the "green energy" graft and corruption should be a no brainer. Solyndra, anyone?

All the your other ideas are good as well.

HOWEVER, the next Rep Prez must be a real political bastard- and have a "Come to Jesus" talk with both Boneless and Turdle should they remain in place.

We can't have Boneless/Turdle blabbing on TV after the election about how we're going to finally run Congress to be bipartisan and build consensus.

As Boneless did after Pelosi lost her seat.

Sadly, the government has failed on all of these fronts. The absolute bare bones, basic stuff that they are responsible for, they have failed at. They have no business being responsible for anything else.

152 To those of you that truly want limited government and more personal liberty ... I'd suggest you keep in mind that Republicans are just as much your enemy as Democrats.

Never forget that. Republicans are the one's that want you to shut up, go to work, and pay your taxes ... because the status quo still ain't bad.

Republicans are the abused wife that yells at the kids because the husband's a drunk and won't listen.

Republicans are the Mafioso charging you protection money.

Republicans are your personal enemy ... insisting you play along with the corrupt scheme just as much as the Democrats.

This includes their followers as well as their leaders. This includes some of your family and some of your friends. This includes many on this board.

Fine. We're "underpaying" our federal taxes by 20-40% every year (depending on the year).

As in, we're spending so much more than we're taking it, that no matter what we do, we cannot decrease the revenue going to DC for DECADES just to pay off the last 10-15 years of spending.

So I can't complain too much about "sorry, we have to lay off everyone and end all services but can't reduce taxes for a generation" because that's what my parents and grandparents generations voted for for the last 60 years, because I guess they're all assholes and don't care about us.

I oppose it because its being presented falsely and solves no issues, in point of fact it makes legal and Constitutional nearly every problem we purportedly seek to solve.

And hey, didja know the AoC had a provision even more stringent than Article V? Yep, indeed - Article XIII mandated that ALL of the 13 States had to ratify any changes. The first thing they did in Philadelphia when they convened was to *abandon* the set of tasks given them by their States in favor of "The Virginia Plan" and the second was to change the rules for ratifying any changes being considered.

But I do agree that the idea is very popular and sells a lot of books.

No, but tax it as income.

And then use their post-welfare income as the "income" from which any other welfare programs are judged.

So if you get $45,000 in welfare, you're no longer poor and no longer qualify for any additional programs, and may get kicked off the programs you are in.

Make it an absolute nightmare for people to collect massive amounts of welfare. Because right now there are so many programs and so much money floating around that no one knows who is getting what, and its not taxed or counted as income.

So someone making $20,000 a year and bringing in $50,000 in welfare benefits (for a total of $70k) a year is considered "poor" and gets a net benefit on April 15th, while her neighbor who makes $40,000 a year with no welfare benefits is considered "middle class" and has taxes withheld from his paycheck every month, and most likely owes money on April 15th.

284 Getting rid of witholding, while a good idea in general, won't do much politically. 50% pay no taxes. They'd have no check to send in every quarter. Of the other 50% that does throw in a dollar or two, 1/2 of that group would be writing a check for a few hundred dollars. The truth about income taxes is that a very small group of people pay a shit ton of taxes while the vast majority pays little no taxes.

303 Posted by: HUCK / AKIN 2016 at June 29, 2015 11:52 AM (0LHZx)

Yeah. And as soon as you hit $100,000 a year (doesn't matter where you live. If you live in the NY tri state area, where mortgages on an entry level house will run you $5k + a month and $100,000 is hardly enough to raise a family on... doesn't matter), you get BONED.

Can't write off student loan interest, and you're paying an effective federal rate in the high 20s, plus state rate, plus FICA, plus all the other taxes.

Not to mention property taxes, tolls, gas tax, alcohol tax, sales tax, diesel tax on everything you buy that came via truck, (indirectly) $100 per 18-wheeler that crosses the GW bridge, etc. etc.

So essentially you're better off being poor. Because if you make a decent amount of money, you're probably paying 60-70% directly and/or indirectly to government.

Add in red tape and compliance costs and all the other bullshit in life (including the pass through corporate taxes you pay on everything you buy), and you may get to take home 10-20% of what you earn. The rest goes directly or indirectly to government.

