Obama Has Given Up On Guaranteeing Free Traverse of the Seas

The United States has enforced the free transit across the seas for centuries.

Iran is now taking piratical prizes; and Obama, you will not be surprised to hear, is okay with that.

The seizing of the Maersk Tigris wasn't just an act of piracy; it was a declaration of a new order on the seas, and Obama has, as usual, bowed to a foreign potentate.

Since World War II, the American Navy has been the guarantor of freedom of the seas for all nations and commerce. The U.S. Navy prides itself upon its annual forays into disputed waters to demonstrate that seizing ships like the Tigris means engaging American warships. But neither the White House nor the Navy declared that Tuesday’s seizure violated that basic norm. Instead, the Iranian foreign minister brazenly invoked respect for freedom of navigation. Iran flexed its muscles and America did nothing. Translation: The U.S. is a paper tiger, and Iran will seize other ships as it pleases. When a timorous America imposes no penalty for state piracy, such actions are sure to repeat. Imagine how that affects the calculus of a hundred nations and thousands of ship owners.

[T]he seizure illustrated that Mr. Obama is determined to reach a nuclear deal with Iran, regardless of what actions Iran takes.... [T[he seizure was not an accident; it was ordered by the same government with whom Mr. Obama is determined to sign a nuclear agreement. Mr. Obama could suspend negotiations, with sanctions in place, until the Tigris is released. But he will not.

I lost track of this story myself; I did not know that Iran was keeping its war booty.

A source (a French diplomat, I think) had earlier said that Obama Administration was acting as the mouthpiece for the mullahs at the nuke talks. Even here, our own government flacks on Iran's behalf, insisting that this ship was seized by the Republican Guards without the blessing of the government.

But if so-- why do they still keep it? How long does it take to communicate an order to the Guards?

So this is America, where our government lies to us on behalf of a fanatical regime of an alien religion which has sworn to destroy us.

58 Part of the problem was evident rightee here in these comments on the first thread on this topic. Lots of hair-splitting and chin-stroking about fine details of the Iranian action (most of it illiterate in the sense that freedom of navigation, esp. in Hormuz, has and must be enforced somewhat aggressively, given the geography, the players, and the stakes).

The observation that this is a fundamentally unserious country applies not just to the vast swathes of the sports- or pop-culture addled, or the shallow stupid NPR types who gaves us the current regime and situation, but to those who show more sense as well. The lack of will - and of the savvy that will *is* the key ingredient - was evident from 2005 on. Not just in society, and the political class (the wretched begging of McConnell for some sort of political relief because whaaaa Iraq was haaaard and stuff), but in the brass (esp. the Army) as well.

Fine to focus on the histrionically absurd, unfit, alien sorts like the president and his band of Beltway featherweights. But the rot, and the irreversible change (don't have a word for the new America, really), extend far far beyond the Beltway.

Is this your way of pointing out that we have a weak-knee'd congress that would never do such a thing? If so, props to you.

If they had any stones whatsoever, they would do exactly this kind of thing to stop TFG from running America into the ground. But they don't. So they won't.

108 A wee bit OT, but I just got a call that my sister-in-law, for whom I am the only surviving relative, has just had a second heart attack in six months and is being transported to one of the medical "centers" 90 miles away from her regional hospital (which was pretty much gutted by O'care). She sounded pretty upbeat, but I do not think this is a good situation.

SO, any prayers would be much appreciated and I offer my thanks in advance since I now have no idea what my schedule or internet access will be for the near future.

You don't realize that President Supergenius is playing three dimensional chess here with moves so far ahead that it would dazzle you if you could comprehend it.

First off, while it will adversely affect China, massively increased piracy would raise the cost of importing goods from China and lead directly to an upsurge in manufacturing in the United States. Manufacturing jobs used to be the backbone of the union movement and can be again. Those manufacturing jobs will be filled by all the illegal aliens who have come over the border within the last few years. Instead of working in the new manufacturing jobs, blacks will continue to buy and sell drugs, go to prison, collect welfare and vote Democrat. Hey, if a system works you don't want to screw around with it.

There will still be a need for transportation but with ship transport made too expensive by piracy, air transportation will become much more common. Since Aircraft manufacture is one of the few areas in which American manufacturing is still doing well and since aircraft manufacture is heavily unionized by militantly left wing unions, this is also a good thing.

