2 Good Morning Morons. Today is Thursday, December 04, 2014. On this day in 1945 the Senate approved U.S. participation in the United Nations. This was done via the United Nations Participation Act. The Senate approved it on Dec 20th 1945. That would make it one of those lame duck sessions we all love so much. The Republicans took over both houses in 1946. Does this sound familiar. One of the biggest disasters this country ever did with foreign policy was joining the UN.

You can't believe everything you see on Teh Intarwebz, Vic.

Regular elections are held on even-numbered years (1946). The new officeholders take over at the start of the following odd-numbered year (1947). So in December, 1945, the drones would have had their places since the previous January.

What bothers me more than Congress approving membership in the UN back then is that in all the years since they haven't gotten us the hell out. Bonerism has been alive and well in D.C. for many, many decades.

My research shows that heart attacks and your probability of having one are largely due to heredity and life style choices. Number 1 - heredity, number 2 smoking, number 3 overweight with a non-exercise life style.

If they are putting Biden forward, it means one of two things: 1. they already know they aren't going to win in '16, so they expect him to put on the right kind of show. Or 2. they are putting him out there as the clown act, and are hiding the headliner, to be revealed somewhere later in the show.

97 Folks could really benefit from watching the Chris Rock bit about how not to get your ass kicked by the police. Everyone caught up in these recent events was violating one or more of Rock's common sense precepts.

OK, so now let's deconstruct this latest one: The video looks terrible. It looks like the cops choked the dude to death for next to nothing, jacking with him for a two-bit street crime and barely resisting.

However, the other side of the story is that it was local buisness owners who called the cops because it's bad for business to have giant black dudes outside on the sidewalk committing street crimes. Dude had been arrested 31 times, including nine time for this same offense. He was out on bond when this event occurred.

The cops didn't choke him to death, or even cause any structural damage when they grabbed him. They pulled bim down and subdued him, and the guy died later in the ambulance of a cardiac arrest, because, again, giant black guy.

Paramedics appear to have deteced a pulse and apparently he was breathing. There was apparently a reasonable debate going on at the scene as to whether he needed an ambulance or whether he was well enough to get on a bus and be sent home.

Important practice tip, a la Rock: when you are in an encounter with the cops, be respectful, shut the fuck up, and don't resist. I can't overstate the importance of this strategy.

Here, the dude wouldn't allow himself to be cuffed. I don't care who you are or where you're from, in the city I live in, that will get your ass kicked. In fact, you deserve to get your ass kicked because you're a fucking moron. What did you think is going o happen? The cops are going to just allow you to decide when you're being arrested because you told them last time, "I'm just taking care of my business and want to be left alone" (or something close to that from the video) when in fact you are a recidivist dickhead standing there for the 32nd time committing a moronic street crime? What if I robbed every person who walked by of $1? Do I get to decide when the police get to fuck with me?

I feel bad for this guy and his family. This didn't need to happen. But like Mike Brown and Trayvon Martin, he is dead today because he was a fucking idiot. It is so easy to avoid this kind of treatment by the police I don't know what else to say. Be respectful, shut the fuck up, don't resist; it's that easy.

It hurts!. Condolences to your family. Faithful was along in years? Several years ago we buried a cat that was 16. If the church door was open she would often come in. She would even attend meetings that I didn't particularly want to go to. I often thought of adding her to the membership list. If I had a new member-"Cleopatra" who outside the church know the difference? ;^).

A choke can restrict air and/or blood supply, depending on the way pressure is applied. In this case the officer's forearm blade is flat against Garners' throat, and his opposing hand is looped OVER the shoulder pulling on the wrist for extra force, while his left shoulder shoves Garner's head forward, again for extra force. That's a choke, and both a crappy and dangerous one, because it primarily attacks the trachea and air supply.

There is this false meme spreading around that it was actually a "seatbelt hold". This is nonsense. If you watch the video the officer initially went for a seatbelt hold, then quickly converted it to a full on choke.

I don't recall the numbers, but I have read that semis full of smokes brought Big Profits: one large-ish box truck loaded down with cigs could return a 5-figure gross. And there were enough cops on the take to keep it pretty safe.

Here's an article that has a lot more background on the incident. A couple interesting tidbits.

- First, this wasn't some random shakedown in a random neighborhood. This was a targeted operation after citizens complaints, apparently neighbors got tired of guys hanging out, selling weed and smokes and drinking on the street, and the person giving the order was the number 3 guy in the NYPD. A black officer. No racism.

- Second, the police are stating that it was not a banned chokehold that was used but a standard police technique.

- Third, Garner was arrested 8 times for selling lose cigarettes previously and had been warned a week before this incident to stop doing it. He had been picked up earlier this year with 23 sealed packs of untaxed cigarettes and one open untaxed pack. I'd have to look up the law but at some quantity the crime goes from misdemeanor to felony.

Their bullshit sophistry is that he used a "seatbelt hold", which isn't a choke and isn't against their procedures. He briefly did apply a seatbelt hold, but then rapidly converted it to a full choke. Look at the image still links in comments above.

