BATFE's Interesting Definition of "Redesign"

Over the last few weeks, there has been a lot of discussion about whether using a SIG brace on an AR pistol as a stock magically turned the AR pistol into a short-barrelled rifle ("SBR") (i.e., making it illegal to own unless registered under the National Firearms Act of 1934 ("NFA")).

First, it looked like BATFE said, "no problem". Then, it looked like they said "wait, we really meant 'no, you can't do that'". Then it looked like maybe they were being misinterpreted. Now it looks like they really said "yes, we were serious about that".

This is relatively hard to follow, but I'll try to summarize it for you. First, the basic issue is the the NFA requires rifles with barrels shorter than 16 inches to be registered as SBRs along with payment of a $200 transfer tax. It is, however, obviously legal to own a handgun with a barrel shorter than 16 inches.

So the enterprising folks at SIG designed and marketed an AR pistol that features a brace to help support this obviously ungainly handgun.

Since SIG is a commercial manufacturer, they sought and received clearance from BATFE to sell the AR pistol as a pistol and not an SBR. And this is where it should have ended.

Instead, though, people asked BATFE what would happen if you shouldered the AR pistol using the brace as a stock. Could it possibly turn it into an SBR? (thereby telegraphing their intent to build a *wink* "AR pistol" *wink* when they really intended to build an SBR).

Which ... ummm ... look at that SIG in the link. We got a favorable ruling from BATFE saying that thing isn't an SBR when it looks, acts, walks, talks, shoots like exactly one. The next step in the regulatory process is to STFU, not beg the regulator to use tortured logic to reach an adverse conclusion.

Yet here we are. Upon request, BATFE has now reached the nonsensical conclusion that an AR pistol can be "redesigned" on the fly by the user's act of shouldering it. By that logic, an 18 year-old who buys an AR and then shoots it with one hand has "redesigned" it into a pistol, which he can't legally buy until he's 21.

Great. Just great.

Oh, also ... this provision of the NFA is exceptionally stupid and should be repealed.

In Related BATFE News ...

Making your own AR from an 80% lower receiver took a big hit a couple of weeks ago when BATFE ruled that a person couldn't rent equipment at a machine shop to mill and drill the remaining 20% without said machine ship registering as a firearms manufacturer.

This ruling is even more convoluted than the SIG brace one (if that's logically possible) ...

Riddle me this one Batman... If a "receiver" is a "weapon" then it must have an individual part of itself that is a "receiver", which would be classified separately from it as a "firearm"... So where exactly is it that I can buy this mysterious "receiver, of a receiver, of a receiver, of a receiver" that you refer to?

I'm in the market for a new AR. It's complicated since I live in MA and, unlike the federal "assault weapons" ban, theirs didn't sunset. Fortunately some good manufacturers make MA-compliant rifles, and I'm pretty much settled on LaRue Tactical. But if you have any other recommendations, please put me some f'n knowledge in the comments.

6 Since I had a 1911 and a bunch of leftover AR-15 parts, I thought a Mech Tech carbine upper might be fun. I painted the barrel and added a forward rail for a front sight and a buffer tube stock. She's a heavy bitch, though - about seven pounds. Should soak up the .45 ACP recoil nicely, though.

When I carried a 1911, I really liked the Don Hume IWB holster with thumb-break. Added another layer of security by the thumb break tab crossing between the cocked hammer and the firing pin. Assuming you carry in Condition One, which I would hope.

20 Hello naughty little freaks. Quick question. Got mini-me an AR-15 chambered in 22. About 10% of her rounds show the rim taking the strike (little notch?) but failing to fire/eject. Good news, she's gotten very good at clearing the chamber and staying on target. Using Federal hi-speed ammo as S&W recommends n had armorer checkout rifle after purchase and before using. What are we doing wrong?