Finally, the US Navy will protect US flagged vessels. Once again, heavily unionized.

The U.S. Navy is now escorting most ships under U.S. flag through the straits. Which is nice, but that's the reason the ICRG picked a ship under American protectorate, not flag. That would be a direct act of war and has been for centuries.

The bottom line is Obama is so desperate for a deal that any response won't be punitive. It's also laughable they've framed this as factions within the IRG that don't want a deal acted independently.

Probably. Haven't thought it all the way through yet. I would have a much harder time doing that with an island that is already part of a US territory.

With a sailboat, I could anchor offshore and visit/make my home there at my leisure, as long as I had my bug out bag ready to go at a moments notice.

188 I doubt anyone who wasn't riding in the van will ever know what actual justice is, in this case, short of some very clear evidence. A jury will make a decision. One faction will be very angry about it. Another will say justice was done. The only ones who will know what is actually true will be the people who were there.

Wonder what would he do if Congress declared war on Iran?

Posted by: CSMBigBird at May 01, 2015 01:08 PM (jsWA"

Obama, of course, would never sign such a declaration.

The question, though, is interesting in the event that we ever have a real President again. Effective opposition to wars requires that the media have many news cycles to drive home the anti war message and then, after the media have reinvented reality, the Democrats are free to undo the accomplishments won with the blood and sacrifice of America's fighting men and women.

However, Iran could be hit with about 600 nuclear weapons over the course of a day or two and then cease to pose a threat. That would only involve a couple of news cycles and then the next earthquake, Kardashian, ghey thing, race riot would push it out of the news. There would be documentaries on PBS and all the usual lefties would say all the usual stuff about America being the worst place evahhhhh but they already do that now.

Eventually, Democrats will lie themselves back into power and they will try to undo the victory but unless they can genetically recreate the Persians and, while they are messing with the DNA make them radiation resistant, they will not be able to undo the results.

The Democrats might threaten to turn over all the people involved to the International Criminal Court, because you know the Europeans would be hopping mad about that sort of unilateral US action but I am guessing that Israel might be willing to provide sanctuary until the Democrats are gone.

190 Just like not negotiating with terrorists....

Obama is now 'fundamentally changing' America, by ceding the freedom of the Seas so many of us spent YEARS defending.

Obama allowed a Civil Court in Iran, to order the seizure on this ship...

They argued it had entered Iranian Waters... so just like the Spaniards seizing the ships of the treasure hunters they wanted to get Gold from... it was 'legal'...

Even though it was in a Channel that in the past, we had guaranteed a right of innocent passage.

What this precedent sets, is that now Iran will press the claim that any ship entering the Gulf is under Iranian Legal Jurisdiction, INCLUDING for TAX purposes.

And we are letting the Precedent stand.

205 This is the second incident. First time was an American flagged ship.

Crew of Iran-Seized Maersk Tigris Are 'In Good Spirits,' Company Says

The crew of a cargo ship seized by Iranian forces were safe and in "good spirits," Danish shipping company Maersk said Wednesday.

The Maersk Tigris was preparing to enter the Strait of Hormuz when the Iranian Revolutionary Guard fired across the Marshall-Islands-flagged ship's bow and boarded it Tuesday, according to senior U.S. defense officials. Iran has not officially commented on the seizure.

Maersk said Wednesday it was in close talks with the Danish Foreign Ministry and was working to obtain more information about why the vessel was seized in international waters.

"The crew is safe and under the circumstances in good spirits," the company said in a statement. "The well-being of the crew remains our paramount concern."

Maersk said that according to its information, the ship was being escorted towards Bandar Abbas in Iran by Iranian patrol boats.

The U.S. Navy has dispatched a guided-missile destroyer, the USS Farragut, and three patrol boats to the southern end of the Persian Gulf.

The Tigris is being held in Iranian territorial waters, and it is unclear what circumstances would trigger a response or whether the U.S. is willing to engage militarily with the Iranians.

Col. Steve Warren, a Pentagon spokesman, said the United States "has the discretion to take action" under maritime law. He said that would require a presidential order.

