Is This Why Hillary Clinton Deleted 32,000 Emails?

Did you know this? I wondered, but didn't know. So, when Hillary leaves office, she is now in possession of a mountain of classified information, all on her servers.

She of course is not allowed to keep that information. Only the government and its currently serving operatives are permitted to possess classified information.

But she's in this odd situation, odder than most, because she insisted on transacting all business on her private servers, rather than the government's.

So while the typical Secretary of State would only have to search and delete a few of his private emails to bring himself into compliance with the law, Hillary Clinton, drunk on power and vodka but mostly vodka, now finds herself with servers stuffed with thousands of emails recapitulating classified information.

That's illegal. And furthermore, it was illegal to have kept these emails for any period of time past her official tour of duty.

Actually, her little Paranoid Gambit may have put her in the position of an impossible dilemma: On one hand, she is required to save all correspondence. (For a normal person, this is no problem, as the correspondence is on the government's servers, and is saved automatically).

But another law says she can't keep all those emails, because they discuss classified information!

The way out of this dilemma is to recognize it, and to turn over the servers to State (thereby being in compliance with both laws), but for Hillary Clinton and her desire to hide evidence, that's an impossibility.

So... perhaps at that point she decides to have a Deleting Party for six months.

Anyway, that's all my supposition, but what is not supposition is that it is actually a crime to possess classified information without authorization (Petraeus just pled guilty to this crime) and that Hillary signed an exit statement certifying she had no classified information in her possession.

As you read this, remember her strange, convoluted, and lawyered-up wording: There is no classified information.

That sentence is in present tense, and isn't even grammatical. It's literally senseless.

Why did she say this senseless thing so senselessly?

Actually... The writer, Shannen Coffin, points out a more likely scenario: That Clinton is now "returning" these documents (and references to documents; referencing classified information makes the reference classified) to State to make herself, allegedly, in compliance with the law.

But she wouldn't be. Turning over documents two years after leaving office, and only after being pressed on it by State Department officials and Congressional subpoenas, is not what the law has in mind.

3 Those e-mails, that work product, belongs to the US government, not Hillary Clinton, and the US government should take steps to secure that server and its contents.

Unfortunately, that is in the incompetent yet skulduggerous hands of the Obama administration, such as AG Holder and Sec. Kerry, so I expect them to fail on this.

She cannot know who has those emails, just the veiled threat of a release which compromises her integrity will modify her behavior. We cannot trust her in a position of public trust.

I suspect it is the email with regards to financial transactions and previous positions (Fast & Furious, Benghazi) that concern her more. I believe the classified issue may be a red herring, anyone (or organization that permitted it) who forwarded classified traffic to that UNCLASS address should be prosecuted. Now, in her position, it is likely that an aggregate amount unclassified information could constitute a classified data store; and any individual statement generated by someone in her position could have implications that could have security concerns.

Yeah, I have a hard time believing she was running the sever in her basement. Just because of power outages and all of that, and being a residential home with comcast cable (which is not the most reliable in the world, especially during winter, with storms). That would mean her email regularly went out when power or cable went down.

But wherever the server was, or whoever hosted it... and why they have forwarding IP addresses and companies in the caymen islands and all the other bullshit... who knows? Honestly, who cares?

This is what democrats do. And they get away with it.

So why get all worked up?

CLINTON: I did not email any classified material to anyone on my email. There is no classified material.

Well, that's not responsive to the question. It looks like she really wanted to make that statement about classified material: this was very close to the end of the press conference; not much time left to say what she had to say. So, she just slipped it in there.

How many of those staffers had been vetted by the government and held security clearances sufficient to be reading message traffic at the SECSTATE level?

109 I'm trying to figure out how to equate this business with the Zimmerman telegram. It is worth noting, the U.S. decided to go to war with Germany in 1917 because of the contents of a telegram, intercepted by the most basic of spying techniques.

Needless to say, important stuff gets communicated back and forth within and between state departments, foreign secretaries, etc.

I think there are big shoes that aren't dropping here yet. Most likely involving Iran, Isis, the Egypt and Libyan eruptions, Russia in the Ukraine and elsewhere, and countless other matters involving the Chinese and Norks.

