Random House: When Lena Dunham Called Barry "Barry," She Meant It As an Alias, Even Though She Didn't Say So

Apologies for "the confusion."

It should be noted that when Dunham referred to an ex-boyfriend earlier in the book, she specifically stated that she would be using a pseudonym to refer to him.

She did not provide any such statement with regard to "Barry."

Random House is offering to pay for any legal expenses Barry might have incurred in hiring his lawyer in this matter.

Nolte sums up some key points:

5. We know for a fact that nearly six weeks ago, Dunham herself was aware of the agony her memoir caused Barry One. And yet, rather than exonerate an innocent man she knew was twisting in the wind, she attacked the National Review author who told Barry's story.

6. How did Lena Dunham choose the name Barry? Moreover, no less than five descriptors in Dunham's memoir led who-knows-how-many people to believe Barry One was her rapist: 1) Barry One attended Oberlin at the same time Dunham did. 2) Barry One shares the same first name -- a very uncommon name. 3) Barry One was a campus Republican. 4) Barry One was a prominent campus Republican. 5) Barry One worked at one of the Oberlin campus libraries.

The details anyone could easily Google led right to Barry One.

I think Lena is going to be sued, and I think she's going to have to pay a large settlement.

20 Yeah... my understanding is that this is actually bad for Random House. What they should really be doing is shutting up and claiming that their editing process did not include verification or fact-checking of any claims in the book; that all claims are the authors alone and no reflection on Random House.

By saying, "Oops, our bad," they're basically just admitting to liability. By saying, "Oh... we'll pay for his lawyer" they're admitting he had good reason to hire a lawyer.

There probably wont be any future printings, and the basic injury is already out there in the public square, so that offer is of little value.

Maybe they should just go ahead and offer Barry an ownership position in Random House and get this whole thing over with.

Exactly my point earlier today, too.

All details led to this particular guy.

meh, just going to copy/paste

The very weird thing (conspiracy?) about the Dunham story is that "Barry" was a conservative on campus. Someone exactly like that existed, it's just the details were off.

Purposely implicating him and thinking she could get away with it? Meaning someone did the research to find "that guy?"

This is creepy. So very creepy. "Barry" is not a common name. And certainly matching up "Barry" with belonging to a Republican or Conservative campus organization cannot be chance.

58 Was "campus Republican" a pseudodescriptor?

Because she managed to get that in there. It's not about the name. If he were just "Barry, anonymous student", then she (and Random House) might have a case, as rare as that name is. However, she gave a descriptor that narrowed it easily to one person.

And I don't think she can hide behind the fact that she made other descriptions that were not true (i.e., mustache).

She obviously wanted to get in this passive-aggressive dig at one of the few right-of-center people she encountered at Oberlin. A guy who was undoubtedly a bete noire for the brownshirt lefty crowd.

109 I'm frankly stunned that Dunham is still welcomed in visible public life, after her open admission of having sexually interfered with her baby sister.

It's been asserted by some that among the long term social-engineering goals of the institutional left is to render pedophilia normative and uncontroversial.

I found those claims unconvincing when I first heard them. Now? In the wake of Dunham and the non-reaction by the lefty chattering classes to her horrifying actions? I find it a hell of a lot more plausible.

I was also able to find him and his wife on Facebook. I'm sure that's taken down now. They didn't have much info except a picture of her and their baby. (And, yes, morons, she's hot.)

It was way too easy to find him. I'm really shocked Random House didn't do any due diligence, given the massive advance they gave Dunham.

Certainly doesn't appear that she was from her telling of it. She invited "Barry" over to her apartment, they had consensual sex, he took his condom off twice, she didn't like that and asked him to leave, which he did.

The next day she writes in her journal that she and "Barry" "f*cked 69-style, nobody came." She complains to her friends that the sex was rougher than she wanted, and her friends tell her she was raped. She agrees, saying she never consented to be treated so roughly.

That's fine, but did she ever tell her "rapist" that she didn't consent? Or did she just expect him to read her mind? She also writes that before "Barry" came over to her place, he jammed his fingers into her v*gina; she didn't object, because she wasn't sure if she was turned on or not. So apparently Dunham herself isn't sure if she likes the rough stuff, but "Barry" is supposed to know what is going on in Dunham's mind -- and if he doesn't guess correctly, then it's RAPE!

Lena Dunham's attorney replied to reporters in Chicago that their defense will be the inherent difference in pronunciation of their names. "'Lena 'Dunnam' does not sound at all like 'Jef-fuh-fuh Done-Ham, Dot Com'," he stated.

Well his name is already being whispered on some lefty websites as THE rapist so about the only way for him to rebut the charges in a public way is to sue. Which of course puts his name even further into public view but at least he gets to tell his story and deny the accusations.

Given the trend these days of throwing rape charges around without ever going through the legal process, filing a libel suit is pretty much the way that an accusee can defend himself in public.

No, the big news in the new Field Poll is that Sen. Dianne Feinstein-- who has long been one of the more popular pols in California -- isn't so highly thought of anymore.