304 Inre the taxes and welfare...here's the mindset of the people we are dealing with.

I belong to a program on Amazon.com where we get free items to review. We then keep the items.

Recently a program change was announced where we'd be receiving 1099 forms for the value of the items (I'm skipping a lot of history, but suffice it to say that the terms of service for the program until this week rendered those items non-taxable).

The wailing and gnashing of teeth from a fair portion of the program members was something to behold. I need to point out that the majority of them are stay-at-home literary types, and thus the vast majority of those complaining are well left of center...some aggressively so. But lots of complaining about how *they* have to pay taxes on this stuff now.

Even more maddening...quite a few complained that receiving 1099 income would mess up their benefits. Yep. Lots of chattering about how they will have to make a choice between healthcare and freebies.

A fair chunk quit the program out of protest, calling it a program for one percenters. Others are talking about meticulously adding up the value of the stuff they request until it hits close to $600, then stop requesting things.

Me, I've come so close to replying to these fucktards that THIS IS WHAT THEY VOTED FOR! It also very neatly illustrates the cycle of dependency these people are stuck in, even if they don't really grok it.

Depressing and amazing at the same time.

Posted by: mynewhandle at June 29, 2015 11:59 AM (AkOaV)

315 No, but tax it as income.

And then use their post-welfare income as the "income" from which any other welfare programs are judged.

So if you get $45,000 in welfare, you're no longer poor and no
longer qualify for any additional programs, and may get kicked off the
programs you are in.

Make it an absolute nightmare for people to collect massive amounts
of welfare. Because right now there are so many programs and so much
money floating around that no one knows who is getting what, and its not
taxed or counted as income.

So someone making $20,000 a year and bringing in $50,000 in welfare
benefits (for a total of $70k) a year is considered "poor" and gets a
net benefit on April 15th, while her neighbor who makes $40,000 a year
with no welfare benefits is considered "middle class" and has taxes
withheld from his paycheck every month, and most likely owes money on
April 15th.

Posted by: mynewhandle at June 29, 2015 11:48 AM (AkOaV)

Eliminate welfare and let charity come from actual charitable organizations whose donor give voluntarily.

One of the big problems with welfare is people consider it a "right" rather than understanding that it is a "gift" that they are not entitled to and should show gratitude for.

Posted by: wrg500 at June 29, 2015 11:56 AM (kQBSd)

Under full faith and credit it should be all 50 states.

For example, NY has to recognize my NH drivers license, my theoretical NH marriage license, and now my theoretical MA gay marriage license.

All has to be recognized. Every state is required under the constitution to give "Full faith and credit" to documents, court proceedings, etc. from every other state.

So it would SEEM TO BE a no brainer that that would include CCW's.

Then, of course, states like VT and AK have constitutional carry. Well, they don't issue any paperwork. But if they were to shall issue paperwork upon request, every other state would (seemingly) have to recognize that as well. And since you don't have to be a citizen of VT to "constitutionally carry" it would seem that we could all get paperwork saying "VT says we can carry whenever, wherever, without a permit or anything else", and that all other states would need to recognize it.

Of course... penumbras and emanations.

Plus, words are such... fluid things.

Technically, Texas doesn't have to. All we have to do is declare that because the US is no longer following its own Constitution, there is no legitimate US government, therefore recognition of said is withdrawn.

We joined by treaty, but treaties with an entity that doesn't exist are null and void... I suggest that we phrase it "suspend all actions as a member of the entity purporting to be the United States, until such a time as Constitutional government is restored."

Yeah, but that's different.

For example, NH has legal fireworks. MA doesnt.

that's okay. No full faith and credit involved there.

And I mean... I don't know "equal protection"?! That would be a stretch.

I suppose with the Court's new definition, you could argue that rednecks in MA have less fun than rednecks in NH because NH rednecks have better fireworks to set off and blow off fingers with. I don't know. Under any normal legal theory, no.

But we are in the twilight zone, so who knows?

______________

Why do people keep saying this? Everyone gets a paystub with their paycheck do they not? And on every paycheck it shows YTD taxes paid. It's not some great mystery that would suddenly be revealed by getting rid of witholding.

The reason most people don't give a fuck about taxes is because most people don't pay any taxes. And the few that do, pay such a small amount, it doesn't matter if they pay it all at once or in 24 or 26 increments.