What things? We may never know, but it's possible... just possible, that the inertia being demonstrated by this current administration is not just due to incompetence. Well, it is, but I'm thinking part of that incompetence is foreign governments in possession of American secrets.

Funny how that works. Republican administrations don't prosecute prior Democrat administration officials for actual criminal behavior, because Democrats threaten to prosecute Republican administration officials for *non-criminal* behavior.

Of course, this where we get back to, "if we had a functioning opposition party..."

201 Another thing...

No one in DC is going to go after her too hard on this one.

Because they all illegally conduct government business (at least the shadier stuff) on private emails.

Guaranteed if someone was able to subpoena all email addresses of everyone in DC, they'd find that every single one of them has at least one (actually) private email address, at least one "private" email address (for sketchy stuff), then a public email address that they only use for the mundane day to day stuff.

So no one can throw too many rocks from their glass houses on this one just in case they get caught at some point in the future.

If you adapt it to use in a different context, the meaning would be adjusted similarly, so "a pret-a-porter thought" would probably be "a ready-made thought".

Joe Biden thinks of Neil Kinnocks speeches as "pret-a-porter speeches", for example.

275 It's probably not even accurate.

Her lawyers assume that once deleted the data is gone forever from her server, and that is probably wrong.

Here's the thing, she used several different backup services. Including Google. Google has a bit of a crazy idea about what's yours is theirs after it's "abandoned".

They define abandoned as six months old. So all your emails on gmail that are more than six months old, they mine them for data unabashedly.

That's their gmail service. I have no idea what sneaky definitions they use to claim your old backups are theirs, but I bet they exist. So we should be going after those.

Even if the original disks are gone, drilled through, smashed, melted, and trashed some of the backup services she used probably have data; including from the three month period where Clinton was sending emails in the clear, without encryption.

287 oh, but also, I guarantee that most .gov emails are easily "hacked" as well.

I'm familiar with (civilian at least) government data policies, and while they'd be good enough for most mid sized companies, I have to imagine that Russia and China have intelligence agencies who are at least close to as good as the NSA and know about currently-unknown zero day vulnerabilities (including NSA back doors) in most commercially available software.

not to mention all of the smaller countries out there, and all of the free lancers.

With enough money, you can find someone who will be able to hack in to just about anything.

299 Okay, I watch a lot of television so bear with me but I thought government agencies had specific procedures for handling and destroying classified documents. Googling "u.s. government process for destroying classified material" brings up a number of pages with guidelines for getting rid of classified material -- burning ("burn bags"), shredding (with an approved strip or cross-cut shredder) pulverizing or disintegrating, wet-process pulping, etc. There is a separate list for destroying digital and/or electronic classified material -- shredding removable electronic media, degaussing, hard drive destruction by punching/crushing, et al.

The main purpose is to assure destruction is complete and reconstruction is impossible, and the various government agencies are responsible for destroying the material as well as assuring it is done properly and thoroughly.

Apart from the illegality of retaining classified material on her private server and deciding by herself what to delete, how did Hillary dispose of it? How can we be assured that she followed proper procedure and that it's really gone?

C level executives are often very arrogant about computer infrastructure. They've got to have login access to EVERYTHING, even stuff they have no need to access. I mean it's not that hard to use your phone to surf away from the corporate LAN. Or if you really need, you can set up a VPN host at home, and surf from there.

Backup Exec and some of the legacy software still break your data in to packets for tapes, which is why you cannot recover live virtual sessions from them.

But most modern software just write everything, as is, to a disk. Usually a SAN, not a NAS (unless its a small company, I guess). And usually one archiver on site, one off site (for DR purposes) is considered best practices.

But I've heard stories about the old days -- tape libraries and silly shit. Then the IT guys would store the tapes off site. And by off site they meant in their basements.

Then Iron Mountain came along... then VM's... then storage got cheaper.... but the fed gov is still stuck in the early 90s when it comes to IT. I guess any bureaucracy that size would be. What a headache to migrate everything!

But the Clintons know where all the bodies are buried, so whoever is behind this (ValJar, Obama, Soros, or whoever) doesn't want that to happen.

Because when that happens, those people will turn State's Evidence faster than you can say "boo," and then Clinton goes down harder than when she's with Huma.

