2 Good Morning Morons. Today is Thursday, December 04, 2014. On this day in 1945 the Senate approved U.S. participation in the United Nations. This was done via the United Nations Participation Act. The Senate approved it on Dec 20th 1945. That would make it one of those lame duck sessions we all love so much. The Republicans took over both houses in 1946. Does this sound familiar. One of the biggest disasters this country ever did with foreign policy was joining the UN.

3 There are those who seek truth.
Others gladly hate the truth.
Those dedicated to the Lie
seem to have drops all pretense.
They don't just shade the truth,
They don't nuance the lies with truthiness,
They say anything, make up anything,
And would destroy anyone
just to propagate the Lie.

The war in heaven on earth is getting hotter.

Morning, Glories!

43 Based on this it looks like what killed him was a combination of Garner's lifestyle choices and heredity

Cardiovascular disease equals poor blood flow to the brain of the deceased.

As to the police, in a 'fight or flight' scenario our bodies automatically direct blood flow from the 'newer' brain to the 'old brain'. The 'old' brain directs respiration, muscle control -- the things that once upon a time helped us escape a charging rhino. The 'new' brain which separates us from primates is shut down until danger subsides.

Engaging the police and resisting arrest? Never a good idea, but some certain segment of society will never 'get that' basic notion.

You can't believe everything you see on Teh Intarwebz, Vic.

Regular elections are held on even-numbered years (1946). The new officeholders take over at the start of the following odd-numbered year (1947). So in December, 1945, the drones would have had their places since the previous January.

What bothers me more than Congress approving membership in the UN back then is that in all the years since they haven't gotten us the hell out. Bonerism has been alive and well in D.C. for many, many decades.

If we have learned anything over the years it is that politics is, and always has been to a large extent, theater.

It's expensive theater, with very serious consequences, but the people who perform go through a complicated set of gyrations on a huge, life-size stage.

If they are putting Biden forward, it means one of two things: 1. they already know they aren't going to win in '16, so they expect him to put on the right kind of show. Or 2. they are putting him out there as the clown act, and are hiding the headliner, to be revealed somewhere later in the show.

Biden won't be President. I don't think even Biden is crazy enough to believe that.

97 Folks could really benefit from watching the Chris Rock bit about how not to get your ass kicked by the police. Everyone caught up in these recent events was violating one or more of Rock's common sense precepts.

OK, so now let's deconstruct this latest one: The video looks terrible. It looks like the cops choked the dude to death for next to nothing, jacking with him for a two-bit street crime and barely resisting.

However, the other side of the story is that it was local buisness owners who called the cops because it's bad for business to have giant black dudes outside on the sidewalk committing street crimes. Dude had been arrested 31 times, including nine time for this same offense. He was out on bond when this event occurred.

The cops didn't choke him to death, or even cause any structural damage when they grabbed him. They pulled bim down and subdued him, and the guy died later in the ambulance of a cardiac arrest, because, again, giant black guy.

Paramedics appear to have deteced a pulse and apparently he was breathing. There was apparently a reasonable debate going on at the scene as to whether he needed an ambulance or whether he was well enough to get on a bus and be sent home.

Important practice tip, a la Rock: when you are in an encounter with the cops, be respectful, shut the fuck up, and don't resist. I can't overstate the importance of this strategy.

Here, the dude wouldn't allow himself to be cuffed. I don't care who you are or where you're from, in the city I live in, that will get your ass kicked. In fact, you deserve to get your ass kicked because you're a fucking moron. What did you think is going o happen? The cops are going to just allow you to decide when you're being arrested because you told them last time, "I'm just taking care of my business and want to be left alone" (or something close to that from the video) when in fact you are a recidivist dickhead standing there for the 32nd time committing a moronic street crime? What if I robbed every person who walked by of $1? Do I get to decide when the police get to fuck with me?

I feel bad for this guy and his family. This didn't need to happen. But like Mike Brown and Trayvon Martin, he is dead today because he was a fucking idiot. It is so easy to avoid this kind of treatment by the police I don't know what else to say. Be respectful, shut the fuck up, don't resist; it's that easy.

It's organized crime all the way down. Buy cigs in a low tax state, smuggle them to NYC. In the socialist state everyone is on the take in some way, somehow.

Watch the full video. It WAS a choke, look at this still
http://tinyurl.com/o4zg53w

A choke can restrict air and/or blood supply, depending on the way pressure is applied. In this case the officer's forearm blade is flat against Garners' throat, and his opposing hand is looped OVER the shoulder pulling on the wrist for extra force, while his left shoulder shoves Garner's head forward, again for extra force. That's a choke, and both a crappy and dangerous one, because it primarily attacks the trachea and air supply.

