In the 5-4, decision, only Kennedy opined.
All 4 dissenters opined.
Thus remains 4 uber-psycho-statist-lefties who simply voted in lockstep/goosestep fashion.

22 OT-but maybe not t I was at a Farmer's Market on Saturday and there was an African American woman selling home made desserts. I always go to her table because her stuff is very good. We always chat because I'm a regular customer (Fenelon Family lies this stuff; I can't eat it. :^) At any rate, she said "This has been a heavy week" without explaining more, but I don't think it was just or primarily about the weather. I have said to her before that I like the cross she wears which comes from Israel, so my guess is she was not thrilled about the gay marriage decision.

30 Kevin W. sums it up nicely. This is exactly how it feels, although I think there is more malice behind getting there.

The ranks of the Right are filled with a splendid array of gifted and erudite lawyers with unshakeable commitment to the rule of law. Many of them are my friends and colleagues. But their arguments always leave me a little bit cold. We can debate all day about how many Angels in America can have their first dance on the head of Anthony Kennedy's pen, but we know that the Court's liberals are going to vote one way, that some of its conservatives will probably vote another, and that John Roberts and Anthony Kennedy will, if the goblins in their heads are sufficiently insistent, ratify whatever Starbucks-customer consensus exists for 80 miles on either side of Interstate 95. That the chief justice went one way on health care and another on marriage tells us nothing at all about the law or the Constitution: It tells us about John Roberts.

And that is the problem.

Yep. If John Roberts actually cared about the Constitution, OCare would have been overturned the first time it came up (because it is quite obviously Unconstitutional), meaning the case this time would never have even gotten to the court.

Same Sex Unions (it's not marriage) would still have gone the way it did- but however upsetting it is, that's hardly surprising.

They've been doing that for years. That particular article was published June 5, so we can be pretty sure it wasn't because of the SCOTUS decision.

Despite all the prohibitions in both Old and New Testament against homosexual behavior, too many homosexuals think that "God is Love" means that Christians are supposed to ignore those prohibitions.

Interestingly (and I'll have to look this up) there's apparently a gay woman who is a friend of our pulpit minister at my church; she wrote a book called (I believe) "Likes Girls, Loves God" in which she details her struggles with homosexuality and faith and her decision to be celibate as a result. So it's obviously not all of them.

Which makes the douches like this clown so much worse.

67 I am the first to admit that my knowledge of high finance is, shall we say, less than total but it was always my understanding that interest is merely a risk calculation.

If risk has been removed, say, just to pick something at random, by having the government back stop all risks, then the interest rate should be effectively zero as the risk is effectively zero.

The problems with this should be obvious.

I am more than a bit train wreck fascinated to see what's going to happen in Greece.

72 Bush told reporters gun control was an issue that should be sorted out at the state level. "Rural areas are very different than big, teeming urban areas," he said.

As a Dedicated Tenther, I believe I am qualified to comment on this:

Jeb Bush is an idiot, and does not understand plain language. The Constitution reserves certain rights specifically for the People. It usually does so by saying "The Right of the People..." before defining whatever right.

One of those is the Right to Keep and Bear Arms. "A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed."

So, no, it's not up to the States. The Constitution already put paid to that idea.

Of course, we're ignoring the Constitution everywhere else, why not with guns, too?

82 That the chief justice went one way on health care and another on marriage tells us nothing at all about the law or the Constitution: It tells us about John Roberts.

And that is the problem.
____________________________

Roberts also went in opposite directions on the two 0-Care cases.

In Sebelius, the case in which he said 0-Care was valid as a tax, John Roberts lectured Americans that it is NOT the duty of the Supreme Court to save American voters from the consequences of bad laws enacted by their duly-elected representatives; that's what the ballot box is for.

Then last week, in Burwell, John Roberts informed Americans that it IS the duty of the Supreme Court to save American voters from the consequences of poorly-written laws enacted by their duly-elected representatives.

Apparently when it comes to bad laws, Americans have the remedy of voting legislators out of office in retaliation, but when it comes to badly-written laws, somehow we don't have that same option.

John Roberts is nothing but a shameless political hack. There is no consistency or clarity in his reasoning; he simply decides on the outcome he wants, and then works backwards to try and justify it.

86 it was always my understanding that interest is merely a risk calculation.

Not so. Risk calculation factors into specific interest rates (whether or not you are charged 7% or 11% on that personal loan from the bank, for instance), but it is *also* a representation of the time-value of money.

