Another Day, Another GOP Sellout

Executive amnesty supporting Loretta Lynch will get a floor vote to be Attorney General thanks to the GOP.

By a vote of 12 to 8, the committee approved the nomination of Lynch, the U.S. attorney for the Eastern District of New York, as the first African-American woman to take the reins of the Justice Department. Attorney General Eric H. Holder Jr. announced in September that he would step down as soon as the Senate approved a new nominee.

Sens. Orrin G. hosta (R-Utah), Lindsey Graham (R-S.C.) and Jeff Flake (R-Ariz.) voted with the committee’s nine Democrats to approve Lynch’s nomination. Several Republicans on the committee, including Sen. Jeff Sessions (R-Ala.) and Sen. John Cornyn (Tex.), said they would oppose the nomination because of President Obama’s executive action on immigration.

I think Tom Tills (R-NC) didn't vote. Not sure if he was stuck in the snow or was simply ducking. Either way, she could and should have been defeated in committee.

Well, the GOP majority can simply refuse to bring her to the floor for a vote, right? Yes, McConnell could do that but he's already said he will bring her nomination to the floor.

So conservatives can filibuster her and force Democrats to find 60 votes, right? Nope. Reid eliminated that last year and even though he complained about how horrible it was, McConnell didn't put it back in place. Why, it's almost as if he didn't want conservatives to be able to cause him any headaches. Almost.

Clearly there are enough sellout Republicans willing to snuggle up to Obama to get her through.

Quick question, other than getting Keystone to Obama for a veto, what difference has the GOP majority in the Senate made so far?

I don't know if he ducked the vote. US Airways shut down CLT last night at 9:00PM, he may still be in Huntersville, which got a whopping four inches of snow.
A freshman doesn't need to take a useless vote if he doesn't need to. His vote would not have mattered, since Leslie and Orran and Jeff had already sold out.

It IS called politics.

----

Here are three.

1. They simply do not care about the same things you care about despite campaigning on them.

2. They are not necessarily looking to stop Obama or enact conservative results - they are mainly trying to get more control. They think that by taking measures Drew and others want (including me), they will lose votes and thus lose control. (I do not agree with them on that, but I think it is part of their calculus).

3. Life is typically easier when you go along to get along.

Hillary is old and ugly, and not attractive to anyone under a certain age... so it is indeed unlikely she will secure the nomination. If she is nominated however, the same idiots who always vote for Democrats will vote for her. Maybe not as many of them as voted for the Scoamf, but if she's up against Jeb, which she probably would be, she's got a good enough shot at winning that she could very easily be elected.

The tougher hurdle is the nomination.

129 Back to wiping out ISIS. There is a contrast between Vietnam and Iraq. There were jungles in Vietnam and the soil was amenable to tunneling - so the enemy could hide. There aren't any jungles in Iraq and you can't tunnel in cufking sand. In order to be militarily relevant ISIS has to cluster in the open. Add to that the fact that we have far better surveillance capabilities today than in Vietnam.

Question: what happened to the Iraqi Republican Guard at the start of the Iraq war? Answer: The B-52s reduced them to very small individual body parts during the News blackout period; there weren't even any platoon sized units left. So much for the administration's absurd lies that the Air Force can't do anything about ISIS.

158 I support the filibuster for SCOTUS and cabinet-level appointments and legislation - just not for lower level (e.g. lower judges). These nominations are a big reason why I haven't jumped on board the "nuclear option because now we can" bandwagon.

Those of us in the dissident majority with minority representation need to keep in mind that "now we can" doesn't mean "us-we can," it means "Team GOP-we can." Dissident conservatives should keep in mind that we are the smallest minority in Congress - vanishingly so in that we mustered all of 2 Senate votes against Vichy Mitch's tail-tuck yesterday. Anything that strengthens majority/leadership control is poison to us. Choose accordingly.

On top of it all, we were surprisingly easy on Lynch regarding the multiple admonishments DOJ has received lately, even from the uber-leftiest head of the uber-leftiest Ninth Circuit. A recently resigned DOJ attorney said that the Justice Department was being run like a plaintiff's law firm, sizing up targets for shakedown settlements. Worse, it's well known for suborning perjury, burying evidence and scoffing at court orders.