There is this false meme spreading around that it was actually a "seatbelt hold". This is nonsense. If you watch the video the officer initially went for a seatbelt hold, then quickly converted it to a full on choke.

For comparison, in this video this BJJ grappler demonstrates a seatbelt hold
http://youtu.be/N_rQ0kuir6E

Finally, he only said "I can't breathe" after they released the choke.

After placing an order for a pack of cigs, you had to wait while your common street vendor sent a runner to his supplier to get the pack you ordered.

New Conservative Talking Point: Eric Garner is a punk who got what was coming to him for disobeying the law and authority. After all, we are a nation of laws, and the law is sacred.

213 Bigby's Nic-Stained Fingers at December 04, 2014 08:10 AM

Here's an article that has a lot more background on the incident. A couple interesting tidbits.

- First, this wasn't some random shakedown in a random neighborhood. This was a targeted operation after citizens complaints, apparently neighbors got tired of guys hanging out, selling weed and smokes and drinking on the street, and the person giving the order was the number 3 guy in the NYPD. A black officer. No racism.

- Second, the police are stating that it was not a banned chokehold that was used but a standard police technique.

- Third, Garner was arrested 8 times for selling lose cigarettes previously and had been warned a week before this incident to stop doing it. He had been picked up earlier this year with 23 sealed packs of untaxed cigarettes and one open untaxed pack. I'd have to look up the law but at some quantity the crime goes from misdemeanor to felony.

Andy McCarthy did a good write up on this incident. He leans toward disagreeing with the GJ but he recommends and open mind until the facts come out.

Given the fact that evangelical nuts who WANT to abuse agency power are drawn like moths to the flame of the various alphabets this is inevitable....

You get hardcore PETA types who can whip up "discretionary rulings" functionally creating law on the fly with fines in the 6 to 8 figure range and little recourse through law.

The left has codified shakedowns without recourse and the right refuses to name the enemy in play.

Even given the worst possible interpretation of the events at hand, I'm still not sold on the idea that the criminal system is the best way to handle this over the civil system.

As I said on twitter, I do research ethics. The field is littered with cases that share many analogous traits to this one. I can't recall them being handled as criminal trials.

233 "- Second, the police are stating that it was not a banned chokehold that was used but a standard police technique."

Their bullshit sophistry is that he used a "seatbelt hold", which isn't a choke and isn't against their procedures. He briefly did apply a seatbelt hold, but then rapidly converted it to a full choke. Look at the image still links in comments above.

There is a lot of sophistry and semantics going around trying to say this wasn't a choke when it in fact was. Regardless of what killed the man or whether the police acted appropriately, lets at least not bury the facts under semantics.

IANAL, but manslaughter usually requires some element or recklessness, which has a very particular definition in the law.

That's to say I'm convinced the cop didn't just say "ah, fuck it, I'm going to use this easier hold, risks be damned" (which might raise to the level of recklessness.

Consider: if a doc screws up a surgery and the patient dies we don't call that manslaughter unless they did something pretty beyond the pale.

Naturally it fell apart completely.
The guy she named ("Barry", who is real) should sue her for everything she's worth. Tons of people know who this guy is buy now since he's the only Republican named Barry who went to Oberlin at the same time as Dunham.

Almost all the other details in her rape claim are demonstrably false -- except his actual name.

325 Mindful webworker

Condolences on the loss of Faithful. I lost two kittehs within a year, Kette (who died on the anniversary of Pearl Harbor last year) and Diana, who died at the end of July. I have two younger kittehs now, but I still miss the senior ladies who were 16 and 18 when they passed. And I've seen a number of my friends through pet loss (kittehs, doggehs, and a birdeh) over the past several years. It's never easy, but as my friends say, there is some comfort in knowing that the pet had a good life with its human family, and remembering all the joy that the beloved pet brought to its humans.

338 I'm guessing the Teledyne comment was a reference to the US research program in hypersonics. Yes, we have a hypersonic research program, whose test flights keep failing disastrously.

We don't have a hypersonic missile that works that China can just copy.

America and China are in a hypersonics race. Both programs are classified, of course, though the American program is more open. From an outsider's perspective it appears the US program is a good bit more advanced and leading the race. Hard to say. The Chinese program is very opaque.

Both America and China have conducted hypersonic tests in recent years.

With the modern state of espionage, it probably won't be too long after one country figures it out that the other one copies or steals the design. Of course, part of it is also having the industrial and and scientific and engineering muscle to actually build it. Something China increasingly possesses.