334 The prime rule of network security - particularly if you're a high-profile target and there are few higher than the Secretary of State of the USA - is that unless you have a known and documented configuration that is tested regularly you must assume you have no security.

So, we assume that someone was reading her email and the question then becomes who did so and what did they do with it.

As I said in earlier comments, Putin's actions would be much more easily understood if he were in possession of private US administration communication opposing countermeasures.

Even worse is the prospect that the Norks or the Chinese - oh so good at the long game - or less likely Iran - found a pile of material that'd render her resignation or impeachment necessary should she be elected President, and are sitting on this for future use (you can spell that 'blackmail') in the event that she might be elected President.

It's not even beyond consideration that such information would be quite useful to the French or the Israelis or other nominally friendly states whose interests do not always align with those of the US administration.

Now I'll take off my tinfoil hat and go bake some samosas on it.

LOL..... I lived though the 'old days'...

When I started with computers... IT was not even a term yet.

I used to solder in individual memory modules...

Some of the equipment I worked on in the Navy, is now in the Smithsonian Institute.... which is pretty damn scary...

Most today use Shadow copy to take a snapshot of the entire server... so its easier to restore the image... or an individual file... from a local copy stored on either a NAS, or some USB device...

But many companies want offsite storage... so you end up with backups of specific databases off site ( mission or business critical information) instead of the entire server...

We normally set up both ( I mainly support Drs. offices, Electronic Medical Record stuff).

If the server was set up as its claimed it was, then yes, most likely ever two-bit intelligence agency in the world was able to hack in to her emails as soon as they found out she had a private domain. Which depending on how important the country is, may have meant post-guccifer.

Most of us could have hacked in to her email at any time if we used one of the widely available hacks on the interwebs. But we're not script kiddies.

So if you put a Picture on the free storage... they do not own it (you can sell it)... but they would have a License to USE it... or even modify it...

392 So conspiracy time... let's say this whole brouhaha is semi-orchestrated by the white house.

We know clintons and obama's hate each other
We think we know that some deal was made for Hillary to drop out and cede the nomination to Obama instead of her fighting it out at the convention or something.
We think we know that said deal probably gets her Obama's endorsement in the primaries.
We damn well know that if that deal existed, there is no way in hell he actually delivers on this.
Based on the knowledge we have of the scofflaws running the show, it's fairly certain that her server contains information that would be incriminating to Obama.

Now... I have said this before, I have no love for the Clinton's or their political machine but I would trade Obama for a third Bill Clinton term in a new york minute. Regardless fo that, Hillary is not as politically gifted as slick willy, it's starting to look like a possibility she might not survive this. All the screaming masses at places like Gawker defending her or saying, hey this is no big deal dont matter. Normal people, not political wonks, look at this presented even in a biased manner and are saying "WTF?"

If in fact their chapter of American politics is coming to an end. What do we think about her trading the server for immunity? I will happily let the Clintons go on their merry way if they destroy Obama on their way out the door. What do you guys think?

Don't think this is a safe assumption.

Despite the "I'm a doddering idiot when it comes to email" pose, its probably not the case that she is.

Presumably, having access to an eight figure rich private foundation ALSO gives her access to actual IT people who know that hitting the "delete" button doesn't actually wipe the drive contents. IE, she didn't put in this server HERSELF. . .she had tech people or a tech company do it, and the ones that did that, and maintained it would also know the above.

IE, if she's going or (more likely) has already gone through all these emails, she may have simply archived the ones she wanted to keep onto a separate hard drive, then physically destroyed the original one.

Had the same thought, but the analysis is kind of like a matrushka doll.

Imagine the reasoning in hostile capital X: "It's easy to hack the server. Too easy. Hmmm. Suspicious. Maybe they want us to hack the server, to feed us disinformation. But you'd think that they'd make it somewhat harder, to make it plausible that they were trying to keep this secret, but we defeated their security. But then, maybe they figured that we'd figure that that's what they'd do, so they figured that they'd act like totally incompetent fools, because no intelligence service would ever do something this stupid, even as a ploy, and so by being this stupid they'd be signaling that the intelligence services were not involved. "

Guaranteed if someone was able to subpoena all email addresses of everyone in DC, they'd find that every single one of them has at least one (actually) private email address, at least one "private" email address (for sketchy stuff), then a public email address that they only use for the mundane day to day stuff.
****
Contrary to popular belief, not everyone in DC is doing shady stuff. And if they are, many of them are hopefully smart enough to use something more secure than email!!! Most people are probably more likely to use the work email for personal stuff than vice versa.

