Oh, Roger Simon (pjmedia) has a good piece that explains why Petraeus is being prosecuted by Obama's DOJ. The piece doesn't say that, but it explains the why of it, almost accidentally.

45 I've been reading more about what happened in the store. Apparently when the guy came in with his guns blazing (not just trying to pray, huh, strange that) everyone fled to the two storage areas in the basement. Unfortunately one of the freezers wouldn't shut so the people who were hiding in that one had to come back up the stairs since the guy saw them running down and threatened to kill everyone who was still upstairs if they didn't come back up. So that group went up and when they did they saw a gun that the terrorist had placed on the counter and one of the hostages tried to shoot the terrorist.

Unfortunately, the reason it was just laying there was because it was jammed, so when he tried to shoot nothing happened and the terrorist killed him on the spot.

One of the hostages was able to call out to the police and leave his phone on so that the cops could hear what was going on inside.

I heard that question from my parents from time-to-time. Not about nakedness, of course, but usually about something that was broken, or scarred, or missing cookies.

88 Stayed off the web all week because I spent five days as a juror on a rape case. (My first jury service.) This ate up my last week off before graduation in May, which made me unhappy. I thought I had any number of red flags that might have me excluded, but the new system seems to be "fit to serve unless proven otherwise." In voir dire, very few questions looking for trouble.

Trial was mostly boring mechanics of getting all the elements of the ten charges into evidence, despite the fact that most of that information was stipulated, agreed in advance. Defense did not contest any of the facts of the crimes, claiming that the complainants had simply misidentified their man.

The tiny young woman prosecuting was sharp and dramatic, and hearing the word "fuck" out of her mouth in her first paragraph made her case vivid despite all the boring burdens she was checking off. The testifying complainants were certain, clear. precise and believable. (One was 17 at the time of the incident, now an adult). Police were efficient and established two independent lines of identification that corroborated each the other. Forensics scientists presented the DNA cleanly, without exaggeration of its meaning.

The defender seemed to be going through the motions, and there were a lot of loose ends and red herrings in the testimony that might have allowed some doubt to squeeze in. But rebuttal witneses would have undermined the simple claim of misidentification. His entire defense was the wretchedly stupid testimony of the defendant, which was demolished on cross-examination.

When defendant interjected unnecessary and damaging info on cross-examination, the prosecutor raised an eyebrow to the jury, poised to let those words sink in, and sat down. Defender's redirect was garbage, closing statements were short and dramatic.

The judge's instructions were sloppy and meandering, raising pointless arguments in deliberations and three trips back to the courtroom to resolve questions. (Yes, different phrasings of a weapons charge were essentially a typo for two identical crimes. Yes, "instrument of a crime" would include a gun, a toy gun or any prop brandished as the perp threatened to shoot. Yes, whatever that third quibble we were having was not material.) The confusions stretched deliberation to a second day.

We convicted him of rape, robberies and all collateral charges. Our jury foreperson cried as she read the verdicts.

Over lunch, after the verdict, we learned defendant had a history of other violent offenses (inadmissible in trial), and was convicted (by judge) of two aggravated offenses that our jury did not hear. This case would earn additional time for violation of earlier paroles.

Defendant had rejected a plea offer of 20-50 years when he elected to stand trial. Barring some surprise in the pre-sentencing investigation, would expect to serve more time than that offer. There were no refused defense requests and no denied objections that could constitute obvious grounds for appeal, though anything might happen in the tornado of the Commonwealth's legal system.

So that was my week. I figured I'd share my diary with my fellow Morons.
