Senate Passes USA Freedom Act to Replace Expired Patriot Act

Obama says he'll sign the bill.

WASHINGTON (AP) -- Congress approved sweeping changes Tuesday to surveillance laws enacted after the Sept. 11 attacks, eliminating the National Security Agency's disputed bulk phone-records collection program and replacing it with a more restrictive measure to keep the records in phone companies' hands.

The legislation will revive most of the programs the Senate had allowed to lapse in a dizzying collision of presidential politics and national security policy. But the authorization will undergo major changes, the legacy of agency contractor Edward Snowden's explosive revelations two years ago about domestic spying by the government.

The Senate passed USA Freedom over McConnell's objections. He sought to formally pass the Patriot Act, explicitly gifting the government the broad metadata collection powers it previously just assumed.

"This is a step in the wrong direction," a frustrated McConnell said on the Senate floor ahead of the Senate's final vote to approve the House version, dubbed the USA Freedom Act. He said the legislation "does not enhance the privacy protections of American citizens. And it surely undermines American security by taking one more tool form our warfighters at exactly the wrong time."

It would also continue other post-9/11 surveillance provisions that lapsed Sunday night, and which are considered more effective than the phone-data collection program. These include the FBI's authority to gather business records in terrorism and espionage investigations and to more easily eavesdrop on suspects who are discarding cellphones to avoid surveillance.

Many are unimpressed by the reforms contained in this bill.

The bill, the USA FREEDOM Act, manages to have a more ridiculous acronym than the PATRIOT Act and includes a few measures to strengthen the intelligence community’s ability to track terror suspects (for instance, it eases the transition between tracking them within the U.S. and abroad, activities that require different legal approval). Some privacy advocates thought the bill didn’t go nearly far enough -- it will still allow broad requests for metadata, just not as broad or as easily as under the original Patriot Act -- but some hawkish legislators (and NR’s editors) argued that the replacement program will be less effective without doing anything important for civil liberties.

Meanwhile, the AP is reporting the FBI is running surveillance flights from "front companies," though this seems to be ginned up nonsense to me.

ASHINGTON (AP) -- Scores of low-flying planes circling American cities are part of a civilian air force operated by the FBI and obscured behind fictitious companies, The Associated Press has learned.

The AP traced at least 50 aircraft back to the FBI, and identified more than 100 flights in 11 states over a 30-day period since late April, orbiting both major cities and rural areas. At least 115 planes, including 90 Cessna aircraft, were mentioned in a federal budget document from 2009.

For decades, the planes have provided support to FBI surveillance operations on the ground. But now the aircraft are equipped with high-tech cameras, and in rare circumstances, technology capable of tracking thousands of cellphones, raising questions about how these surveillance flights affect Americans' privacy.

See, this is what I mean by ginned-up nonsense. In rare occasions, they may be equipped with equipment capable of this.

What am I supposed to do with that?

It seems to me any time you have a surveillance flight, you might want to do some electromagnetic spectrum monitoring on your target. Now I suppose that you could just start scanning everyone in the area.

I don't know. Some people seem less interested in protecting civil liberties than in protecting criminals from detection and prosecution. I suppose this is a reasonable thing to do if you imagine the government will declare you a criminal at some point in the future. A bit paranoid of a fear, but... not as paranoid a fear as it should be.

Even conceding, arguendo, the government might actually turn technology against citizens it brands Political Outlaws at some point in the future, are we to just give terrorists a free hand in the meanwhile?

The "front companies" thing seems like hyped-up nonsense to me, too. You would not want these planes marked FBI, or have them known to be FBI planes. This is the same idea of the FBI working out of vans marked "Imogene's Flowers" when they're doing surveillance.

Do we get worked up about that? Is it just hair-pulling-out time as a general thing?

I just don't see the story here.

and only very rarely does the FBI do phone surveillance, almost never do black bag jobs, and are now trained to not leave tape holding door latches unlike the inept CIA contract burglars at the Watergate.

Very rarely. Trust US, we don't read other people's mail nor listen to their phone calls. Other than one or two times with the mafia. Very rarely, it is just too expensive and takes too much manpower as you can see in the latest news from Boston. It takes a very large crew to keep surveillance on just one man for two years. So the FBI doesn't do it often.

Ostensibly, metadata will now be collected and retained by the communications companies rather than directly by the government. The government can then request to see it from the companies if deemed necessary.

As somebody else already said, the government will probably continue in some fashion.

That's actually a good question.

We take requiring a court order to do a full recording wiretap as a given but I believe this was a fairly recent court decision from say the 60s or 70s. And I'm not sure if your phone usage by itself - phone numbers called/calls received from and duration - are even protected the same way.

Likewise I believe people's mail can't be opened without a court order but the sender and receiver information can be recorded without one.