There is nothing shady about having personal email, but having your own server and using NO work email address at all is next level shady. Most people couldn't get away with that anyway because theirIT dept/bosseswould never allow it. Most especially with anything classified or that needed encryption.

The only reason she got away with this is because she's a clinton and a democrat.

419 Presumably, having access to an eight figure rich private foundation ALSO gives her access to actual IT people who know that hitting the "delete" button doesn't actually wipe the drive contents.

431 >>Somewhere, deep underground in some sub-basement, ALL of Hildebeast's emails lie hidden.......waiting.

Well, by definition, every email she sent had a recipient, and they may have copies. IE, Hilary can't easily delete emails on OTHER PEOPLE's computers (let alone on the computers of foreign officials). Or at least backup copies might exist on their equipment. But archiving all of them would be effectively impossible for any third party investigator.

Incrimination is usually a two way street. . .IE the individuals receiving incriminating emails probably wouldn't want them released either.

The NSA may well have all of these. . .but it won't release them.

In terms of criminal prosecution here, that's not going to happen. Obama isn't going to prosecute his own ex-SecState especially after she's out of office, especially because he had to know about this, and especially because she's the Dem's best (however thin) chance of retaining the White House.

If she wins election, HRC, obviously, isn't going to prosecute herself. And no GOP administration would prosecutor her, because no matter how well-deserved that type of prosecution would be portrayed as a partisan witchhunt.

So basically the only thing HRC has to do is get this issue off the TV screens until after the election. After that, she's scott-free.

452 @450

True. Refer to comment #111.

BTW, having worked with classified info, myself, just taking that stuff out of a secure location without explicit permission is a big NO-NO, whether you show it to anybody or not. Classified info has to be CONTROLLED at all times. The higher the classification, the bigger a deal it is.

ALSO BTW, come to think of it, this might be a good time to remark on the lunacy of electing people who would never be able to get a security clearance to high office (speaking to Obama's drug use and associations with a known Communist and at least one convicted felon, not to mention the couple who were on the FBI's most wanted list for being terrorists).

453 @448 "Oh, and even though the premise exists that the there's mutual hate between the Clinton's and the Ogumbies, I'm still not convinced that they're willing to destroy the progressive movement over it."

BUT!!!!

You have failed to recognize that with Obama, narcissism comes first - even before socialism - and that Obama reportedly doesn't consider Killary to be a committed enough socialist to carry the ball for him. Obama is too self-centered to care about a movement that he isn't the focus of. Just look at how he sacrificed both the House, then the Senate, to have his way. He did little to help the party.

Posted by: Optimizer at March 12, 2015 04:31 PM (/q6+P)

454 Actually, classified data is only allowed on approved systems. I think it inconceivable that Clintons mail server was approved in any way, shape, or form, nor any of the devices accessing it.

If any classified information hit the server she'd be obligated to inform the relevant security group, who would cooperate in the cleanup. It's absurd to think that any security guy would approve the continued use of the server after seeing it in action. A FOIA request might or might not reveal if there was a spillage of classified data on the server.

Posted by: Ernst Blofeld at March 12, 2015 04:53 PM (XZWie)

455 Hillary will answer that yes she signed the document, but that her only retained copy was destroyed in a gardening fire and the one and only State Dept copy went down in flames in a tragic blimp accident, so there is no copy of her signed OF-109 extant.

Posted by: MikeD at March 12, 2015 04:58 PM (uKJIC)

456 "She of course is not allowed to keep that information. Only the government and its currently serving operatives are permitted to possess classified information."

But she is equally prohibited from DESTROYING the information. Once classified material of any sort makes its way onto a system, it requires special handling and only a an appropriate classification authority is allowed to approve its destruction and put it through the process to properly destroy it.

And furthermore, just hitting "delete" doesn't ensure destruction. That's nowhere near sufficient for classified (or even sensitive but unclassified) info. The hard drive needs to go through a long, intensive wipe process where ever sector is overwritten multiple times to remove magnetic traces. Or better yet, dumped in a shredder.