22 Oh, yeah - Yay, gun thread!

I've always loved the looks of the XM-177 (Colt Commando). I had a leftover 16" barrel, so I mated it to an A1/C7 receiver with a teardrop forward assist. Then I drilled out a motor shaft ring and permanently attached it to the barrel to simulate the grenade ring on later moderators (that's the name of the extended flash hider on the pictured model - it not only reduced the flash but slightly reduced the noise as well.)

Next I installed a slip-over fake moderator that ends about an inch from the "grenade ring". It fits over the barrel so it looks like a short barrel with a long moderator, but it's actually a full 16" underneath it.

The next step will be to use flat black caliper paint to paint the ring, faux moderator and the exposed barrel between them to give them the illusion of one complete unit. Then it goes on a lower with a CAR buttstock and A1 pistol grip.

It's not even close to a "copy" (for one thing, the upper should be a flatside without the FA and shell deflector), but it will capture much of the salty look.

AR-15 building is addictive.

I actually have a grandfathered pre-ban AR-15 HBAR that I thought about putting a Daniel Defense upper receiver group on. But there's provision in the law that makes me think even *that* might be illegal, even though the result is no more an "assault rifle" than the original one is.

I've got an 870 Express that I put an 18" barrel and an extended mag tube on (with a bayonet mount, just for the Fuck You Factor). I bought an assortment of small replacement parts from the hardier Police model that I'll install eventually. Basically I liked the convertibility between "tactical" and clay-busting (it came with a 28" ribbed barrel)

Call me a puss, but I'm not crazy about all the "tactical" stuff on pump shotguns. Plain-jane pumps seem to me to be about the ultimate in terms of value and versatility. My old Mossberg Security Combo was really cheap when I bought it in the 80's, and it's never failed to fire. I need to add a light to it, but that's about all I can think of that would actually be an improvement.

No, I was simply worried about the pistol slipping out of the holster, because I'm a very active person. But not really an issue as far as I'm concerned with 1911s...you need intentional muscle movement in 3 directions at once to discharge a cocked and locked 1911 (backstrap safety disengaged by the , manual safety moved to off position, and trigger pull). Just nothing wrong with another layer of security, if it doesn't hinder the function.

I no longer use a 1911, love them and if I had unlimited funds would have a Dan Wesson, but I sold my last one to another Moron. I personally don't like safeties on carry guns, just one more thing to think about under stress when millliseconds matter. So I use decocker pistols now. The 1911 is the only exception, because the ergonomics are just so freakin awesome. Switching the safety off of a 1911 during the drawstroke just happens naturally for me.

Just my .02, worth exactly what you paid for it.

Definitely stamp them "pistol" (if you stamp them at all).

True fact: You can attach a 16" barrel and a stock to a Thompson/Center Contender no problemo.

But attaching a pistol grip and 10" barrel to a T/C Contender Carbine will get you a one-way ticket to Federal PMITA Prison, as will merely attaching a stock to a Super-14 (14" barreled) Contender.

its easy, you can do it much cheaper, you can get better, proven components, youll know more about your rifle, and ultimately it will be YOUR rifle-no other rifle will look like it or be like it at any range you go to...it will be your own little work of art...youll show pictures of it to your friends and family like, well, pictures of your friends and family

i built both of mine, two carbines, one with a mid length gas system, the other is carbine length with rifle length quad rail, both have all magpul furniture, one is all black, the other is flat dark earth and black, and they both turned out absolutely beautiful and run like sewing machines no matter what ammo i use...extremely happy...

56 Also, in regards to the necessity of a thumb-break on an IWB holster, I no longer consider that a requirement. I switched to a Galco horsehide for my current carry, it has no thumb break, and I've never been given reason for concern about it.

But I still use my Don Humes with the TB, too, because they're very nice and the TB doesn't hinder the drawstroke in any way once you acquire the muscle memory for your drawstroke.

That being said, I'm neutral on the thumb-break anymore. Wouldn't matter if my next one had one or not. With a well-placed snap (like on the Don Humes), the TB is a non-factor. I have no problem with extra safety measures that don't impede function. I'm very safety-oriented, and very anal.