The victors in any court case is the side with more raw information. This is an irrefutable fact and is a feature of free societies anyway. It ensures that everybody, so long as they dot I and cross their t, can, hypothetically, defend themselves based upon facts and not ideology, as was the case prior to establishment of the system circa the fall of theOttoman Empire. It cannot be stressed enough that a trial by facts is the single best thing to happen for the common man in a matter of a legal nature.

The availability of technology to gather massive amounts of information is also not a bad thing. Neither is the government having that capability, it is an unavoidable eventuality of technological development in any case. It must be assumed that the government knows everything about everybody in today's world of technological inundation.

Tell me what is the explicit codified language in any arbitrary place on any arbitrary action? Regardless of what you, or anybody attempts to suggest as clearly legal, it will always be possible to argue that the fulfillment of that action necessitates some otherwise stipulated illegal action. The vast majority of the time nobody cares and it is probable that the representatives of the estate are aware that pursuing such laws is pointless and defeats the purpose of prosecution. These laws become somewhat akin to scoff laws, but it is the government which scoffs them; the people are ignorant of them due to their sheer number or awkward specificity.

This is why a person who has a taillight out can get charged for illegal carry of a firearm in a motor vehicle. The illegal carry charge is tacked on after the fact to the original and actually meaningful violation. This explicitly increases the cost of the taillight violation by several orders of magnitude. Imagine if our driver did not have insurance too. And/or had had his license revoked. It becomes very easy to absolutely ruin a person's day, week, or even year with a siren over something that costs pennies.

So, hypothetically, let us say that a particularily nasty man is elected president. He has some very vocal dissidents. It is within reason that he wants them to go away, so he watches them for their taillight to fail. The simple solution is not to have a bad taillight.

Too bad that is impossible now. There is no hiding from technology. It is everywhere and sees everything. Giving an entity which may indeed have a vested interest in shutting somebody up the power to collect raw information on that scale on everybody is a very bad idea.

Instead of needing to mind a taillight, pennies, we must mind everything, quite the opposite. Then, life may continue without note, until you say something our nasty little president does not like. Once you do, your entire life is turned upside down, you fight an endless battle of lawyers-presumably with a lawyer, who happens to want his own paycheck-and you cannot win. Simply because the government will always have more information than you. Maybe once or twice a jury will rule against the government, but in the long run the government will win more than it loses. You did, after all, break the codified law on those specific points.

The solutions are to deny the government access to meta-data or to have the law so brief, simple, and explicit that it is knowable and follow able on the individual level or provide for the overturn of laws by jury.

The law is impossible to understand in its totality today. Technology precludes the ability to limit data collection in any significant sense, but I see no reason to explicitly allow and protect it. Juries have never had that power, it would be a significant development in jurisprudential theory if they did.

The weakest point in that trifecta is the technology portion for the time being. While it is a battle the people will not win in the end, it is the only field we can win today. The other two require revolution of the bloody variety to be implemented.

Therefore, Ace, you are either wrong or actively encouraging a revolution from our current government to some as yet undefined one. That us codified as treason and is probably not popular on the hill. I wonder whose life will be turned over?

Perjury can easily carry the day, as can pure unadulterated bullshit - i.e., the daycare molestation cases from the 1980s.

Stupidity/emotionality can sway a case, too. Some years ago, 60 Minutes or some similar news show actually got to film jury deliberations in a criminal case (the State, DA, and defense all agreed to it). Simple matter - the defendant was charged with being a felon in possession of a firearm. The DA proved (and the defendant even admitted) that: (1) the defendant was a convicted felon; and (2) he was arrested in possession of a firearm. The facts and law were 100% on the state's side. The jury acquitted, even though they agreed that the facts unequivocally showed that: (1) the defendant was a convicted felon; and (2) he was arrested in possession of a firearm, and they agreed that the judge had instructed them that they had to convict if they found those two elements to be true. Their reasoning: "He was trying to turn his life around, and wanted to become an armed security guard, so he needed to have a gun." Neither the law, nor the facts, mattered a whit to them.

457 The FBI has a lot of planes and they fly them to do surveillance in all kinds of cases. Most of them are Cessnas because the Cessna has a high wing, which lets the observer have an unobstructed view down. They fly a clockwise circle if there's an observer aboard and a counter-clockwise circle if it's just the pilot/agent up or the observer's in the left seat behind the pilot for some reason. DEA has planes, ICE has planes, the state police has planes and they all do the same thing. I spent plenty of time up there or down on the ground listening to the plane telling us what the crook's car was doing. They're not very good for collecting radio signals or meta data or whatever because up there you're picking up crap from all over. 99 percent of these cases the planes are supporting visual surveillance on the ground.