They could have forced Obama to appoint a caretaker to DOJ and at least pulled the fangs of that particular runaway beast going into 2016. Instead, we get Eric Holder with bosoms.

They have done nothing. They will do nothing. We've had a Know-Nothing party before. Now we have a party saying "No, Nothing" to their own voters on every major issue. Priceless. TYS.

179 "Net Neutrality also seems designed to drive small ISPs out of business."

Just as a ton of the "public interest" legislation of the New Deal actually somehow ended up entrenching the hold of big businesses over the economy, and discouraging new competitive entrants.

Almost as though it had been designed and intended to so do. Hmmm.

Mitch is basically an "FDR Republican" at heart, and so are most of the Senate GOP. So, it's unsurprising that they aren't pushing back against this radical expansion of the FCC's authority, the FCC itself being a New Deal creation which cemented the hold of politically pliable big broadcasters.

I'm a young man. I really, really, really, didn't want to be able to tell my children (when I have them), that I was there to watch America decline into a sihtpit under the auspices of the SCOAMT/SCOAMF and the GOPe. Just....dang, just dang.

It's time to admit it.We failed our FoundingFathers,in the long run. They built a great system with a number of safeguards, but even they couldn't protect against the kind of ignorant internal tampering that destroyed it.

"A republic, if you can keep it", then it slowly became a representative democracy as more and more of the indirect election methods, methods that were supposed to be implemented by wise statesmen, were stripped away and turned into popular vote items.

Then wegot FDR and the Supreme Court after he scared it into compliance, and that was really where the fatal wound was dealt to the nation. It's just taken us a long time to succumb.

At work, and feelingmuch more sad than angry.Even AllenG's rant cannot move me.

We had a good run of it, though. A real good run.

184 First, you ban bullets that do not fragment on impact because you can label them 'armor piercing'. "Armor" does not mean the stuff that the M1 Abrams is wrapped in, nor the stuff the Mine Resistant truck is wrapped in. No, 'armor' for this Presidential Edict is the kevlar shirt law enforcement wear under their uniforms.

When the regulation goes into effect, caliber will not be specified. It will be all bullets that do not fragment.

So what, you ask.

So the next step, and there is always a next step is banning bullets that fragment on impact, because they are 'inhumane' and the wounds they cause are terrible wounds, and because these 'hollow point' bullets are a violation of the Geneva Convention.

There are only two types of bullets; those that break up on impact, and those that do not. These two rules will ban all bullets, in two steps, by Presidential edict.

Obama is still President, and will continue to be President until at least January 20th, 2017.

185 The Hat is right.

And I *love* the analogy to the Enabling Acts (blank slate authority given to Hitler as temporary, emergency measures ..... which, um, turned out a bit differently than some anticipated). Sure, it's over the top, a bit, and technically speaking.

But you know what? In proper context - that is, the American historical context - that analogy is spot-on, not outlandish at all.

Lawlessness now defines most of our system. Co-equal branches? Nope. Imperial presidency (like nothing seen since the Civil War, which was, um, a CIVIL WAR, which tends to bring out extreme measures). Judiciary completely unhinged from its constitutional channel, legislating wildly and arrogantly (and about as intelligently as you'd expect for a branch not intended for this role). Congress? Essentially dealt itself out of the system.

I've harped on it before, but the thing about recess appointments, where the Senate eventually won its lawsuit, was stunning and revealing. At no prior time in US history would the president's party have tolerated such poaching on Senate prerogatives. Which is why such a thing would not even be attempted, not pressed seriously.

But Senate Dems just sat there, silent, while one of their institutions' main powers was diluted by bold presidential over-reach.

Seems like some geeky, obscure thing to most, perhaps. To me, it is/was a chilling, astonishing development. The glue that made our system work has fallen apart. We are now more or less ruled, there is not representative, lawful government.