It's the middle of November, early morning, and Markay is perched in a chair right outside the biennial meeting of the Democracy Alliance. He is not allowed inside. He is never allowed inside. As a reporter for the Washington Free Beacon, a conservative website founded in 2012, Markay's assignment is to sit in a lobby cafe of the Mandarin Oriental hotel for three days, acquiring news about the meeting the way a shipwrecked sailor might acquire driftwood.

Five months earlier, when the Democracy Alliance met in Chicago, it distributed the photos of 20 reporters to prevent attendees from leaking anything by accident. Eleven of the profiled reporters worked for the Washington Free Beacon.

The recent test failures are part of a program to build a conventional, global prompt strike capability. That means sustained hyper sonic flight, which is much harder.

I agree, as a first step.

But we've gone so far the wrong direction on rape accusations, and I don't know how to get back to where we should be.

1) Accused rapists often do not get to "face their accuser."
2) Even with an acquittal, the accusee's reputation is forever destroyed.
3) We're not allowed to question accusers because "that makes them relive the rape all over again" or "it makes it less likely for the next one to come forward."

At some point we've got to admit that rape is a crime on the order of murder (yes, I put them at about the same 'severity'), and that for that reason the accused deserves all the (legal) benefit of the doubt our system provides.

On Nov. 13, after Lachlan Markay was done staking out the Democracy Alliance, Continetti headed to the Republican Party's Capitol Hill Club to accept a prize. The Young Conservatives Coalition was giving him the "Buckley Award," named for National Review founder William F. Buckley, for his "significant contribution" to the movement. As fellow award-winners James O'Keefe and Dan Backer watched, Continetti asked his audience to reject the popular history of Buckley as a bloodless intellectual.

"The Buckley of the 1950s and 1960s was even more frightening to liberals than even Ted Cruz," said Continetti. "He defended Joe McCarthy. If you want a controversial issue, defend Joe McCarthy!" Buckley, he said, launched "the conservative march through the institutions that continues to this day."

396 I usually try to do this as a courtesy -- apparently it's now the law -- with a hefty fine for noncompliance.

In TX, the law is "move over or slow down." Move so there's at least one lane between you and the shoulder if possible. If not, you have to slow down to something like 15 mph less than the speed limit (or 10 mph as a minimum, I think).

Since I can't remember the numbers, I choose to move over.

1) Accused rapists often do not get to "face their accuser."
2) Even with an acquittal, the accusee's reputation is forever destroyed.
3) We're not allowed to question accusers because "that makes them relive the rape all over again" or "it makes it less likely for the next one to come forward."
--
Yep. There's no need to have campus kangaroo courts for sex crimes.

If somebody gets raped or sexually assaulted on campus then you need to do the same thing you would do before or after college -- call the damn cops.

But they don't want that since they are trying to punish behavior that isn't rape and they know it.

And the only response to that is for these falsely accused men to bury academia in lawfare and take every penny in damages they can get.

My lab moved in two phases. The second phase was the animal facility.
Comp med handled animal movement but I had to handle all equipment.

At the time we ordered needles by the case. 10 boxes 100 needles each. In multiple sizes (though the case sizes may have been different.)

And a $50,000 microscopy set.

As I'm loading it up, my boss looks at me as says "no just make sure no one steals the microscope while you're loading."

I turned to him and said "do you know where we are? No one's going to steal the microscope. I might get shot over the thousands and thousands of dollars of needles I'm moving, but I think the freaking scope is safe."

It hadn't dawned on him that stuff we bought for maybe $50 from Fischer was worth more on the street than a fancy set of optics.

I feel awful for your coworker, hopefully severance and COBRA will help. Lord knows Father in Law is in the same boat with the disabled mother-in-law who takes thousands in meds each year. They're COBRA-ing until it runs out (security of knowing your doctors and pills are covered is better than the potential savings from finding new insurance).

After that we have about an 18 month gap until Mom-in-law is Medicare eligible.

All true, but my point was that this is often (usually) the case even in a real criminal investigation.

Remember that the Duke Lacrosse case was handled by "the real cops" (at the direction of the idiot DA). Their reputations are basically ruined, no matter that the court came back and said "Completely Innocent, we can't believe you actually brought the charges, Mr. Nifong."

And the entire time they were actively proving their innocence, we were being scolded that listening to them and questioning Ms. Mangum's account were "making her relive the trauma" and "making it less likely for the next girl to come forward."

412 Reading the Breitbart article about Lena Dunham's 'rape,' it appears that its not even the classic definition of what constitutes rape (ie, forcible sex). By her account she willingly engaged in sex, just decries how it went.