58 The problem with the Sig brace was a bunch of retards pushing envelope and asking for written BATF opinions.

The BATF declared Sig braces to not be an SBR part, and AR owners should have left it at that. But some activist shitheels wanted permission to use the wrist brace as an impromptu shoulder stock, which generated this BATF near reversal ( put the brace up to your shoulder, and you have magically created an SBR ).

This is why we can't have nice things.

The manufacturing thing with 80% receivers is consistent with the BATF's enforcement of requiring manufacturers to pay the SOT and register. Just because the retail customer puts sweat equity into making it, doesn't mean that the factory ain't making firearms.

Of course, the proper solution, in my opinion, to all of this is to enforce the second amendment, and start hanging BATF agents, but I guess that makes me a bad person.

He was crazy and dangerous.

I agree with you on the mechanics of the .45. I'm not 'active' in that I'm not running around and jumping or rolling, but I have a leather holster with no break for my 1911. It sets on an angle, inverted over my back pocket. I wear it when I ride the scooter and it's never come loose in the holster, even after a long ride.

If the barrel nut absolutely refuses to index, regardless of how much you reef on the damned thing once you have the upper in the vice+jig, it is ok to shave a few thousandths of an inch off the front face of the upper.

Tape some 400 grit sandpaper flat on your workbench, and vertically drag the face of the upper exactly once across the paper, and try again. If it still won't index, repeat.

I've had my Theis holster with horsehide (though I think it's only available in cow leather for now due to supply issues) for about 18 months, and it's good for carrying a Beretta 96A1, so I bet it'd carry a 1911 just fine. If you need to take the holster off frequently, the two-clip hybrids probably aren't a good choice: I find it a hassle to put the holster back on unless i undo my belt.

Not quite. First of all, federal law only prohibits an 18-20 y.o. from buying a pistol from an FFL. Private purchases from another non-licensee who is a resident of the same state are legal.

Second, there's nothing in the law that says a rifle can't be fired by one hand, or should only be designed to be used with one hand. See 18 USC 921(a)(7):

"The term 'rifle' means a weapon designed or
redesigned, made or remade, and intended to be fired from the shoulder
and designed or redesigned and made or remade to use the energy of an
explosive to fire only a single projectile through a rifled bore for
each single pull of the trigger."

So if someone uses one hand to shoot a rifle, they've done nothing to "redesign" it into a rifle (following the tortured logic in the ATF's SIG brace ruling).

However, let's look at the definition of "handgun" in 18 USC 921(a)(29):

"(29)
The term 'handgun' means -

(A)
a firearm which has a short stock and is designed to be held and fired by the use of a single hand"

Previous ATF rulings about attaching a second pistol grip to a handgun (e.g. a vertical grip to the handgun's dustcover) have said that the presence of a second grip means it's now been "redesigned" to be used with two hands, and is now an AOW. But with the logic used in the SIG brace ruling, it follows that if someone merely uses two hands to shoot a handgun, without physically modifying the gun, then they've "redesigned" the handgun into a AOW.

I think that the military version of your gun of the week was also known as either the CAR-15 or the CARB-15. I had the front end of one on my M-16. I didn't like the collaspsible stock but apprciated the shorter front end because we in the bush most of the time.

I hate it when I come to Texas from my beloved Clownifornia on a business trip, and the only gun show in the DFW area is the SMALL one in Lewisville. One of the things I love about DFW is that there's always a gun show on the weekends.

106 Marlin .45 cleaning. All Marlins are made to be disassembled, unlike the Winchesters. Do not ever take apart a 94. The manual is fairly clear. That being said, I don't bother. I reverse brush it etc. wipe it up. Grease and spray. Etc. never had a problem.

116 Might have been said already, but SIG makes a couple AR type weapons specifically legal in the more restrictive states like MA (and NJ where I live). Highly recommended. And if you happen to be a LE officer, SIG has a very good pricing program.