(ii) a full jacketed projectile larger than .22 caliber designed and intended for use in a handgun and whose jacket has a weight of more than 25 percent of the total weight of the projectile."

What was intended by the Founding Fathers, was for Congress to pass laws, with the executive limited to doing A, B, and C.

Now, we executive agencies (some independent of even the President) who are given power to do anything except X, Y, or Z -- with the X, Y, or Z so vaguely written that the agency can even do that unless the courts slap them down, and then usually only for a single instance with no other repercussions.

What I found most chilling and astonishing wasn't so much the sea change in internal governmental processes, but in the actual campaigning for office.

That Obama's finance team deliberately shut off the safeguards meant to keep foreign money from coming into their coffers via credit card donations over the Web in 2008? Provably resulting in many 100% illegal contributions, with more such illegality no doubt having gone undetected? And that the Republicans collectively emitted not so much as the smallest peep of protest about this practice?

Yeah, that was "chilling and astonishing". But it got worse.

Because after having gotten away with it in '08, Team Obama proceeded to do THE SAME DAMN THING ALL OVER AGAIN in 2012. And the Republicans again collectively emitted not so much as the smallest peep of protest.

That goes beyond "chilling and astonishing" to the level of, holy cow, the Republic really did die quietly in its sleep a few decades ago, and now what we've got is a very elaborate exercise in pro-wrestling keyfabe to keep the rubes quiet.

But considering that Congress has already ceded its primary purpose - to legislate - it is not hard to see it cede all other purposes and powers.

298 I really don't know why any of you are surprised. Any nominee Obama puts up will be just as odious ideologically as Loretta Lynch, and with arguably less qualified to do the actual job of being the chief prosecutor and running the department.

The last thing the Republican leadership wants is to have the focus of the public on a nomination to an office most people who aren't criminals have no interest in thinking about. Let alone have that focus be all about how the Republicans "hate" a black woman.

Having the expectation that leadership will do silly, counter-productive things just to salve the emotional needs of people like Drew and some of the commenters here, and then being righteously indignant when they refuse to do those silly, counter-productive things, is just plain dumb.

She will most likely be confirmed with all Dems voting yes and enough Republicans voting yes to get her over the line. All the no votes that need to be no votes for back-home electoral purposes will be there, and that's about it.

All of which could have been easily predicted the moment the nomination was announced. Because nobody is going to not vote Republican in 2016 because of how an individual senator voted on this nomination, and everybody with a brain knows that.

313 Some of the real goals of the FCC ambush takeover of the internet (they gave no warning they were gonna do this).

1) Drive small ISPs out of business. Fascism and corporatism prefer a small # of big companies to control. All the little ISPs have got to go.

Massive new regulations drive up costs - especially for little guys. Big guys can absorb it easier.

2) Taxes. Title II explicitly opens broadband to taxes. Right now FCC won't apply the taxes, but they just granted themselves authority to do so at any point in the future. As ppl drop landlines, tax revenue goes down, FCC wants that tax money

3) Trial lawyer giveaway. These new regulations open up broadband providers to more class action lawsuits from trial lawyers.

4) Municipal broadband. Left has some fantasy about dirty hippies stringing fiber and running municipal co-op broadband. Yay, Government Internet.

Obviously anyone can call himself "Tea Party" because for all practical purposes, there really is no such thing. Hell, Roy Blunt could call himself Tea Party if he wants.

The fact is though, Rapin Akin was NOT a Tea Party candidate in 2012. He was a sitting Congressman, and had ALWAYS been part of the sometimes looney "religious right." 330 C'mon guys, all this proves is how badly we need everyone's support to take back this White House in 2016.
We can't help the way the rules of the Senate are set up, and we can't just change the rules for short term gains. You know how that would look to the press?
No, my friends, this is a long game, and we need to stand resolute with the GOP to turn back this agenda and bring freedom and prosperity back to this great nation.
Now's not the time for acrimony in the party, or for foolish charges up unwinnable hills. Now is the time to make your voice heard by donating what you can to the RNCC, so we can protect our slim majority in the senate and win the
White House in 2016. Then we all will be in the right position to reclaim the American Dream.