There is a lot of sophistry and semantics going around trying to say this wasn't a choke when it in fact was. Regardless of what killed the man or whether the police acted appropriately, lets at least not bury the facts under semantics.

IANAL, but manslaughter usually requires some element or recklessness, which has a very particular definition in the law.

That's to say I'm convinced the cop didn't just say "ah, fuck it, I'm going to use this easier hold, risks be damned" (which might raise to the level of recklessness.

Consider: if a doc screws up a surgery and the patient dies we don't call that manslaughter unless they did something pretty beyond the pale.

Condolences on the loss of Faithful. I lost two kittehs within a year, Kette (who died on the anniversary of Pearl Harbor last year) and Diana, who died at the end of July. I have two younger kittehs now, but I still miss the senior ladies who were 16 and 18 when they passed. And I've seen a number of my friends through pet loss (kittehs, doggehs, and a birdeh) over the past several years. It's never easy, but as my friends say, there is some comfort in knowing that the pet had a good life with its human family, and remembering all the joy that the beloved pet brought to its humans.

We don't have a hypersonic missile that works that China can just copy.

America and China are in a hypersonics race. Both programs are classified, of course, though the American program is more open. From an outsider's perspective it appears the US program is a good bit more advanced and leading the race. Hard to say. The Chinese program is very opaque.

Both America and China have conducted hypersonic tests in recent years.

With the modern state of espionage, it probably won't be too long after one country figures it out that the other one copies or steals the design. Of course, part of it is also having the industrial and and scientific and engineering muscle to actually build it. Something China increasingly possesses.

I agree, as a first step.

But we've gone so far the wrong direction on rape accusations, and I don't know how to get back to where we should be.

1) Accused rapists often do not get to "face their accuser."
2) Even with an acquittal, the accusee's reputation is forever destroyed.
3) We're not allowed to question accusers because "that makes them relive the rape all over again" or "it makes it less likely for the next one to come forward."

At some point we've got to admit that rape is a crime on the order of murder (yes, I put them at about the same 'severity'), and that for that reason the accused deserves all the (legal) benefit of the doubt our system provides.

At our department meeting, there was a guy who was quietly sobbing. He has four kids, his wife doesn't work, and one of his young daughters just had some major gastrointestinal surgery. I'm pretty sure he's got some bills even after the insurance. I really felt bad for him.
There are really nice equipment in my lab that I could live comfortably off of if I could ever pawn them!

In TX, the law is "move over or slow down." Move so there's at least one lane between you and the shoulder if possible. If not, you have to slow down to something like 15 mph less than the speed limit (or 10 mph as a minimum, I think).

Yep. There's no need to have campus kangaroo courts for sex crimes.

If somebody gets raped or sexually assaulted on campus then you need to do the same thing you would do before or after college -- call the damn cops.

But they don't want that since they are trying to punish behavior that isn't rape and they know it.

And the only response to that is for these falsely accused men to bury academia in lawfare and take every penny in damages they can get.

My lab moved in two phases. The second phase was the animal facility.
Comp med handled animal movement but I had to handle all equipment.

After that we have about an 18 month gap until Mom-in-law is Medicare eligible.

What is disappointing to me in some sense, is by choosing to completely cut out R and D here at our site, they are surrendering certain capabilities for good. The alternate sites don't have certain things we did here and it translates to slower progress and products for the customer in the future. It means they are giving up in certain areas.

It has been the law in Michigan for years - get over or slow down for stopped emergency vehicles. I just went to Maryland and back and signs stating that are up just as you cross the border on the turnpike or the interstate. This isn't new.

I agree with everything you said. The situation is insane.

The Right should be able to fight this by demanding colleges take things as seriously as they say and involve the police. Colleges should get out of the sex crime business completely.

The Left defends it by saying the men who are punished (suspended/expelled/etc) aren't being *really* hurt in any tangible way. But with social media now the charges stick around.

Plus there are the feminist sites that let people anonymously list men as rapists. Which is crazy. They let crazies go on and anonymously list men's real names and the "crimes" they've committed.

Good thing is more men are suing the colleges rather than just slink away quietly and hope everybody forgets this horrible false accusation.

In case you missed the update- fracture to the radial head which attaches to my elbow. Ortho says putting a cast on it is a bad idea, so all I get to do is take narcotics for the pain (nothing else works) and anti-inflammatories for the swelling.

That's especially bad today, because I had to skip my morning pain meds; I had to come into the office to talk to some people, and driving while on narcotics is... not wise.

It'll be this way for 4 - 6 weeks. Probably.

To get serious for a moment, I actually think that something of that nature might actually serve a good purpose by serving as a warning to otherwise oblivious New Yorkers that the good times that were initiated by Giuliani and continued, more or less, by Bloomberg are now over and it might well be time for reasonable people to GTFO. The family of my sister in law were Jews in Germany and recognized the indications that, despite the inconvenience and genuine sacrifices involved, it was time to GTFO. And that is why the particular genes that belong to my sister in law exist and were passed on to my nieces.