The takeover of the Tigris was the second incident of Iranian "harassment" of free shipping within the Strait of Hormuz in four days, Warren said. On April 24, four Iranian Revolutionary Guard gunboats "harassed" the American-flagged cargo ship Maersk Kensington as it transited the Strait into the Persian Gulf.

220 I already provided an update, that the US Navy is accompanying US flagged vessels through the straits and that the Iranians are holding to their claim that they have a court judgment.

While I do not believe their claim, once the ship was intercepted and ordered to anchor there is little that can be done by the USN. The Maersk Alabama incident took place on the high seas, without any nearby support for the pirates, no nation-state involvement, and pretty much was in the control of the USN from the time it showed up. Here it wouldn't be quite so easy.

Posted by: Sambo at May 01, 2015 01:28 PM (sPp6M)"

One thing you might want to look up on the intertubes is "Sea-Crete" or "Biorock". Essentially, if you feed negative DC current into a submerged conductor like the steel legs of a disused oil platform, calcium carbonate will acrete onto the conductor at the rate of about 2 inches a year. This reverses rusting and makes the underwater portions of the platform a lot stronger. It also serves to remove carbon from the ocean so maybe there is some sort of environmental do gooder government program that would guarantee your occupation as long as you maintain the windmill that generates the power. Another thing about that is that shellfish attached to the conductor grow at twice the rate that they do in ordinary conditions so if you want ed to raise oysters or some other shell fish commercially of for your own consumption, that is something to think about.

During the "Tanker Wars" of the 1980's the Kuwaiti tankers were re-flagged as US ships which put them under US Navy protection. Even then, during the Reagan Administration, we were not escorting everybody and his brother's ships through the straits, just ours and close allies.

Me - I think that this is Iran trying get something back from the USA for those ships that were turned back from Yemen. Despite all of their bluster the Iranians know they really cannot take on the USA in a shooting match, so they pull a little stunt like this, grab a flimsy pretext, just so they can shout "See! 345 Washington (CNN)U.S. Navy warships accompanied four U.S.-flagged vessels through the Strait of Hormuz Thursday, beginning a new military operation to offer armed protection from potential harassment by Iran's navy, a U.S. defense official told CNN.

The ships transiting the strait were both inbound to the Persian Gulf and also outbound into the North Arabian Sea, and they traveled without incident. All four unarmed vessels were military supply and survey ships either operated by the U.S. Military Sealift Command or under contract to the command.

The official said the Pentagon will not be providing daily details on transits or the warships in the area because the U.S. "does not want to establish a pattern of life" for observers in the area.

A big part of the expressed concern on this blog is all of the officers who knowingly follow bad orders (See Wisconsin's Shame, and also the stand down orders to let it burn in Baltimor). I realize that county sheriffs may be different than municipal police, but I can't imagine they are entirely different. The Iranians don't really have all that many ships. Certainly not much in the way of prizes for letter of marque privateers. It would not be all that good an idea to attack their port facilities because their main oil customer is China and with all the other problems, it would be a bad idea to piss of the Chinese as well right now.

Iranian infrastructure might make a reasonable target if the US were sufficiently peeved. Knocking out the Iranian electrical distribution system would make life more unpleasant for the Iranians. Blowing up the gas compressors that supply the CNG for their cars would also make life difficult for the Iranians and have few consequences outside of Iran. Doing either of those things would probably require destroying the Iranian air defense system first and that job got a lot more difficult with the delivery of Russian S-300 missiles. Of course, if you destroy the air defense system then you might as well then use deep penetration bunker busters to blow up the Iranian nuclear bomb program.

That is why Soros has Valerie Jarret to ride herd on Obama. What did the left need in a president? 1. Large head - like all famous people. 2. Reasonably good at reading a teleprompter. 3. Historic First Black Man. 4. A finger puppet to absorb the right's ire.

Incompetency is completely predictable: you know they'll screw things up - if screwing things up is what you are after - who could do it better? Soros wants the kind of chaos he has profited from in other parts of the world.

Obama won't stand up for the Marshal Islands and if he won't protect them, he sure as shit won't protect Taiwan, Poland, Japan, Germany, or anyone else that considers the USA their pre-Obama ally.

Our allies know we could elect an idiot like Obama at any time and this means they know that the USA can never be counted on for more than four to eight years at a time ever again. Good job Obama.