348 As an additional point, I watched the hearings particularly interested in the vaunted debate and questioning skills of Sen. Cruz. Frankly, she owned him; and she owned him in a particular way that is a window into why he isn't going to be the 2016 nominee, if he even runs at all.

She stuck doggedly, although pleasantly professionally, to her talking points regardless of how many ways he asked her the same questions. She had about 4-5 different ways of deflecting his inquires, all of which in the end amounted to "FYNQ." Every one with a smile and lots of reasonable-sounding phrasing. He was reduced to complaining about her non-answers instead of getting the sound-bite he was obviously fishing for.

Hmmm. That dynamic sounds very familiar, doesn't it? Ted Cruz was acting out the Scott Walker vs. the MSM action from this past week. Here's a hint: Cruz wasn't in the Scott Walker role.

If Cruz couldn't get a simple career US Attorney to bite on his shit, how can any of his supporters expect someone like the actual Scott Walker to bite on it during a primary debate?

I wonder what else it could possible be built on. He has no actual record of leadership in the Senate beyond running his mouth. Same as Obama in 2006 and 2007. Obviously, that isn't an impediment to winning pace Obama, but the field is a lot stronger than the Democrat field was for Obama in 2007-08.

I say the same thing about Paul and Rubio. None of these possible first-term senators has any actual substantive record to offer primary voters. Bush and Walker both have actual governing records, Walker's obviously more recent and more conservative, and thus far more appealing. Plus he isn't named "Bush."

But Cruz, particularly, is lionized as some kind of conservative savior. He hasn't actually done jack shit beyond talk. He impotence in the hearings for Lynch are merely an example of his lack of concrete accomplishment in the Senate.

Cruz isn't a substitute for the larger argument - beat on him all you like, the GOP won't smell one bit better.

Posted by: SocietyIs2Blame at February 26, 2015 01:27 PM (QKIQb)

378 JJStone, chemjeff, others - solution? Solution?

Kind of obvious. GOP should use its position - aggressively, ruthlessly - to block every single thing this lawless admin. tries to do. Including doing a little vandalism and making an example of an AG nominee, forcing them to make do with a place-holder (if you don't understand how off the rails the DOJ is, look into it - forcing a place-holder on them might only hamper them a bit, but it's long past time for "throw everything you have at them").

Oh - and on the little matter of DHS appropriations. Every GOP incumbent should be framing the issue clearly - the Dems want to hold national security hostage to ensure that lawless presidential behavior results in mass amnesty.

The substance and politics of all these big issues line up perfectly for the opposition party. Cannot remember when the alignment was so pristine. These are gigantic clubs the GOP should be using to beat the Dems (and the press) with, mercilessly. Pathetic little Jeb Bush actually provides a ridiculously easy target to use, as well. Beat up on a GOP headliner whose views/statements on illegal immigration are kookier than anything Lyndon Larouche ever said - and just as politically unpopular.

The opportunities and tools for torturing and defeating the administration - and simultaneously greatly strengthening the GOP's positioning for 2016 - are obvious and abundant. Not everyone without Beltway experience will see this as easily, but a first step is to shed tribalistic party loyalty and think about outcomes.

384 "Is there any new party out there at a local level? How can it go national?'

Lots of little proto-parties, lots of talk and dissatisfaction. I'd prefer it start local, frankly, or state level at most. My Holy Grail would be one House seat on the "national" level.

One of the many "hardest" parts is to keep the message simple and on point, avoiding hijacking. The Tea Parties got mixed and muddled with social conservatism. I'm not anti-so-con myself, but the original fi-con only, issue oriented idea was the most viable and it was the idea animating the grassroots early on. Ideas I like are no deficits/balanced budgets to start, rule of law, and construing government as a last-resort, strictly delimited powers necessary evil in general. Stay away from social issues, particularly abortion and marriage (FWIW, I'm pro-life/state issue, anti-gay marriage personally).

Then getting on the ballot, getting funding, and the other whorishly hard hurdles start. It's a decades-long project, but UKIP shows there's hope for it in an Anglo democracy.

