Is This Still America? The John Doe Raids and the Weaponization of Government

Crossroads.

Yes, Wisconsin, the cradle of the progressive movement and home of the "Wisconsin idea" -- the marriage of state governments and state universities to govern through technocratic reform -- was giving birth to a new progressive idea, the use of law enforcement as a political instrument, as a weapon to attempt to undo election results, shame opponents, and ruin lives.

Most Americans have never heard of these raids, or of the lengthy criminal investigations of Wisconsin conservatives. For good reason. Bound by comprehensive secrecy orders, conservatives were left to suffer in silence as leaks ruined their reputations, as neighbors, looking through windows and dismayed at the massive police presence, the lights shining down on targets' homes, wondered, no doubt, What on earth did that family do?

This was the on-the-ground reality of the so-called John Doe investigations, expansive and secret criminal proceedings that directly targeted Wisconsin residents because of their relationship to Scott Walker, their support for Act 10, and their advocacy of conservative reform. Largely hidden from the public eye, this traumatic process, however, is now heading toward a legal climax, with two key rulings expected in the late spring or early summer.

The first ruling, from the Wisconsin supreme court, could halt the investigations for good, in part by declaring that the "misconduct" being investigated isn't misconduct at all but the simple exercise of First Amendment rights. The second ruling, from the United States Supreme Court, could grant review on a federal lawsuit brought by Wisconsin political activist Eric O’Keefe and the Wisconsin Club for Growth, the first conservatives to challenge the investigations head-on. If the Court grants review, it could not only halt the investigations but also begin the process of holding accountable those public officials who have so abused their powers.

Important and frightening.

I don't recall offhand but I believe the John Doe statute contains statutory authority for requiring gag orders. I could be wrong on that.

I still cannot fathom how John Doe statutes are Constitutional.

51 At the state level, the prosecutors persecutors have been busy trying to get 3 more justices to recuse themselves for having "ties" to their targets. So far, only Ann Walsh Bradley recused herself from the case...because her son works for the law firm representing one of those targets.

Why is the recusal push so important? If there's fewer than 4 justices who haven't recused themselves, the Wisconsin Supreme Court can't hear the case, and the final word belongs to the District Court of Appeals that previously heard the case. In this case, it would be the Madison-based 4th District, which sees nothing wrong with the persecutions.

Indeed, two of that three-judge panel have significant "issues" that would be ripe for calls of recusal if they weren't Lawgivers-In-Black highly interested in silencing their political opposition. Brian Blanchard, back when he was the DemocRAT District Attorney in Dane County, used similar tactics to try to (and partially succeed) hand the entirety of the Legislative leadership and the office of state attorney general to the Madison wing of the DemocRAT Party of Wisconsin. The second is Joanne Kloppenburg, previously seen losing to David Prosser in the 2011 Supreme Court race.

I do know that when I got arrested for suspicion of a DUI (I was not drunk & thus never charged), the cop told me I did not have a right to consult with a lawyer about blowing in the breathalyzer as part of his little "you're under arrest" speech.

In the past I was never a small government type. I mean, not small small. I used to like government because, to me, it meant order and equal protection.

Today? Each day I become increasingly in favor for a miniscule government.

They didn't get in to it, they just said I had to blow, wasn't allowed to talk to an attorney, and was being handcuffed for their protection.

Then I blew .00 and they let me go after doing several flashlight in the eyes tests to make sure I wasn't on drugs or whatever silliness it is that they do with flashlights in eyes.

No apology or anything, of course.

My wife had a similar experience. She was pulled over near the Canadian border, on the US side. The cop told her he smelled alcohol. She has never had alcohol in her life.

He pulled her out of the car, wouldn't let her get her coat, and made her stand there for ten minutes with no coat in winter. When he got back around to talking with her, she had her hands in her pockets and he barked at her for that.

He gave her the breathalyzer and she blew a 0.0. He reiterated that he smelled alcohol and told her she was lucky he was releasing her. No apology.

In 2005 I bought a new Compaq laptop for $700 that was 5x better than my Thinkpad.

Today, 10 years later, I'm trying to buy a much better laptop than my Compaq for just half the price (~$350 ).

Of course, "Civil War" is a misnomer. The South wasn't fighting the North for control of the United States (which would have been an according-to-Hoyle civil war). Or, if you insist on calling it the "Civil War," then you should call it "Civil War II," since the first one would have been the American Revolution.

My sister had a computer with Windows 8 that crapped out. While I was looking to see if it could be fixed easily I gave her my old laptop with Windows 7, my new one had 8 and I was just starting to use it. I was bitching about how 8 is shit, and pretty much everything I viewed of it before actually having it was right. (If you want to play Minesweeper you have to download it as an app that takes up the entire screen. FUCKING MINESWEEPER! Tell me that's a good OS.)

During this she mentioned not really liking it either and brought up her coworker. Her coworker has a Windows phone. And she likes it. But yet she also has a computer with Windows 8. HATES it. That is Windows 8 in a nutshell. It is a phone operating system that Microsoft stupidly thought people wanted their PCs to behave like.

THat is entirely correct. Akil Amar discusses/ed it frequently, how the 14th amendment changed the fundamental conception of states as sovereign within their spheres. Once that happened, unitary government (a la England, with a supreme parliament) was all but assured. Only problem is that instead of a single all-powerful parliament, we got a ready-made dictator in the form of a president. Prime Ministers are much weaker.

Ok, I understand and agree with this, but where the hell you got that I was bringing a "The South Shall Rise Again" vibe is beyond me. Seems as though you are a might too sensitive.

I simply said that my opinion is that the Constitution died (or began to) as a result of the Civil War. I realize that all the Lincoln lovers object to this, but it is patently true.

I've always preferred to read biographies. There are plenty of good ones out there about the generals on both sides of the civil war, and compilations of letters from soldiers on both sides... I'd suggest checking some out.

The Z80 in the C128 was solely used for CP/M mode--which I think I used no more than 5 times. Other than watching the "beachball" demo that came with the RAM cart, I generally used it as a ramdisk. Good times.

Speaking of old shit, I guess I should get back to playing my Windows 98 game (Max Payne) on my Windows 8.1 gaming rig...

The police used to watch over the people, now they just watch the people. So fuck 'em. I'm sure there's some good ones, and in truth my few encounters are nearly always positive because I'm always in a suit and have my life in order. But because you never really know which card you're going to draw, I treat them all as potentially abusive and dishonest. It's the only smart play.

Not workable. Such a thing is not a Union, because every election loser gets an instant veto on something they just voted on.

It'd be one thing if there was a secession procedure in the Constitution ... but the idea that it takes a majority to vote a new state in, but that state gets to leave at any moment it wants is ridiculous - because the logical end of such a "right" is that each county, city, town, and family also has the unilateral ability to secede from the state.

I see the problems we face. I firmly believe they can be resolved politically and peacefully.

Be a long tough process, surely--but doable.

It starts at the dogcatcher level, where our own "long march through the institutions" begins. How long it will take, I have no idea.

But unless it begins at this basic level, change will never occur.

All of us can help here, even though our effort may seem totally insignificant. But you CAN effect change at the local levels.

Keep in mind, that the oath so many of us swore, that hasn't an expiration date does not always mean picking up a weapon to fulfill.

All that doesn't mean that if things go pear shaped and there's no alternative I won't ruck up and become someone's nightmare.

Look into Classic Shell to make Win 8 more palatable. Makes a Win7 type of interface the default.
