4. At the time of his death, Garner was out on bail after being charged with illegally selling cigarettes, driving without a license, marijuana possession and false impersonation.

5. The chokehold that Patrolman Daniel Pantaleo put on Garner was reported to have contributed to his death. But Garner, who was 6-foot-3 and weighed 350 pounds, suffered from a number of health problems, including heart disease, severe asthma, diabetes, obesity, and sleep apnea. Pantaleo's attorney and police union officials argued that Garner's poor health was the main cause of his death.

6. Garner did not die at the scene of the confrontation. He suffered cardiac arrest in the ambulance taking him to the hospital and was pronounced dead about an hour later.

Very much this. I really am tired of the Manichaean way this gets framed. There really are those out there who think every cop order is lawful, every arrest good, every use of force justified, and if you disagree you want blood in the streets. You can support "law and order" while being critical of police actions and wanting your Constitutional civil rights to be observed, defended and protected. It is not lawlessness to do so - in fact, quite the opposite.

So I personally know what utter BS it is to say that things are worse now. They aren't. When you call people racists long enough, the word loses its power. If you say that only black cops can police black communities, then you are calling for segregation. A better response is to dial back all these stupid laws and regulations that involve the government in our lives.

If I were an NY elected official, I would repeal the law making it illegal to sell single cigarettes. It's a small start. Keep decriminalizing things. Let cops deal with crime. Citizens in this country are desperate to live their lives without government intrusion.

172 today my older girl has to go outside of her comfort zone...she has been summoned to talk to the r.a.director of her dorm about her roommate who should never been allowed in student housing in the first place. when i dropped her back off at school sunday, once again, police cars were parked outside her building....my daughter...said....they are in my room...i just know it....and she was right....it's the fourth time since school started that she knows of that the police have been in her room....once would have been too many....but 4 times? twice for thoughts of self harming, once for a false sexual attack claim and the last time for slicing up her arm no where near a vein.....

I don't know about NYC, but in the Metroplex the answer is "no." If he had an outstanding warrant or was in violation of his parole, he had to be taken to jail.

As tsrblke points out- life is complicated. Any number of things could have been different, and Garner wouldn't be dead. Many of those have to do with the picayune laws. It seems just as many have to do with bad choices Garner had already made.

I think there's some sort of state or local regulation covering tobacco sales and the collection of taxes. Garner was circumventing the taxes, and that's the one thing the State won't abide.

There is an excise tax that retailers pay to the state and the city. If you buy cigarettes outside of the city of New York, they cost $1.50 per pack less. The city charges that on top of the state excise tax of $4.85. The stickers you see on a pack of cigs in NYC indicate the excise tax has been paid. So, bring in cigs from outside the city and sell them as loosies avoids the extra $1.50 per pack.

My dad is pushing 70 years old. He's short and fat (really- morbidly obese), has high cholesterol and high blood pressure. If asked to do anything strenuous for very long, he just can't. Oh, and he tore up something in his shoulder a few years ago, and hasn't bothered to have it fixed yet. He "isn't some spry 20 something." If he hit me in the jaw, he'd at least break it, and would probably knock me unconscious.

No, when someone is resisting arrest, you don't just "[keep] him surrounded until he [tires] out." Because all it takes is one good/lucky punch and then you have an officer down situation. At that point it becomes life or death, and they're almost obligated to shoot him.

He died (as best I can tell from the facts in evidence) because he was in poor health, and being choked out was not good for him. He didn't have to die, but given that he was resisting arrest, I don't think the officers did anything terribly untoward.

237 I didn't read Mooch's comments but I sort of agree that a lot of schools are pretty woeful on helping get their students into college.

A friends son is graduating this year and just had a great semester, so he wanted to send his grades off to the five colleges he has applied to so they could see how well he continues to do, but his high school said "no- we only send grades once". He was smart and got the department secretary to run him off a transcript and he himself mailed it off. I know colleges won't treat that as official, but its better than nothing!

