Random House: When Lena Dunham Called Barry "Barry," She Meant It As an Alias, Even Though She Didn't Say So

Apologies for "the confusion."

It should be noted that when Dunham referred to an ex-boyfriend earlier in the book, she specifically stated that she would be using a pseudonym to refer to him.

She did not provide any such statement with regard to "Barry."

Random House is offering to pay for any legal expenses Barry might have incurred in hiring his lawyer in this matter.

Nolte sums up some key points:

5. We know for a fact that nearly six weeks ago, Dunham herself was aware of the agony her memoir caused Barry One. And yet, rather than exonerate an innocent man she knew was twisting in the wind, she attacked the National Review author who told Barry's story.

6. How did Lena Dunham choose the name Barry? Moreover, no less than five descriptors in Dunham's memoir led who-knows-how-many people to believe Barry One was her rapist: 1) Barry One attended Oberlin at the same time Dunham did. 2) Barry One shares the same first name -- a very uncommon name. 3) Barry One was a campus Republican. 4) Barry One was a prominent campus Republican. 5) Barry One worked at one of the Oberlin campus libraries.

The details anyone could easily Google led right to Barry One.

I think Lena is going to be sued, and I think she's going to have to pay a large settlement.

The very weird thing (conspiracy?) about the Dunham story is that "Barry" was a conservative on campus. Someone exactly like that existed, it's just the details were off.

Purposely implicating him and thinking she could get away with it? Meaning someone did the research to find "that guy?"

This is creepy. So very creepy. "Barry" is not a common name. And certainly matching up "Barry" with belonging to a Republican or Conservative campus organization cannot be chance.

Well his name is already being whispered on some lefty websites as THE rapist so about the only way for him to rebut the charges in a public way is to sue. Which of course puts his name even further into public view but at least he gets to tell his story and deny the accusations.

Given the trend these days of throwing rape charges around without ever going through the legal process, filing a libel suit is pretty much the way that an accusee can defend himself in public.

Ventura claimed that Kyle's book idenitfying him ( anonymously, but then later, Kyle identified Ventura as the celebrity) defamed him by saying he was punched out by Kyle in a bar, attributed comments to Ventura he denies saying, and Ventura contends the episode never happened.

A judge awarded Ventura $1.4 M from Kyle's estate which I understand was actually paid by the insurance company for the book's publishing house. It was later upheld on appeal and Kyle's widow was not granted a new trial.

In this case, no one actually knows for certain what happened. There are no actually corroborating witnesses for or against , the jury(in Minnesota, no less) had to choose who to believe.

Moral of the story? Don't think for a minute that a lying celebrity(exhibit A, Jesse Ventura) won't prevail in a courtroom full of jurors who are star struck. A lawsuit can go either way.

After being apolitical throughout the season, the last two episodes featured Bush-bashing (GHWB), Republicans are the Party of the Rich, and the main protagonist ditches a National Academic honors trip so she can run away and follow the Grateful Dead. You can do your thing, and I can say "You're a disgusting fuckup," and you can't make me do your thing, and I can't make you do mine, and you can say "Straight sex is terrible" and we can do and say all these things in a free society and not stop the other from doing them. But it becomes unfree and biased when one can stop the other from doing or saying their side of things, by law or coercion. "So the pendulum swings the other way" - no, past injustice does not qualify new injustice.

So the hate you perceive is not irrational hate but a resistance to the muzzle that says you can shut me up but I can't shut you up even though both of our positions are nothing more than relative constructs based on our respective moral contexts.

This will stop when 1) people of minority sexual status stop seeking special protections and tax dollars, and 2) when people of minority sexual status start policing their own by exiling the shamers (ChikFilA and Mozilla picketers), the criminals (Terry Bean), and their enablers.

But much like Islamists, they're not going to do it. The deck is so grossly stacked in their favor - they're weapons free while the opposition is limited under fatally oppressive ROEs, they have no accountability while small blunders by the opposition destroy careers and lives, they have the favor of the media while their opposition is blasted at every turn - they have so much to gain and so little possibility of loss, they'd be fools to position themselves for an armistice. They're going to ride this out to the bitter end and severely alienate a meaningful portion of the world in the process.

Actually, the argument I saw is simpler than that: rape is a criminal offense. Documents pertaining to a criminal offense are public record. Ergo there should be no *special privilege* for someone accusing someone else of rape to remain anonymous.

And I don't have an argument against that- not one that doesn't boil down to, "but that's mean," which is not a good basis for a judicial system.

I hate public policy changing unless there's a good reason for it. One has been demonstrated; deliberate false acusations and/or accusations made by people who have mental issues.

These same lying women all had they names and identities out in the public domain. They need their names known. Otherwise they cannot claim the mantle of Victimhood

However criminal cases are not civil suits. They aren't Doe vs Doe. It's State vs Doe. That's why the alleged victims name is not in the case header.

Furthermore a significant number of these accusers are children and teens. Putting their names in the public domain would discourage reporting. This is especially true in some communities. Many times the accused rapist is a family member and the alleged victim does not have the support of the rest of the family. Especially if the accused rapist is the breadwinner

There is no epidemic of false criminal complaints anymore than there is an epidemic of campus rape.

I don't think the answer is to publish the accusers name. It's to prohibit campus courts from dealing with allegations of serious crime like rape

My understanding is that accusors who are minors already enjoy certain privacy protections in the court system that are not available to adults. I think their identities would be protected under other laws.

Most likely, our co conspirator was taken in by a kindly social worker/youth counselor who has convinced the city that the money they dump into these professionals urban youth programs is worthy. To demonstrate that, they have insisted that St.Louis employ said conspirator gainfully so that his self esteem, sense of self worth, work ethic and general well being will be enhanced and nurtured under their supervision and he will someday be a model citizen of the community.

I have a friend who works in this type of works program and she constantly is giving her mini criminals a "new start" I worry for her safety and fear I will get a call someday that she was found face down in some crack house somewhere with a knife in her back and her purse missing. So trust me that the scenario I wrote above goes on thousands of times a day in the big city.
And especially with famous co conspirators. Those rehabilitations are quite the feather in the cap of social revamp warriors like my friend.....