Him slipping the rubber off or being rougher than she likes has to be viewed as different (if only in magnitude) from what the average conception of 'rape' is, being force, threat, or violence.

Loosening the standard to that degree basically criminalizes anything the female decides to criminalize.

So much of this is fixed if rape is handled by the courts rather than by the schools.

As for schools where the security is police. There needs to be a firewall between the two for criminal cases.

Now admittedly, this country needs to fix it's rape reporting mechanism in general. But the dems are too focused on using "abortion in the case of rape" to mess with the more prevalent on the ground issues that matter.

I agree with everything you said. The situation is insane.

The Right should be able to fight this by demanding colleges take things as seriously as they say and involve the police. Colleges should get out of the sex crime business completely.

The Left defends it by saying the men who are punished (suspended/expelled/etc) aren't being *really* hurt in any tangible way. But with social media now the charges stick around.

Plus there are the feminist sites that let people anonymously list men as rapists. Which is crazy. They let crazies go on and anonymously list men's real names and the "crimes" they've committed.

Good thing is more men are suing the colleges rather than just slink away quietly and hope everybody forgets this horrible false accusation.

428 In TX, the law is "move over or slow down."

It looks like we have something like that...

The Steer Clear law, which went into effect Sept. 8, 2006, requires motorists to move into a lane that is not adjacent to an emergency response area. An emergency response area is an area on or near a road where services are being provided by police, sheriffs, coroners, medical examiners, firefighters, fire police, fire marshalls, rescue personnel, emergency medical service personnel, towing and recovery personnel, hazardous material response team members and/or highway construction and maintenance personnel. If drivers cannot
move over because of traffic or other conditions, they must reduce their speed. In cases where law enforcement may not be present, the law allows road workers and emergency responders to report violations by motorists.
Law enforcement may issue citations based on these reports. Failure to move over or slow down can result in a summary offense that carries a fine of up to $250. In addition, fines will be doubled for traffic violations occurring in work zones areas. If that violation leads to a worker being injured, a 90-day license suspension could result.

439 Feminists just hate the fact that in normal heterosexual sex the male is dominant and the initiator.

They hate the fact that every romantic movie that chicks watch has the Will He or Won't He scene where she looks longingly in his eyes with the Kiss Me, Dammit look and then he grabs her or misses the message and turns away.

This normal fact of heterosexual courtship and sex bugs the hell out of them.

Huh,

Missouri actually has a whacky definition of "Strong Arm Robbery"

A person commits the offense of robbery in the second degree if he or she forcibly steals property and in the course thereof causes physical injury to another person.

Dunno what's considered "physical injury to another person." Does shoving someone count? Does there have to be a bruise?

In any case it's a class B.

To get serious for a moment, I actually think that something of that nature might actually serve a good purpose by serving as a warning to otherwise oblivious New Yorkers that the good times that were initiated by Giuliani and continued, more or less, by Bloomberg are now over and it might well be time for reasonable people to GTFO. The family of my sister in law were Jews in Germany and recognized the indications that, despite the inconvenience and genuine sacrifices involved, it was time to GTFO. And that is why the particular genes that belong to my sister in law exist and were passed on to my nieces.

Now I don't expect that particular form of bad times to occur in New York City but I think it is reasonable to expect that the annual homicide count to rise from ~500 per year during the Giuliani and Bloomberg era to back over 2000 per year as was typical when David Dinkins was mayor. I also think that, given the feckless attitude towards national security displayed by the Obama Administration, there is a reasonable chance that a nuclear weapon will be detonated in NYC and the best defense against nuclear weapons is to be some place else when they go off.

To that end they cave to the vocal.
I think for men in college currently there's a bit of a "Someone Else's problem field" thing happening. While we're all at risk of this happening the crowd you run with matters too. 508 @491 I think the biggest risk isn't a real nuke, but small dirty bombs that contaminate a mile or so within a city.. maybe a little more. The Feds set acceptable rads at such a super-low level, even if it was a relatively small device/yield, the Feds would demand abandonment and /or very expensive clean-up.

Do that in 3 big cities, or three parts of same city, and the desired effect would be achieved. Chaos, panic, fear. The death toll from the bombs would be tiny. Evidently it hasn't been done yet because it's harder to actually do than write about.

I just watched the video. I found it disturbing. The big picture is that we have too many laws that require enforcement. I always go back to my belief that the common law is better than codified law. The common law basically takes care of all known criminal mischief. Its the civil law that has added numerous crimes to the books that do not really endanger the lives of anyone.