Now I don't expect that particular form of bad times to occur in New York City but I think it is reasonable to expect that the annual homicide count to rise from ~500 per year during the Giuliani and Bloomberg era to back over 2000 per year as was typical when David Dinkins was mayor. I also think that, given the feckless attitude towards national security displayed by the Obama Administration, there is a reasonable chance that a nuclear weapon will be detonated in NYC and the best defense against nuclear weapons is to be some place else when they go off.

I think for men in college currently there's a bit of a "Someone Else's problem field" thing happening. While we're all at risk of this happening the crowd you run with matters too. I had one Girl Friend in college, she's now my wife. My chances of false accusations were low because of that. Many people may be in similar situations, so they don't get caught up in the net, so they don't care.

The Feds set acceptable rads at such a super-low level, even if it was a relatively small device/yield, the Feds would demand abandonment and /or very expensive clean-up.

Do that in 3 big cities, or three parts of same city, and the desired effect would be achieved. Chaos, panic, fear. The death toll from the bombs would be tiny. Evidently it hasn't been done yet because it's harder to actually do than write about.

I just watched the video. I found it disturbing. The big picture is that we have too many laws that require enforcement. I always go back to my belief that the common law is better than codified law. The common law basically takes care of all known criminal mischief. Its the civil law that has added numerous crimes to the books that do not really endanger the lives of anyone.

There are far too many unknowns to really know if the administration acted improperly. I don't think the police were aware until the RS article came out. They should be investigating now.

That being said, the most credible part of the RS article for me is that the UVA administration did nothing. But that may have been entirely justified.

The reporter stated that she set out to do an article about rape at an elite university but she didn't find anything that fit until she spoke with Jackie. So, yes, the reporter was scouring the country and not finding a useful story. You would think that would be the story, much like NBC (or whoever) sending the Muslims out to pray to Mecca at NASCAR races and then spiking the story when nothing happened.

I had forgotten that Rolling Stone was the only media outfit that claimed that the stuff Glass wrote for it was totes true you guys.

You know what's interesting? Every article I've seen that doubts the story says that if it is true then this is a horrible crime and many people need to go to jail for a very long time.

I'm sort of tired of those disclaimers. I understand why people feel the need to say it, but it is pointless. Never would I think that being skeptical of the story would mean that the person would not feel this way. Not sure why it needs to be said at all.

The story is obviously agitprop, for several reasons.

First, as the "reporter" admits, she chose to investigate UVa because it lacked a "radical feminist culture upending the patriarchy." That's enough to call "bullshit" on her story right there; she admits to having an agenda when setting out. We could stop with this one alone - I'd be intensely skeptical of anything and everything she said from that point on.

Second, the story reads like the product of a creative writing class, because that's probably exactly what it is. Read it again, and notice how the authoress adopts an air of omniscience, knowing what the dramatis personae are thinking and feeling. Hell, by her own admission she doesn't even know who most of the people involved were, yet she knows the thoughts and feelings of her lead character? This isn't a report - it's a script.

Third, some real clangers. As someone pointed out, guys are visual. We like the lights on; women often do not. If a bunch of guys were going to commit a gang rape, I absolutely guarantee any light available would be turned on. Note also how convenient this is. Identify the perpetrators? Nah, it was dark. Just have to go with Jackie's take on events. You know, 'cause it was dark and all. Bullshit.

Fourth, consider the plausibility of a bunch of guys whipping out their todgers and rolling around on a floor covered broken glass, and doing so in the dark. What guy wouldn't love to do that? That scenario sounds like a lesb feminist fantasy to me.

I'm even willing to give benefit of the doubt on the "I recognized them even though it was pitch black" thing. Your eyes do adjust amazingly well to low-light conditions. It's possible it was "pitch black" when she was pulled/thrown in and her eyes adjusted as the assault continued.

Granted that- a lot of the rest of her story still doesn't add up. If you grant her enough "benefit of the doubt" eventually all you're really saying is "we believe you even though the evidence doesn't."

And, still, the safest thing for the University would have been to open a criminal investigation in the first place. Like- "give it to the cops" criminal investigation.

She was looking for a plot vehicle for her agenda, and she found/manufactured one. Her publishing this as a "news report" is the most egregious self-aggrandizing marketing since that guy who hyped the Segway.

They're bad to start with. Unless force was clearly involved, no one other than the participants can begin to discern whether someone was victimized. 694 So that NBC Live performance of Peter Pan airs tonight. I caught Red Eye talking about it because the lead, Ashley Williams, was asked about how that last time NBC did this with the Sound of Music and she said it didn't matter because "Hate watching" is a thing now.

Anyways after seeing the commercials for this I was trying to figure out if I should know who this Ashley Williams is and Red Eye helped with that. Oh its Brian Williams demon seed. One of Lena Dunhams friends on her shitty show. No wonder she thinks hate watching is a thing.