Her approval rating sank to an al--time low (for her) of 43 percent. The poll found that 36 percent disapprove of the way she's doing her job and 21 percent have no opinion of...someone who has been in the Senate for 20 years and on the states political scene for four decades. [...]

Feinstein's approval rating is now similar to that of fellow Democratic Sen. Barbara Boxer. That's a surprise: As the Fieldsters put it, "Throughout most of her tenure, Boxer has typically received somewhat lower job approval ratings than her Democratic colleague Feinstein. That is no longer the case."

Indeed, Boxers approval rating is actually UP to 44 percent from 39 percent in 2011.

What's up with DiFi? Field Poll director Mark DiCamillo posits that it could be her defense of the National Security Agency surveillance techniques earlier this year in the wake of the Edward Snowden leaks, as Comrade Lochhead has described.

274 I watched one episode of girls.

In that episode the Lena character is depressed about her parents doing something. One of her hot friends fucks some guy and then is depressed about fucking him. And some other chick has a problem with work and is depressed about work.

A real fun, uplifting show.

She claimed she was raped. She included a *lot* of details about the accused. Someone (either just to fact-check, or to find a rapist and see him brought to justice) did some digging and figured out who it had to be.

From his end, if I understand properly, a lot of the things she mentions in the book are things that would be included on his resume (his name, plus his attendance at Oberlin in the right time frame, plus leading whatever club that was, and so forth) that anyone who reads the blurb (which is now all over everywhere) would reasonably conclude he was the same Barry- and who wants to hire a rapist?

Absolutely. It's the main problem with our victimization culture. Victim's status is valuable and so there has to be some claim to victimization.

Think about even the ultimate victimization, the root of where it all started. It's based on the fact that one of your ancestors was a slave, at least 4 generations ago. And that's not even necessary.

He's been contacted by the press and various lefty sites linked to his Linked In profile and identified him as the guy. That's how he found out about this.

Posted by: BackwardsBoy, Curmudgeon Extraordinaire at December 09, 2014 02:31 PM (0HooB)

371 I'm kinda unclear on how much responsibility falls upon the publisher. It's Lena's libel. I get that the deep pocket frequently gets sued, but just how much liability do they really bear for this?

My guess is that they will cough up a million or so just to make the problem go away, but Lena is the one to punish in court.

Or so I hope.
Posted by: GnuBreed at December 09, 2014 01:50 PM (Cwylc)

The publisher is who produced the book, so they will be the ones on the hook or rather their insurance company will be.
Random House and Lena can then sue each other for negligence and fraud.

This is not unlike the Chris/Taya Kyle suit brought by Jesse Ventura. Ventura claimed that Kyle's book idenitfying him ( anonymously, but then later, Kyle identified Ventura as the celebrity) defamed him by saying he was punched out by Kyle in a bar, attributed comments to Ventura he denies saying, and Ventura contends the episode never happened.

A judge awarded Ventura $1.4 M from Kyle's estate which I understand was actually paid by the insurance company for the book's publishing house. It was later upheld on appeal and Kyle's widow was not granted a new trial.

In this case, no one actually knows for certain what happened. There are no actually corroborating witnesses for or against , the jury(in Minnesota, no less) had to choose who to believe.

Moral of the story? Don't think for a minute that a lying celebrity(exhibit A, Jesse Ventura) won't prevail in a courtroom full of jurors who are star struck. A lawsuit can go either way.

Here's the thing and this is not original with me, many others have said this too, there is no better depiction of the hollowness of modern Leftism, particularly for 20 something girls, than Dunham's work. If she was a right winger, the Left would be howling in rage at the world that she depicts.

399 Another book the Random House, then working at the Dial Press Susan Kamil was behind.

"In Our Time" tells the story of that transformation, as only Brownmiller can. A leading feminist activist and the author of Against Our Will, the book that changed the nation's perception of rape, she now brings the Women's Liberation movement and its passionate history vividly to life.

Here is the colorful cast of characters on whose shoulders we stand--the feminist icons Betty Friedan, Kate Millett, Germaine Greer, and Gloria Steinem, and the lesser known women whose contributions to change were equally profound. And here are the landmark events of the era: the consciousness-raising groups that sprung up in people's living rooms, the mimeographed position papers that first articulated the new thinking, the abortion and rape speak-outs, the daring sit-ins, the underground newspaper collectives, and the inventive lawsuits that all played a role in the most wide-reaching revolution of the twentieth century.

Here as well are Brownmiller's reflections on the feminist utopian vision...

Yep.
She has an agenda.

465 Speaking of TV shows that may or may not suck, I just finished the entire run of Freaks and Geeks, 18 episodes. I wish I had skipped the last two. After being apolitical throughout the season, the last two episodes featured Bush-bashing (GHWB), Republicans are the Party of the Rich, and the main protagonist ditches a National Academic honors trip so she can run away and follow the Grateful Dead. Either they were fearful of being cancelled and were trying to curry favor with Big Lib in Hollywood, or they knew they were done and let their freak flags fly. "Gay Rights" is a euphemism for "Fulfill my need for acceptance and approval of my sodomistic tendencies."