Salaried people that pay a lot of taxes, already know they pay a lot of taxes. And if you got rid of witholding all they'd do is set up a savings account and set aside some money every week or month to send to the IRS quarterly. It would be withholding by another name.

First off people do know roughly how much is witheld. Even the lowest LIV can read a pay stub or a W2.

But the bigger picture issue is that the LIVs don't actually pay any net taxes. Whatever is withheld is sent back as a refund. **That** is the problem. When 50%+ of the workforce pays nothing, it's impossible to win an election on the promise of lower taxes.

Why do people keep saying this? Everyone gets a paystub with their
paycheck do they not? And on every paycheck it shows YTD taxes paid

Yes, we all get pay stubs. But the money is taken out before I get one red cent in my hands. In that sense - people don't feel it.

Instead of the $500/wk after taxes/withholding/etc., pay them the $625/wk and every person MUST write the $125 check to the government. Now people feel it. This becomes real.

Then perhaps those with >5 brain cells will start asking themselves WTF am I getting for my money.

420 Someone mentioned taxing welfare income. It sounds great, but....taxing welfare income is only going to hurt in the case of people who are truly trying and really, really need that supplemental income.

If I am an unworking single mom with a brood of kids getting 50 K a year in welfare. And, all of the sudden, I am getting taxed, and I only get 40K a year, what does that change? I am still getting 40 K a year for doing nothing. Is that 10K a year enough for me to say, "Ya know, I think I am gonna go out and get that job now...just to make as much or a little more than what I am getting now." Eh, probably not.

Posted by: TickledPink at June 29, 2015 12:30 PM (RLFFI)

421 First off people do know roughly how much is witheld.

Posted by: HUCK / AKIN 2016

But every working adult has a payroll tax.

The 47% statistic is only true when you're talking about federal income taxes.

Regardless, it doesn't take much to really change the dynamics of this country moving forward.

If 10% of the public changed their mind about Big Government and taxes, that might as well be a revolution.

Posted by: McAdams at June 29, 2015 12:31 PM (4b2BH)

422 Sorry to shatter everyone's illusions but ending withholding will do very little or nothing on the IRS or Income Tax in general. Why?

1. Only 50% of the people actually working here pay a tax. And out of those a large amount get money back through the EIC tax welfare scam. Even a large number of people who do not work get money from this scam now thanks to changes since it was originally put in place.

2. Out of the people who actually pay a tax, a large portion are like me, they already have no withholding. They have to file a quarterly return with their "estimated taxes".

In order to have a "withholding" you have to have "earned income" from somebody else's buisness to withhold from.

They may know, but its an abstraction that doesn't really affect their lives. The withholding numbers above the net pay line are like the NL Central standings or the scores on Dancing With the Stars. Mildly interesting in a detached way but they're not really relevant to buying groceries or marijuana.

Make them write a check for it and it becomes very real. Budgeting 101 as brutal life lesson. (Holy crap! I spent my 3d quarter tax payment on tattoos and internet pron!)

427 All those ideas are premised on the assumption of a Republican president. Something that the "milquetoast" establishment has been quietly trying to arrange by pulling down lightning rods and buying time ever since they retook the Senate. Something which I have explained, repeatedly, here in comments sections, which has not stopped you from screaming, stomping, and crying about it since January.

I guess now it finally has sunk in, sort of, that taking the presidency is necessary to saving the country and that should be priority #1... without ever realizing that talking about doing all those things you just listed out loud, in public, will work AGAINST taking the presidency (or even holding Congress) by feeding ammunition to Democrats about incoming reactionary policies. You think you're brilliant for mentioning court packing; but did it ever occur to you that the scheme failed the FIRST time, in the 1930s, because of vast public opposition? Did you even know that? Do you really think that a public newly mistrustful of politicians promising big changes is going to completely forget the experience of the last decade or so and just hop aboard your ideological freight train?

You're advocating that Republicans promise, out loud and public, to do big things when they take the Presidency that will cause them NOT take the Presidency and forever render your preferred policies dead. Good thinking.

You really need to find some other vocation, because you fucking suck at politics.

Uh, dude. Drew is not suggesting that the GOP campaign on the basis of doing these things. he's suggesting that the GOP do these things, once a GOP President is elected. And the opposition will accuse them of wanting to do it, as a matter of course. They already do that.