The article itself was funny itself in how hard it failed to logically explain why Southern Democrats were failing. It tried to paint LBJ as some sort of Democrat prophet, proclaiming that the South was beyond saving once the great Civil Rights Act of '64 was passed, yet they maintained control for a couple of decades after the bill passed. All Southern Democrats were gone, except those in small pockets filled with minorities, oh and in Florida and Virgina where they still have Democrats in a senatorial seat.

The comments section at the NYT is so much worse. There was one guy in there who seemed reasonable (despite being progressive, but nobody's perfect), but the rest were just continuations of the stupidity.

She had to go in, and then called the cops. The State trooper came in, took one look around the door at the guy and said that ifhe tried to restrain him it was lilkely to end badly, and he'd be forced to use deadly force. He called the local volunteer fire company and demanded that EVERYBODY get there. They swarmed him, and my mother literally tranquillized the guy. Here, they were able to use discreation, and overwhelming force. But what if he had instead tried running amok in the residential area?

Almost no one wants restraining somebody like this, or arresting someone for a low level crime to die.There are some sick cops that abuse their power and authority. There's no proof that this is the case here.

Drive back to NYC and sell them to retail sales guys like Garner who sell them on the street.
Maybe Garner bought them himself, but I doubt it. His poor health probably limited that.
Plus more efficient for someone with capital to buy in bulk, sell smaller units of inventory to small-time street sellers like Garner, who probably can't scrape up a lot of cash to buy much inventory at once.

The point is that cops are not, and should not be, under any obligation to use *less* force than the suspect they are attempting to apprehend.

Quite frankly, if they'd been able to give him a wooden shampoo, he likely would have survived that experience (because he likely would have stopped sooner). Once a suspect has started resisting arrest, you must assume he will continue to do so in an ever more aggressive fashion until you have gotten him to stop resisting arrest.

I'm going to be honest- he seems like he was a loser criminal who assaulted his own daughter (per prior comments), I'm neither terribly surprised that he's dead nor particularly sorry about it (beyond the general sadness of any death). He chose to live a life of crime. When he was confronted about it by the police, he resisted, thus beginning a physical altercation where none was needed.

With his age an health, ANY physical altercation could well have ended his life (though, paradoxically, more force sooner might have caused less damage over all).

Actually, no. Most don't. And the few that did were given the impression he got busted a bunch of times for selling loose cigs -- not anything violent.

If somebody has been arrested a bunch of times for violent acts, like domestic violence, then the police know that and that changes how the police react.

Had Garner *not* resisted arrest, no "force" would have been used.
Once he began resisting, had he ceased resisting on his own (seeing that he couldn't win because he was outnumbered), the force would have stopped immediately- and if it hadn't, *then* we'd have a real issue to talk about.

In this case, it looks like a career thug took on police and lost- due in part to the altercation and in part to his own poor health, he then suffered cardiac arrest and died.

I'm not sure how that's either a) an excessive use of force or b) the cops' fault.

At the same time the president took an issue that was a daily, agitating mobilizer of his base and removed it as a factor. He took the kettle off the heat--but that kettle had produced a lot of steam that provided energy to his party.

Now the president has to implement his directive, and implementation has never been his strong suit. He has to tamp down grievance from those who came here legally or are waiting in line. He has to answer immigration activists who think they got too little. He has to face all the critics who will experience and witness the downside of his action on the border.

as for #1, I dunno what the best way to do this is. Were they following the besst practice? Were they being slow and dim? I suspect that one makes the attempt, and then, if resistenace is met, then it becomes a group project. If all of them had swarmed him at the onset, that would have been wrong. If he had used a club, that would have been wrong.

#2. I don't know what those are, and I don't know if there was merit to them, or if the city decided to shell out and end it. They're busily giving millions to the vermin that attacked the Central Park jogger and nearly killed her.

I know nuance is hard, but do try to keep up.

I neither said, nor implied anything about the just-ness of the law in question. The fact is criminals gonna criminal- he was going to get busted for something. If you want to argue about the law (an argument I've been staying strictly out of) I agree with you- I think a law against selling loosies is... silly. At best. And it certainly shouldn't be a felony.

I *also* think I shouldn't be required to wear my seat-belt, put my kids in car-seats/booster-seats, or obey a speed-limit on highways. However, those are the law, so I obey them.

