Wednesday Morning News Dump

*I originally had "Government Run" instead of "Amtrak". It was pointed out to me that it appeared I was doing what I accuse the left of doing in the very next link, which is to lay blame for an accident before the dead are even collected from the crash. That was not my intent. I was simply using "Government Run" as a description to differentiate between an Amtrak train run by the government and say for example a Norfolk Southern train run by a private company. I often refer to companies like Amtrak as "government run" companies. I should have looked at it a bit closer in this context.

Why travel around with $16k in cash on their person if you don't have to?

I mean, I think the guy in the story got a seriously raw deal and I hope he gets everything back to him. I'm left thinking though that if I'm going to save up a bunch of money then go to LA to follow my dream, I'd leave the money in a bank and write checks or use a debit card as needed. It sounds like he did use a bank to save the money in the first place.

This is equally bullshitty as the IRS going after business owners for "structuring" their deposits so as to avoid the $10,000 reporting requirements. My former favorite, to use the term loosely, story about that was the business that sent its employees to the bank when the deposit hit just under $10,000 because that was the limit of its insurance if the person was robbed. It wasn't structuring, it was smart business sense. My new favorite is the guy who had over $100,000 stolen by the IRS because the bank asked him to do smaller deposits because the bank didn't want to deal with the paperwork. But that's structuring and that's a crriiiimmmmeee.

78 Jesus.

Here's my thing. I think the DEA did wrong. And if the guy wants to travel with $16k on his person, whatever.

But something sounds odd to me. Taking a train from Detroit to LA is kind of pricey. Carrying a shitload of cash on an Amtrak train (where, honestly, I'm more worried about robbers than the DEA, though yes the line is now quite blurred) seems chancy. And I don't get the rationale about not being able to withdraw money from out of state banks. Bank of America has branches in both states.

So I'm not questioning whether the guy should be allowed to carry all of his cash on him. Fine, whatever. And I'm certainly not defending the DEA. But I can't square the story with what I'd do in his situation, which makes it hard for me to identify with him.

That's it.

Anything over $10K the feds consider suspicious. They stopped making $500 bills 70 years ago. My banker gave me a couple instead of turning them in. I passed them on to a guy that worked for me.

He went to deposit them and the bank went nuts. Called the cops, etc.
Finally first bank admitted they had given them to me and he deposited the money.

NEVER withdraw more that $10K from you bank in cash at one time. It is an automatic report to the feds if you do.

I always draw out $7K or $8K and ALWAYS tell the teller some horse shit story about why I need the cash. Buying a car, going over seas, paying repairmen. I have a large amount of cash in my gun safe, just in case.

I'm not saying I would travel with that kind of money, but moving seems like not a bad time to do it. I remember when I moved from DC, closing the old bank account was a huge pain too and I think I got hit with some charges. It's not always easy...

Once we transition to a cashless society, all personal freedom will be dead. The government will control you totally.

As conservatives, I can't imagine why so many of our side accepts the premise that the government should know what we do for a living and how much we make. When, according to the Constitution, we should be secure in our papers.

So ergo these people were trying to circumvent US law. The US citizens had to go to court to get their money back.

The federal agents then showed McLellan paperwork that included deposits to the store's account at Lumbee Guaranty Bank. The statements showed two deposits made within a 24-hour period totaling $11,400.

The statements, they said, indicated he had a history of consistent cash deposits of less than $10,000, which is illegal.

Then, the agents told the small business owner something that shook him to his core: The Internal Revenue Service had seized all of the money in L&M's bank account: $107,702.66.

Admittedly this plan is kind of elaborate, but a new lottery-winner can afford it.

1. Win Lottery
2. Buy house and land adjacent to BLM land.
3. Buy box truck
4. Rent small industrial space in nearest town
5. Buy safe and have it delivered to your industrial space rather than your home
6. Load safe into truck
7. Drive to new house via random route, watching for tails
8. Unload and install safe yourself, or with close family ONLY

If close family is not available:

7. Drive to new house via random route, stopping at Home Depot for day labor
8. Unload and install safe with day laborers
9. Bury bodies on BLM land

Of course, there's the whole legality/morality thing to deal with.....

169 re Asset Fortfeture

There is no presumption of innocence under civil asset forfeiture laws.
Rather, law enforcement officers only need to have a suspicion in
practice, often a vague one, that a person is involved with illegal
activity in order to seize their property.

This is simply not true. There is no such thing as a civil asset forfeiture law. What has happpened is that the courts have ruled that police may seize money and property that has been used in a crime or that has been earned through committing a crime. Note that a CRIME has to occur first. There has NEVER been a ruling that says police may seize money or property when no crime has ever occurred. And yet they are doing it all over the place when budgets are tight. And people can get their money back, less lawyer's fees. What people need to do is file charges for grand theft and sue the living hell out of these THUGs. But be prepared for years of court appearances.

