Earlier a staffer with the House Appropriations committee said that they couldn't defund amnesty because Customs and Immigration Services isn't funded by the annual appropriations bill. Sean Davis of the Federalist and former congressional staffer tweeted to me this was wrong. He's now written a post calling BS on the claim that Congress doesn't actually have "the power of the purse" over amnesty.They’re correct that USCIS spending is funded primarily by fees collected by the agency, and that the spending is mandatory, rather than discretionary. That means that USCIS does not need annual authorizations to use those fees to offset expenses. This is actually written into the 1882 law establishing the fees and the authority of the federal government to spend them: [Follow link to see excerpt from the law] The only thing that differentiates mandatory and discretionary spending is how often each must be re-authorized. Every single dollar spent by the federal government must be first appropriated by Congress. Just because some spending is not subject to annual appropriation doesn’t mean it’s not subject to appropriation at all. Congress can’t block Obama’s executive order by shutting down the government, but it most certainly can defund it by law.So yeah, don't buy the "we can't do anything about it BS". Unfortunately it doesn't matter. It's all just words. A law is just a bunch of words. The GOPe can defund every damn thing it wants, but it'll do no good. Obama will just carry on merrily breaking the law and daring the GOP to not send out the paychecks.

I'm really confused at this point.
I'm not sure if this is the right hand not paying attention to the left (ISIS crisis vs Amnesty) or if the whole amnesty gig is designed as the final nail in the coffin of the Republic. Work on an immigration bill that simply states that naturalization status for exisiting illegals is entirely dependent on the effectiveness of preventing further illegal immigration. He wants a million naturalized? Fine - he has to deport 1 million first, and get illegal immigration below 50,000 per year.

I may have missed it being explained somewhere, but I don't understand how the power of the purse works without the involvement of the President.
I don't see where Congress can rescind funding legally without an act that must be signed or vetoed by the President. If it's vetoed, the veto has to be overridden. If Congress does only passes partial funding bills, the President and the MSM portray this as shutting down the government. And today and probably into next year, these bills will not reach the President's desk because they will always be one vote short of passing the Senate. It looks like the MSM gives the President enormous power, because they always can slant this. Is there really an end run that works. Is rescission without Presidential involvement doable? The executive can't spend anything unless and until the legislature authorizes it. The executive's veto power acts to strangle his own administration. He can veto a particular authorization to demand an amendment; the legal effect is to deny himself funding. The funding is denied, unless it is approved. This, actually. It's a lot harder (not impossible, but harder) to paint a shutdown as the result of "Obstructionist Republicans" when the Republicans are busy passing funding bill after funding bill. Especially when none of those contain language that does anything TFG doesn't want. Here a bill to fund DoD. There a bill to fund State. Over that way a bill to fund... whatever. You don't even need "poison pills" in any of them (at least, not until most of the government is back up and running). At some point, Democrats are going to realize that the SCOAMT isn't up for reelection in 2 years, but they are. If they're nervous enough in the Senate, we might even get a veto overridden. I agree. Last time the shutdown occurred right before the Obamacare rollout. The public hadn't seen all the destructive elements of Obamacare and did not support what they perceived as a Republican led fight. Now the public has seen Obamacare and they hate it. More everyday. Surely Democrats have been proactive and previously included sufficient funds in the Stimulus package. After all, they included $1 billion in the stimulus package to cover the death panels board.

Sure they can defund it in the House, see the bill get tabled in the Senate, and nothing happens. I don't have any confidence that they will do anything in January, but wait and see maybe?

Money is fungible. The bureaucrats just shift things around and adjust the color of money. To really hit where it hurts - cut SES positions and limit the number allowed within 100 miles of DC. Don't just cut travel budgets, limit the annual total per individual in SES positions.

What a lot of people fail to realize is that most of the Democrat leaders don't really care if they lose elections. Whether they win or lose, their agenda keeps marching on.
If we win in 2016 it still won't matter. Winning then, btw, is an open question. If we have a bunch of new socialist voters, it may not matter if HRC is a lousy candidate. They'll vote for Socialism, because it is what they believe. In any case, unless Americans find some way to get the Socialist lifetime appointees, their army of dug-in bureaucrats and the RINOS themselves out and stop the shredding of the torn and tattered Constitution, this whole lousy program will just keep marching merrily along. I have, as I said before, pretty much given up hope. People bellow and bloviate, make threats and bluster, and nothing gets done. I don't believe anymore that anything will be done before it is far too late. It may be far too late already. I used to want to live forever. Now all I want to do is take care of my responsibilities until they don't matter anymore. Living and vainly hoping that things will be better is heartbreaking. I hate myself for clinging to shreds of hope because it hurts too much to watch everything we had piddled away by our "leaders". the republicans won't do anything about it. the republican party is weak, weak, weak, and between boehner and mcconnell i don't which one is the bigger wimp. neither one of them has any idea what they are dealing with, and niether one of them knows what to do, at least that is what they are feigning. you all know that the republican party has many that support amnesty. for these jerks, the more immigrants the better! they want cheap labor, and they don't really care about the culture, traditions, and history of this nation. as long as they can make a buck, great! they also like obamacare. after all, they won't have to be stuck with it like the rest of us. they will NOT do A N Y T H I N G, and we all knew they wouldn't stand up to obama even as we held our noses as voted for them. we knew that they were progressive-light. as george carlin once noted, "this is the best we can do, folks." these republican leaders are our best and brightest? teh. the republican party is no longer a viable political party at this point, and furthermore, this is no longer a representative republic.
