I have to confess my own bad behavior on this score: My own post was similarly "baffling," despite this also being my pet issue. In my own case, I mistook the situation we were in; I thought the University was within its rights, so that the only thing to be argued over was whether it should do something it had the right to do (a fight I imagined, as I still do, which would be utterly futile*). In fact, they do not have the right to do it, and universities are required by law, despite being private institutions, to administer questions of the first amendment with all/most of the restrictions placed on the government. David Harsyani had the right position coming out of the gate. (As did many commenters here.) Eugene Volokh asks: What's next? Students talking to each other about a student group event about how Hamas has it right? (The Charter of Hamas, recall, expressly says, "The Prophet, Allah bless him and grant him salvation, has said: 'The Day of Judgement will not come about until Moslems fight the Jews (killing the Jews), when the Jew will hide behind stones and trees. The stones and trees will say O Moslems, O Abdulla, there is a Jew behind me, come and kill him. Only the Gharkad tree, (evidently a certain kind of tree) would not do that because it is one of the trees of the Jews.' (related by al-Bukhari and Moslem).") Why, that could be labeled leading an anti-Semitic and exclusionary discussion that, once it’s publicized on campus, creates a hostile educational environment for Jews. Black students talking to each other about how all whites are racist, and white cops -- and maybe other whites --- should get shot? Again, that could be labeled racist and exclusionary speech that, when publicized, can create a hostile educational environment for whitesPart of my problem with that kind of analysis is this: It is idealistic, and departs far from reality. We all understand the reality we are dealing with: Whites are now legally second-class citizens as regards this sort of law (and many others), and no college would ever try to boot out students for the kind of "racism" Volokh discusses. Oh, I suppose maybe some explicitly, actually Christian university might try the former, but they'd be backed down quickly after a bevy of lawyers and newsvans swarmed the campus. No, what we are talking about with these Speechcraft trials is more-or-less explicitly a tool for non-whites to punish whites. (Caveat: Conservative minorities can expect to be treated as "white" for these purposes, because Race Traitors.) And no, that's not just An Racist talking. The leftwingers pushing these Speechcraft trials are admirably upfront about their belief that speech codes bind "Oppressors" only, and do not bind "The Oppressed." There is even a claim made -- frequently -- that blacks are definitionally incapable of being racist, no matter how filled with racist animus a particular black person might be. The silly claim goes that Racism equals Racial Animus Plus Power, and as they have explicitly defined themselves as the powerless Oppressed, it is actually impossible for a black person to be racist. (They ignore the situations in which black people do in fact have "power" over other people. But that's what silly ideologues do, ignore reality.) So really the only realistic situation where this sort of unconstitutional-but-politically-correct persecution happens is against one of the "Oppressor" cohorts (white, male, cisgendered, Christian, etc.) for the socially hard-to-defend speech that upsets one of the designated "Oppressed" castes (nonwhite, female, gay or trans, Muslim etc.) Trotting out "what if they do it to Muslims" or "what if they do it to blacks" is silly-- Muslims and blacks know they won't do it to them. These sorts of unjust prosecutions are nothing but upside for the "Oppressed" -- they are a wonderful vehicle for inflicting cruelty upon hypothetical Oppressors, but they have near-zero chance of being turned against "the Oppressed" themselves.** Perhaps we need to change that. Perhaps we need to inflict as much stupid cruelty versus these things on the so-called "Oppressed" to achieve a Balance of Terror on the process, an aversion about it from all sides. But that's silly too: Liberals in universities are not going to also bring unconstitutional speech prosecutions against blacks, gays, women, and Muslims. I don't know. I have no idea. Pretty much the country is lost. * My crusades of late have been about situations where a company has a right to fire an employee (and a company has the right to fire any white at-will employee, and most people under contract, too), but which could be pressured, possibly, into not exercising that right. My thinking was, if a Mob pressured them to harass someone for his speech, another Mob -- a better Mob -- can pressure them into not harassing someone for his speech. I thought, incorrectly it turns out, that OU had the right to do this, so we were in a Clash of Mobs situation, and I figured our Mob had no chance. But it's a different thing entirely if OU actually has no right to do this in the first place. ** This mode of argument is of possible usefulness with Liberals. However, it is useless with Leftists. A Liberal might actually care that what is sought is a two-tiered system of justice and rights. A Leftist cares, too, but he's in favor of that, explicitly. Perhaps there was a time with Leftists would lie about their objective; but they're admirably forthright now. If you tell a Leftist, "But you're creating a system wherein whites have lesser speech rights than blacks," the Leftist will say, proudly, "Exactly." The media likes to talk about conservatives become MOAR XXXTREME; they never seem to notice that many former marginal Liberals are now simply Leftists, and that all Leftists have become more radicalized and militant about their Leftism.*** *** It is useful to note that "social justice" expressly means group justice, as opposed to individual justice; the very notion of "social justice" is intended as a corrective to the perceived perfidies of individual justice. Leftism is exactly antithetical to the Enlightenment values of justice for each individual, the cornerstone of the liberal tradition (of which liberal conservatives are the most fructuous and vigorous descendants). Leftism posits that doing justice in each individual case will result in "injustices" for the Oppressed groups who are Poorly Served by Your White Man's Justice; "social justice" is therefore explicitly about one group demanding collective punishment of another group. And the Left has not created this system so that they may be punished by it; as I already mentioned, they have a great many doctrines justifying explicitly two-tiered, race-conscious "justice." Almost anything said that is controversial is going to offend someone. Nobody seems to mind when the person being offended is white, Christian, or pro-US, and that is where the slippery slope begins. There should not be criminal or financial penalties applied to speech, no matter how offensive it is, coming from a governmental or quasi-governmental agency, and the only penalty from private interests should be in refusing to do business with them.