Human beings crave approval. o.o> You and I don't need 'hetero rights' because it's not contrary to God or nature. It is the way we are designed.

Those who run counter to God and nature know it, and their own consciences burn them more than any words from another person, be they the mildest, most loving exhortation to repentance or the vilest slander imaginable.

529 In the midst of all this, there have been calls to publicly name accusers of rape. I agree that due process needs to be conducted, and that false accusations should result in exoneration for the accused, along with identification, prosecution and/or mental health committment for the accuser.

As for all accusers though? We should probably try to determine the best course by talking to survivors of real crimes. Especially those that chose to be revealed, and those whose identities became known. What do they think? And are those in the first category of an atypical personality type? What may have been benign for them may be disasterous for others.

531 Bandersnatch, the self-loathing/projecting thing is kind of tired and not the one-size fits all the self-styled social science wizards wish it was.

The reality is there is a very real subset of the left who wholly opposes sexual stigma associated with any sex act under any condition. I don't know whether it's to tear down nuclear families, destroy perceived power imbalances between the genders, attack any moral absolute in pursuit of universal relativism, or normalize deviant behaviors simply because those behaviors have now reached a biological or behavioral threshold of statistical significance - whatever, the point is they want every stigma (except rape) removed.

The HQ's issue with the gay agenda is it's not about coexisting, it's about imposition and taking away cognitive real estate because the leftist mob deems it un-PC. You can do your thing, and I can say "You're a disgusting fuckup," and you can't make me do your thing, and I can't make you do mine, and you can say "Straight sex is terrible" and we can do and say all these things in a free society and not stop the other from doing them. But it becomes unfree and biased when one can stop the other from doing or saying their side of things, by law or coercion. "So the pendulum swings the other way" - no, past injustice does not qualify new injustice.

So the hate you perceive is not irrational hate but a resistance to the muzzle that says you can shut me up but I can't shut you up even though both of our positions are nothing more than relative constructs based on our respective moral contexts.

This will stop when 1) people of minority sexual status stop seeking special protections and tax dollars, and 2) when people of minority sexual status start policing their own by exiling the shamers (ChikFilA and Mozilla picketers), the criminals (Terry Bean), and their enablers.

But much like Islamists, they're not going to do it. The deck is so grossly stacked in their favor - they're weapons free while the opposition is limited under fatally oppressive ROEs, they have no accountability while small blunders by the opposition destroy careers and lives, they have the favor of the media while their opposition is blasted at every turn - they have so much to gain and so little possibility of loss, they'd be fools to position themselves for an armistice. They're going to ride this out to the bitter end and severely alienate a meaningful portion of the world in the process.

Actually, the argument I saw is simpler than that: rape is a criminal offense. Documents pertaining to a criminal offense are public record. Ergo there should be no *special privilege* for someone accusing someone else of rape to remain anonymous.

And I don't have an argument against that- not one that doesn't boil down to, "but that's mean," which is not a good basis for a judicial system.

i want to know what's likely to happen if this occurs. Was this decision some sort of PC code that spread? Or did it start because a real need was determined? Has that need passed?

I hate public policy changing unless there's a good reason for it. One has been demonstrated; deliberate false acusations and/or accusations made by people who have mental issues.

But what is the opinion of survivors of real attacks? Do they want to be named? Would they go through the whole ugly process knowing that they are now a public figure/

Posted by: Blue Hen at December 09, 2014 03:21 PM (Spluw)

557 There has not been an epidemic of false criminal rape complaints

Not criminal, these women are using the media and campus kangaroo courts to falsely accuse

These same lying women all had they names and identities out in the public domain. They need their names known. Otherwise they cannot claim the mantle of Victimhood

However criminal cases are not civil suits. They aren't Doe vs Doe. It's State vs Doe. That's why the alleged victims name is not in the case header.

Furthermore a significant number of these accusers are children and teens. Putting their names in the public domain would discourage reporting. This is especially true in some communities. Many times the accused rapist is a family member and the alleged victim does not have the support of the rest of the family. Especially if the accused rapist is the breadwinner

There is no epidemic of false criminal complaints anymore than there is an epidemic of campus rape.

I don't think the answer is to publish the accusers name. It's to prohibit campus courts from dealing with allegations of serious crime like rape

Most likely, our co conspirator was taken in by a kindly social worker/youth counselor who has convinced the city that the money they dump into these professionals urban youth programs is worthy. To demonstrate that, they have insisted that St.Louis employ said conspirator gainfully so that his self esteem, sense of self worth, work ethic and general well being will be enhanced and nurtured under their supervision and he will someday be a model citizen of the community.

I have a friend who works in this type of works program and she constantly is giving her mini criminals a "new start" I worry for her safety and fear I will get a call someday that she was found face down in some crack house somewhere with a knife in her back and her purse missing. So trust me that the scenario I wrote above goes on thousands of times a day in the big city.