Garner certainly *knew* that it was against the law to sell single cigarettes (at least, in the manner he was). He chose to break the law anyway.

Now if that's some sort of protest against an unjust law, fine. But then the *point* is to get arrested, so resisting arrest is dumb. Obviously he wasn't doing it as some sort of small government protest.

:shrug: agree to disagree. I know the video isn't the be all to end all, but as far as "Resisting" goes until the cop tries to take him down his "resisting" is fairly low key.

Consider an analogous story that I've told before:
Neighbor shots off fireworks. My yard faces the road and I'm outside with friends around a fire pit. So I get the joy of 4 cop cars pulled up to my house and a cop with his hand on his hip joining my little soiree. (Imagine an accent mark on that e because "damn pixy.")

Cop comes up and says "we're going to spotlight you for 'safety'" (Alternatively he could have asked and I'd have come to him, rather than blinding my guests but hey.)

My response is "Well then I'm not going to set down my glass of wine and get up, so you can talk to me from over there."

Now I wasn't committing a crime (obviously) and I don't have any history of violence that I know of. But I resisted his "authority."

As I said, our rights are downstream those of petty criminals, so I'd prefer the least amount of force necessary to effect a goal, as a benefit to myself when I arise in a similar (but admittedly different) situation.

But then I'm a crazy who also believes that ultimately you're responsible for your own safety, and every so often a truly violent and dangerous criminal may get away.

I also object to sin taxes funding stuff like child health insurance like SCHIP. You've got two diameterically opposed forces from the same government working against each other. There are federally funded anti-smoking programs, and a health insurance law that is funded by cigarette taxes.

An excellent point. Problems here are, habitual criminals have at least a vague notion o fwhat shit they can get away with, and try to skate along that. Police do too, and you're right that they often lump everyone together. in a way, we're easier to control and yes, bully, than criminals, bec asue we AREN'T criminals (at heart). It's easier to give ot speeding tickets to people who say yes sir than to serve warrants on career criminals.

This, I think, is the disconnect we're having. I'm not seeing anyone who is critical of the choking incident saying *this case* should've gone some other way. Its been argued and is done. No, you didn't. As someone who had not, and was not under suspicion of having, committed a criminal act, he had no special 'authority' over you in the first place, except perhaps to ask for identification.

The cops could have just stood around staring at Garner for hours, I guess, but I think they *also* thought they had better things to do than bust someone for selling cigarettes. So, if he won't comply, a "take down" becomes necessary.

If the cops knew he had a history of violent crime (and it seems quite plausible that they did- though we don't know that for sure), then escalating directly to violence (though the lowest level of which they were capable) is much more understandable. Maybe still not "good," but much more understandable.

I'm not saying the cops are completely innocent here. But I'm saying the person proximate to the event with the most culpability is Garner himself, not the police.

So when I tell a cop to shut up (something I've done before when I've had a bad day) I'd appreciate it if they don't bring down the whole force of government on me.

And yet, tons of times I see white teenagers handcuffed on the street near my parents home, while their cars are being searched. Probably because they mouth off to a cop who decided "I'm going to show this kid."

In some ways it's like retail. You're going to get a customer who's a complete jackass, you kinda have to still put on a happy face and play nice.

And I'd disagree that I wasn't under suspicion.
I was clearly under suspicion for firing off fireworks (or depending on which cop you asked "discharging a weapon.") They made as much clear.

(Indeed if they really believed "gunshots" as they claimed when they marched onto my yard, I had the chance of being significantly more dangerous than this guy.)

A very good point.

It's a very ugly intersection. We want police to be fair, professional and restrained. We also want them to be proactive. What we often get are policewho stand back and fill out paperwork and draw chalk outlines after the fact, roust teenagers and others who aren't likely to resist or be believed, or who are not politically connected. Hell, a mayor in MD was arrested and his dogs shot because someone was dealing drugs via FedEx and had arranged for the package to be dropped on his doorstep.
We've also seen what NY became when street crime and low level jerks were allowed to roam uncontested.