The $1000 I loan you today will be worth less in 2 years, so I charge you interest so that I get my value, and not just my money, back. The higher risk you represent, the more interest I charge you so that it makes it more likely I'll get at least some of my money back.

90 Ya know, I'd mentioned it yesterday but the whole thing got sidetracked

Wife's family is selling their family's prop'ty in TX, which lies north of Waco, just south of West, TX [please note the comma - its a town, not the western region of the state]

I don't have complete details, but have been there once. Good deal of acreage, side by side house on a slab. They had a factory facing the highway [he made glass products] but I think that may have been torn down during a highway exansion. I had heard they put in a pole barn but I don't know either way. In any case, the initial appraisal was 500K before the highway expansion, and it's likely the price is down.

So if anybody is actually serious about a move down that way .... something to consider along with whatever else you're looking at.

Sort of. They're saying that County Clerks and employees don't have to issue marriage licenses to homosexuals if they have religious reasons for doing so, and are promising free legal counsel against the inevitable lawsuits.

However, to my knowledge, no one is choosing not to issue the licenses.

I would feel much better if the Governor, Lt. Governor, and AG would all come out and say, "The Constitution of the State of Texas affirms that the natural definition of marriage is that between one man and one woman. No marriage license shall be issued to same-sex couples. The Supreme Court has made its decision, not let them enforce it."

114 Puerto Rico Gov say island can't pay debt.

This is kind of funny actually, when you think about it.

This country can't pay its debt. Not really.

Not without Obamacare it can't.

The things that allowed this country to expand its debt and obligations to the point that it has, were the entitlement programs.

Social Security, Medicare and the Highway funds are all spent at least twice - once in the general fund and once when the IOU's come due. The debt associated with this type of magical government accounting scam became so great that it the deception could no longer be sustained.

But with Obamacare, one sixth of the economy now "managed" by the government, well...

They'll be able to pull this off for a few years, but the debt and the obligations are now so big that the end of this will come astonishingly quick, imo. One sixth of the economy will become one third with respect to actual spending.

A few years at most.

I wish them well. My supposedly conservative state has pretty much caved, as usual. Our cocklick Republican governor is much of the problem.

We do have a couple of counties that have suspended the issuance of marriage licenses, though. Alabama state law says that county probate judges "may issue" marriage licenses.

That can be interpreted to mean they aren't required to issue marriage licenses.

You make a good point. If the SCOTUS can divine the "true intent" of hundreds of congresspeople, ignoring the actual words of what those congresspeople voted into law, then surely the government of Texas can divine the "true intent" of nine Supreme Court justices -- regardless of what they wrote in their opinions.

The Court itself has told us now that words in a law do not mean what they say -- so why should that not also be true of the words contained in a Supreme Court majority opinion?

Before reading those, I had been thinking about a comment that echoed pretty much those same sentiments - about the generalized atmosphere of pretense that we find ourselves living in.

Sometimes I am pretty convinced that my perception of things is flawed. But when several (many?) people evince the same perception; if people are all seeing the same thing, I think it likely that what we are all seeing is probably what is really going on.

Morning read:

The Story of the Forgotten Navigation System from the 80s

Thirty years ago, a company called Etak released the first commercially available computerized navigation system for automobiles.

To appreciate just how amazing the concept of car navigation was in 1985, you need to recall that the Global Positioning System didn't come fully online until a decade later, in 1995. Etak beat modern GPS systems to market by a decade and a half. It was so early that its inventors had to digitize their own maps and figure out how to get them into an automobile in an era before solid-state mass storage, optical discs, or wireless Internet was available to do the job. (The solution: special tape cassettes.)

239 Part of me is heartened by the gay marriage ruling.

It sharply draws the line betwixt church and state and allows the churches to simply get out of the legal side of the marriage business.

Want to enter a contract down at the courthouse? Go for it.

Want your union blessed by God? We get to decide whether or not you qualify for our version.

Period. The end.

When the assault on that part comes - and it's coming as certainly as the sun will rise in the East - the churches (those which don't sign marriage licenses anymore) will be able to simply tell the government, in the most saintly terms possible, using only the language of Jesus, to Fuck the Fuck Off and Get the Fuck Out of God's House.

241 San Francisco, in particular, stands out for its astronomical cost of living. Real housing prices increased by 385% from 1970 to 2010, while real wages rose only 38% during that same period. The city's median rent for a one-bedroom apartment was scraping $3,400 per month as of late 2014; median home prices now reach $1 million. Despite these shocking numbers, it's not hard to see why prices are so high. Housing stock grew by just 8.8% in San Francisco and barely 4% in nearby San Mateo County between 2000 and 2010. During this same time period -- the decade that included the Great Recession's housing collapse -- the national housing stock rose 13.6%.