Country's not lost, but for the longest time (and perhaps even today) an honest discussion on race was discouraged on AoSHQ, with inevitably some silly little "cleanup on aisle 36" comment whenever a poster acknowledges that, as it stands today, blacks hate whites. Not all, mind you, but close to the 95% who voted for Obama ... TWICE.

One is comprised of those of us who cling to the idea that we are a country of laws. I was in college in the mid 90s, right before all this insanity on campus started. It was sort of there at the margins, but it was such a small minority of people we laughed at them.

The reasoning is that the unwelcome group is often the one who pays the bills or carries the weight of the system, so they must be either enslaved, or held to a different standard, so that they can be milked while not enjoying the fruits of the system. Note that this also applies to the political parties, so that certain types of democrats are kept from the spoils system, and that certain types of republicans (read: Tea Party) are driven out in the primary process. The process also applies everywhere from college campuses to boardrooms. It isn't a conspiracy, it is human nature. Orwell noted it well when he observed the communist systems. I know it rankles some people, but this is the problem with lawyers. You talk yourselves into circles of logic, where common sense and reasonable decency are not part of the equation.
Either what these kids did was bad and therefore punishable, or it wasn't. And if the Constitution says we don't punish people for speech, then we shouldn't. Parsing this down, depending on whether this is a public institution or not SHOULD NOT matter. The only reason it does is because lawyers are in the business of interpreting law. I say this with complete sincerity: Lawyers should either be in the business of making law, or interpreting it. Not both. Because we live in a land where the average lay person CAN NO LONGER interpret law for himself, we have lost many of our most basic freedoms. I was stunned when I was talking one day with a black Army senior NCO. The subject of CocaCola came up and someone joked about the cocaine content. This senior NCO sadly says, "Yes, we lost a lot of good men in the '70s because of that." !!!WHAT?!?! The cocaine content was nearly zero in 1903 and gone by the 1920s. I told this man that if he could find a can of CocaCola from the 1970s with any amount of cocaine in it he'd be a wealthy man. This would not be hard to do because people collect old cans. Schools have the right to yank a fraternity charter, since a fraternity is essentially a school-endorsed club. That being said, assuming the school doesnt own the fraternity house (they may or may not), they have no right to kick the kids out of the house and tell them they dont have the "freedom of assembly" to continue fratdoggin it up. But i think SAE nationals also yanked the OU SAE's charter, so they couldn't continue to operate under that name. You know what we really need? Some sort of law document that spells out how a government can behave towards its citizens. Given that power is always abused, maybe it could outline areas of life that a government can't enter. It could even be some sort of "master law" that all other laws have to abide by, and you couldn't make any other law that doesn't agree with it or else it'd be null and void.

Very few people who are still alive have experience "institutional racism" in the sense that their governments made laws specifically targeting people by race. Those that did lived under progressive D governors and D legislatures in the south post - Plessy (so the jim crow days). 228 comments as I post this. I do not have the time to read all of them, so what I am saying has probably been posted, and maybe even refuted by many.
But, I agree, sadly, the country is lost. Not only politically, but generationally. There are moment when I simply want to disappear, to run off to some unkown hidden location in the mountains, get off of the grid, and live the simplistic lifestyle of survival. There are other times when I see that it is truly time for a grand revolution, where we fight, to the very end for our rights and freedoms, where we totally and completely defeat the forces of evil that are being waged against us. I do see a glimmer of hope in that some of the younger generation are actually thinking critically, on their own, and I hope that maybe more of them will come to the conclusion that what they see, hear and are taught in the universities and school systems are not just wrong, but evil, coming from the mouths and mind of group think, where one can have no other opinion, or thought, other than those than that they are programmed to speak or think. I simply do not know. Maybe I am just old, tired, worn out, Maybe I have been too disillusioned from watching our party make some great advances, electorally, to take back control of the entire Congress, and even the Presidency, simply to be sold out to Establishment interests. I, for one, do not have the time to wait for the emergence of some grand new Political Party which will rise to power (only to eventually succumb to the corruption and evil of Washington D.C.). Maybe it's time for Texas, and like minded states to simply secede, to bow out of this grand experiment that we once, proudly, called the United States. As someone in the "younger generation," I disagree. Yes, many of my contemporaries see our government as shitty, corrupt, and inept. But they DON'T see free markets as the solution. That's what rich white people want, and my generation is about as averse to rich white people as any generation ever. Also, for many cities (and I think I read it's true nation-wide now) there are more minority students enrolled in schools than white students. So it will not be long before socialists from central america and other assorted imported Dem voters outnumber "white people" and the system of government that has been built in this country. I think UO runs into constitutional problems specifically because it's a *public* University, so (courts have held) it has to apply the first amendment to its students.
Private universities don't have to do this, as a legal matter. Mind you, they end up having to follow all kinds of rules because of the strings attached to various federal grants (Title IX being the gold-plated example), but they're always free to say "keep your filthy government money, we're following our own rules".