433 This is a govt. version of "making the left play by its own rules", while acknowledging the fact that they change their rules mid-game.

But doing this on a govt. level requires people of the same mindset to play. The current GOP/Republicans are not those people. And conservatives (that we really need) aren't those people, because they are still stuck in playing by the rules and hoping people understand their arguments, like sane rational adults would. But 2008 and 2012 proved us oh. so. wrong.

But this approach you outline works in real, everyday life. It's called "illustrating absurdity with absurdity". You can do so in conversations with Libs or LIVs, family relationships, work, social events, etc. Learn the left's rules and hit them in the face with them. Constantly. Like a curb stomp. Learn how one big social grab (same sex marriage) leads to others (polygamy) and sincerely argue it. Make them LIVE it. If people knew same sex marriage would lead to polygamy 10 years ago, it wouldn't have the traction it does now.

An example - when Bruce Jenner (a man) identified as a woman (something he is clearly not), the Left and LIVS applauded. But when Rachel Dolezal (white) identified as black (something she clearly is not) the LIVs and Left ridiculed and scorned her. Did you catch what I wrote? They ridiculed her (see Maya Rudolph). Like they do Repubs and conservatives, their enemies. They did this because she is a living, breathing example of the real-life outcomes of their lunacy and they cannot explain that in polite company. And they can't have that be rubbed in their face, so they ridicule her and try to move on past it.

So don't let them move on. Cite her as precedent.

Same as when Joss Whedon got butt-pumped by the Feminists for "Avengers". Don't argue to protect him - he doesn't want your help and won't return the favor. Instead, argue with the Feminists against him. Make him eat the shit sandwich he spent years campaigning to put on our menu.

Conservatives need to take those instances, side with Dolezal, etc., and beat the SHIT out of the Left for their actions toward her. Is Dolezel nuts? Sure! Is it a denial of reality to help her? Sure! But we KNOW it is, and much of the Left LIVS don't.

What is the effect of supporting Dolezel? Why, affirmative action policies and other sops to "minorities" go tits up because EVERYONE can identify as a "minority" now. That will wake the blacks, et al up. Then as Republicans you offer them the road back to sanity.

436 The Republic of Texas and a few other red states could get these kinds of ideas passed, but not the entirety of all 57 states. Our country has become too big. Our constitution was designed for 13 states that agreed on fundamental things like 'are you born a woman, or is it a choice'. We need to move back to a Republic with 13 states, give or take.

437 There is not the remotest reason to believe any of that. The analogy is
swimming away from a sinking boat, thinking that you'll find a better
one somewhere.

If you don't swim away from a sinking boat, particularly if it's large, there's a good chance that the suction it creates when it finally slips beneath the waves will drown you.

439 Why do people keep saying this? Everyone gets a paystub with their paycheck do they not? And on every paycheck it shows YTD taxes paid. It's not some great mystery that would suddenly be revealed by getting rid of witholding

Having cash in hand and then having it taken away, even a little of it, is painful. It's part of the reason that people that pay with cash for things spend less money overall than people that don't.

Most people get a direct deposit, and very few read their pay stubs. Twice I've had my payroll service put erroneous information on employee's pay stubs (for months) - the employee's never noticed. Make them write a big check at the end of Government fiscal year. Then vote two weeks later.

443 I'd suggest that the next time we have a big gay rights case ( which will probably involve gays wanting to force a catholic priest to marry them) we put "articles of impeachment for justice kennedy" in the docket.

It doesn't matter if we have the votes to remove him ( the month long trial will be bad enough for his personal anxiety and his legacy)
Kennedy in particular cares about his legacy, and as of now he'll probably retire as the most popular Justice since Warren ( in terms of people who write the history that is)
An impeachment will tarnish that. What is more impeachment is an inherently political act, the conviction is what has to be justified by the law. Will we be attacked for it, no doubt, but we're going to be attacked for something anyway, might as well give the Left a good reason to whine. Game on.

Posted by: midwestconservative at June 29, 2015 04:05 PM (WJc3o)

444 Also, lets start impeaching Obama officials. Will they be removed? No, but they're lives will be miserable afterwards. And a significant number of them genuinely deserve to be impeached ( including Obama himself).
Having "was impeached" on their resume' would suck.