The gold in the safe thing is only part of it. I would want the new house to be a castle with secret doors, passageways and an underground bunker.

Of course to keep the secret passageways secret I would have to silence the architect and the construction crew that built it.

Of course, being in a castle, surrounded by a moat and high walls, is still a fixed position so I would need an army to defend the fixed position.

...and an air force... and the way to conquer such a strongly defended castle is with a bigger army and air force...

So I don't see a solution.

179 Good news, everyone!:

The Food and Drug Administration proposed new rules Tuesday that would allow gay and bisexual men to donate blood in the U.S. for the first time in decades. The ban, instated in 1985 in the early years of the AIDS epidemic, has long been criticized by members of the medical community and portrayed by LGBT groups as a civil rights issue.

Although activists have decried the lifetime ban on gay and bisexual male donors, calling it outdated and homophobic, the prevalence of HIV in the gay community continues to be a concern as it relates to blood donations.

According the Centers for Disease Control and Prevention, men who have sex with men make up only 7% of the U.S. male population, yet they made up 57% of people with HIV in 2011,

Good news, every Juan!:

Los Angeles County supervisors voted Tuesday to end a controversial program that places immigration agents inside county jails to determine whether inmates are deportable.

The Board of Supervisors voted 3 to 2 to sever the county's contract with U.S. Immigration and Customs Enforcement, which allowed ICE agents to work daily inside jails and trained jail employees to assess the immigration status of inmates.

Immigrant advocates have sharply criticized the program, known as 287(g), since it began 10 years ago, with some saying that it encouraged racial profiling and resulted in deportation orders for people who were in jail for minor offenses. During Tuesday's hearing, protesters erupted in chants of: "Sheriff, listen, immigration is not your business!"

Yep. 40 years plus since gays have known there's a deadly sex related condition in their community, that's easily preventable by just behaving yourself, and we still have this:

In 2010, gay and bisexual men accounted for 63% of estimated new HIV infections in the United States and 78% of infections among all newly infected men. From 2008 to 2010, new HIV infections increased 22% among young (aged 13-24) gay and bisexual men and 12% among gay and bisexual men overall.

www.cdc.gov/hiv/risk/gender/msm/facts/index.html

And per the CDC, that 7%% of the population being gay/ish male is actually 2%. And the CDC sure isn't making it easy to find the "percentage of the Gay population that has HIV" number. Because racist.

VDH omits one major fact that is at the root of all the crap we continue to have on the so-called freedom of speech. It was never intended to control local laws. That is a pure invention of the courts.

That should be glaringly obvious when the text starts with Congress shall make no law . . .. Indeed it wasn't until 1925 when the liberal court ruled in Gitlo v NY that it was "incorporated" to the States that it was made applicable to everything. They used the 14th amendment to do this and much mischief has ensued since then. The 14th amendment was never intended for this use.

And the other odious fact about this ruling was that the court upheld the conviction thus the ruling was totally unnecessary.

And thus we continue to have debate over what the first amendment, including the religoious part, means because it was never intended to apply to the States.

229 POTUS Obama says ...

"I have to say that if you watch Fox News on a regular basis, it is a constant venue. They will find folks who make me mad. I don't know where they find them. They're all like, "I don't want to work. I just want a free Obama Phone, or whatever."

... but according to ...

Rep. Hank Johnson (D-Ga.) says with budgets like the GOP plan, "the have-nots of this country will rise up like the people in Baltimore."

230 I grew up with a guy who (last I checked) was a DEA agent. He and his whole oversized, uber-Irish Catholic family were crusading, law and order right wing, adrenalin-seeking types who went the prosecutor/LE route.

I'm beginning to hate this type of person.

231 "The President has been a longtime advocate for investing in our infrastructure and making sure that we have the kind of 21st century infrastructure we know is going be critical to the success of our country," White House press secretary Josh Earnest said on CNN's "New Day." Earnest said that the Obama administration is "hard at work" trying to figure out what caused the crash, and that their thoughts and prayers are with the families of everyone effected.

If there just was another $5 or $6 trillion to spend on infrastructure, this crash could have been avoided.

233 "Chicken or egg syndrome."

This "chicken or egg" post - the one which implies the question Which came first, the chicken or the egg? and by extension offers two opposing views about the origins of chickens and eggs, one holding a strict Biblical-creationist view citing the Book of Genesis and how it says that God created the animals on such-and-such day, versus the other view, based on the theory of evolution which would put forth that the ancestors of chickens were egg-laying animals that over time evolved into chickens - is needlessly provocative.