And the alternative is the long night, sooner or later. Course correction in the present system simply won't happen.

Posted by: SocietyIs2Blame at February 26, 2015 01:34 PM (QKIQb)

385 If what you want is a politician to vote the way you want in exchange for your vote, you will inevitably be disappointed, unless you run, yourself.

All a politician owes you is his best judgement on any given issue. He isn't your cipher, he isn't your doppleganger, he isn't your factotum, or errand-boy. He is your representative and that necessarily means that he is going to "represent" you in the way that he thinks best.

You are free to vote against him just as you are free to hire another lawyer or go to a different doctor if you feel they aren't "representing" you and your concerns the way you like. But, that's it. No more and no less than that.

And if you are smart, you'll be careful about how often you want to switch representatives, just as you'll be careful about firing your attorney or your doctor on the whim of the moment, as well.

The party has to do with things on any given issue as they are, and as they could be made to be, not according to some fantasy, wish-fulfillment universe that doesn't exist. In that context, Loretta Lynch's nomination getting to the Senate floor isn't a surprise, nor will it be a surprise should she be ultimately confirmed.

I understand where you're coming from and have no doubt the worst Bolshies out there would Paulbot and blackhat any process they were involved in, but if the other members of the social contract want Europe that badly, they're going to get it. We're just hoping that Prog support rests more on distortion and deflection than outright "give us free shit because we outnumber you." If we're already Greece, Article V will just be a footnote to an already done nation.

389 Seems to be no lack of folks advising me to not believe my lying eyes ... and that the GOPe is still my last, best hope.

Well boys, have at your political solution. Who knows ? Maybe they'll come for you last.

Me ? I know a take-over when I see one.

390 "The party has to do with things on any given issue as they are, and as
they could be made to be, not according to some fantasy,
wish-fulfillment universe that doesn't exist."

Check the GOP track record since Reagan. Since 1994. Since 2000. Since 2010. They're selling you awfully short on what's possible and what's a fantasy. It's a tyranny of reduced expectations. If you choose to buy in, so be it. If enough of us are both sufficiently hopeful and sufficiently realistic to make something better happen, you'll benefit. If not, we're all fucked anyway.

392 "just as you'll be careful about firing your
attorney or your doctor on the whim of the moment, as well."

I've given clients much the same speech. But let's be real here - if my doctor had a track record like Team GOP, I'd be dead. If my lawyer did, I'd be in jail or bankrupt.

A growing dissatisfaction that started with HW Bush is hardly "the whim of the moment." I've stayed faithful despite the fact that all I have to show for it since the Cold War is moderately effective welfare reform (now abandoned) and the minor Bush tax cuts. And a shitload of broken promises and busted hopes.

Not exactly a spur of the moment decision on my part.

393 People underestimate how long society can put up with tyranny.

If the game plan is purposely make things go from bad to worse in order to cause a revolution, I could easy see my future grand kids living under a Chavez type government.

I still think it's a whole lot easier (and safer) to shift the current GOP and start knocking them off than start something from the ground up. Especially since nobody would be able to build a consensus on what the new Party looks like.

The Whigs were cast off over a single issue: slavery, and the GOP was born. You don't have such a consensus on what exactly modern conservatism is. You have the SoCon, the FiCons, NeoConservatives, Chamber of Commerce type, etc.

Let's just say I'm not convinced by the "Let's overthrow the Czar; what's the worst that can happen?" line of argument.

395 One of the many "hardest" parts is to keep the message simple and on
point, avoiding hijacking. The Tea Parties got mixed and muddled with
social conservatism.

Yes, it unfortunately did get hijacked by the crazies. I was also excited by the Tea Party movement, but in a few months it basically became a place for Christine O'Donnell types.

Bingo.

Especially when there's alternatives.

And also, I know the popular meme is that the GOP is not really a conservative political party, but it has shifted dramatically to the Right over my lifetime. Most Republicans were like Olympia Snowe in the 1980's. Even Reagan was afraid of welfare reform.

We can shift it into the right direction, it just takes time.