The problem in San Francisco is regulation.

Last time I was in San Fran, I had to walk over the pile of homeless people in the street. Not sure if that's changed, or did they shepherd them to other areas to not be seen.

242 >>....but if you start seeing homosexuals attempting to force churches to "marry" them, you'll start seeing some push back.

That will be the last front, though. First they're going to hit easier targets - suing every Christian-based charity, school, etc. - so, Knights of Columbus for not hosting their SSM reception, Christian school for having a policy against hiring homosexual teachers, evangelical universities for having a morality code that includes abstaining from homosexual behavior, Christian adoption agencies for not placing children w/same-sex couples, etc.

By the time they're suing churches to marry them they will have already be 90%+ into their victory over religious freedom.

I've been saying for a while that we should insist that the doctrine of Separation of Church & State forbids the government from any involvement in marriage, as the sacramental marriage long pre-existed the secular contractual form, thus their form must be shorn of ceremony and renamed, perhaps Civil Union or Domestic Partnership.

Let's take it a bit further and go Scorched Earth, and fight to end all of the government's Marriage benefits as well. Make it just a contract, and nothing more.

I'd be happy with this arrangement. I have a feeling that most married Republicans (note the distinction between Conservative and Republican here) would oppose such a measure.

Which gets us to the real root of the problem. Everyone agrees that there's too much spending of imaginary money we don't have on shit we don't need.

Everyone also agrees that everybody else should get their programs cut.

307 allows the churches to simply get out of the legal side of the marriage business.
==========
I keep saying: THAT'S NOT GOOD ENOUGH!!!

There are a whole lot of other things a church does that--should they follow their faith--now violates this invented civil right.

Married-only dorms.
Adoption.
Hospitals.

To say nothing about actually preaching against this lie--that's discrimination too.

So, getting them "out of the marriage business" solves NOTHING. (As if retreat ever solved a problem in a total war like this.)

"Getting them out of the marriage business" is the same false hope, the same mirage, the same lie that we fell for when we agreed to civil unions.

How many more times do you have to get kicked in the gut to realize they really mean to kick you in the guts?

309 Had a brief exchange w/someone on Twitter this morning who was aghast at the "BURN ALL THE HERETICS!!" words and actions from the militant GLAAD folk. When I said that anyone with an above room temperature IQ knew this was going to happen, she got a little peeved at me since, to be fair, she is not a paste-eating, window-licking, Joe Biden wannabe. I then responded that the most militant members of pro-SSM people had always been honest and open about their endgame, or at least ONE of their endgames: the destruction of organized religion and churches. They were very clear about it. They spoke openly about it. But when I mentioned it, people typically responded in one of two ways:

1) They said I was lying, or that I had misheard
2) They refused to take the militant activists at their oft repeated word. "Oh, they don't actually MEAN that."

So here we are. And many of the honest and genuine supporters of SSM are now horrified to see that they were, in fact, nothing more than useful idiots to the members of GLAAD and its ilk. And they're even more horrified to find out that they not only are they being discarded like yesterday's news, they're being attacked as well.

In a larger sense, I was always more or less ambivalent about SSM. In my now lost pixels of my first blog (you could say the same about my current blog because I almost never post), I opined about giving same sex couples ALL of the legal protections that married couples had vis a vis property, inheritance, visitation, that sort of thing. But I opposed calling it marriage because a) words mean things and b) I knew what would happen once it was enshrined as a legal right.

FYI: getting the result you want, while important, is not the most important thing. HOW you get there is. And having SCOTUS declare all of us haterz to be non-persons will, sooner rather than later, lead to open and armed hostilities. While I won't enjoy watching it burn, because I'll be busy protecting my kids, I will enjoy watching the useful idiots shit themselves. Repeatedly. Because willful stupidity should be painful

===========
What advantage?

The one where we start out down 4-3--at best?

This Court no longer has any legitimacy. By remaining in a hopelessly corrupt and illegitimate Court, he condones such.

If he, Scalia and Thomas resigned, it would actually show they believed what they wrote in the last week.

But, what happens if they did?

Either way, it destroys the Court.

Obama appoints three more, 1)which the Republicans can refuse to confirm: No more ruling from the Court until the 2017 at the earliest.
And if they do rule, only the most partisan will view it as legitimate.
Or 2) he appoints 3 more radicals and the decisions swing even further left.

This is a problem to big to solve with words---as Ike advised: Blow it up.