559 So much FAIL that it has to be shared.

Nannystaters beg the all-too-willing government to tax cigarettes into oblivion for the children. The government uses the proceeds to buy the votes of the poor. The poor can't afford their vice anymore and resorts to the black market. Government can abide neither competition nor noncompliance , so it dispatches the police as an armed collections agent. Shit gets out of control, so now the nannystaters, the poor, and the government place the blame on some random white guy who risks his life every day for a relative pittance and a small house in Staten Island.

Let it burn.

There are far too many unknowns to really know if the administration acted improperly. I don't think the police were aware until the RS article came out. They should be investigating now.

That being said, the most credible part of the RS article for me is that the UVA administration did nothing. But that may have been entirely justified.

The reporter stated that she set out to do an article about rape at an elite university but she didn't find anything that fit until she spoke with Jackie. So, yes, the reporter was scouring the country and not finding a useful story. You would think that would be the story, much like NBC (or whoever) sending the Muslims out to pray to Mecca at NASCAR races and then spiking the story when nothing happened.

I had forgotten that Rolling Stone was the only media outfit that claimed that the stuff Glass wrote for it was totes true you guys.

You know what's interesting? Every article I've seen that doubts the story says that if it is true then this is a horrible crime and many people need to go to jail for a very long time.

None of those having the vapors about how dare you doubt this are making any kind of statement that you know, if it's false, this is a terrible thing and will be harmful to actual rape victims since they will be doubted now.

650 Who is more fearful of their fellow countrymen, libtards or Tea Party conservatives? I'd offer libtards. They fear the common man, the regular citizen, especially ones that are armed. Libtards demand the Government intercede and control. And the libtards process their fear as contempt for all who do not believe as they do.

Tea Party folks just want to live their lives, under the Constitution and the rule of law. Unfortunately, regulatory agencies have superseded actual law and made their own stuff up and are accountable to no one. Thus,..... Bundy Ranch.

651 Put this girl under oath.

On-the-record comments come from Rachel Soltis, a suitemate of Jackie in 2012, who says, “At the beginning of the year, she seemed like a normal, happy girl, always with friends. Then her door was closed all the time. We just figured she was out.” Soltis is also quoted this way: “The university ignores the problem to make itself look better. They should have done something in Jackie’s case. Me and several other people know exactly who did this to her. But they want to protect even the people who are doing these horrible things.”

669 I'm starting to wonder if it was a matter of the "reporter" being taken in by a story she wanted to be true or if, after scouring the country and not finding a useful story, *she* perpetrated the hoax. Wouldn't be the first time.
Posted by: Polliwog the 'Ette at December 04, 2014 10:59 AM (GDulk)

The story is obviously agitprop, for several reasons.

First, as the "reporter" admits, she chose to investigate UVa because it lacked a "radical feminist culture upending the patriarchy." That's enough to call "bullshit" on her story right there; she admits to having an agenda when setting out. We could stop with this one alone - I'd be intensely skeptical of anything and everything she said from that point on.

Second, the story reads like the product of a creative writing class, because that's probably exactly what it is. Read it again, and notice how the authoress adopts an air of omniscience, knowing what the dramatis personae are thinking and feeling. Hell, by her own admission she doesn't even know who most of the people involved were, yet she knows the thoughts and feelings of her lead character? This isn't a report - it's a script.

Third, some real clangers. As someone pointed out, guys are visual. We like the lights on; women often do not. If a bunch of guys were going to commit a gang rape, I absolutely guarantee any light available would be turned on. Note also how convenient this is. Identify the perpetrators? Nah, it was dark. Just have to go with Jackie's take on events. You know, 'cause it was dark and all. Bullshit.

Fourth, consider the plausibility of a bunch of guys whipping out their todgers and rolling around on a floor covered broken glass, and doing so in the dark. What guy wouldn't love to do that? That scenario sounds like a lesb feminist fantasy to me.

This.

I'm even willing to give benefit of the doubt on the "I recognized them even though it was pitch black" thing. Your eyes do adjust amazingly well to low-light conditions. It's possible it was "pitch black" when she was pulled/thrown in and her eyes adjusted as the assault continued.

Granted that- a lot of the rest of her story still doesn't add up. If you grant her enough "benefit of the doubt" eventually all you're really saying is "we believe you even though the evidence doesn't."

And, still, the safest thing for the University would have been to open a criminal investigation in the first place. Like- "give it to the cops" criminal investigation.

Only the left could simultaneously laud sex week on campus AND kangaroo courts.

Meanwhile, off campus, serial rapists and murderersare often freed on technical grounds and the so-called innocence project sneers at eyewitness testimony.
