Well, anyway, all of this is a lead-up to my first suggesting that we come up with a new definition for the word "gruber," and then immediately dismissing my suggestion as probably a bad idea that could backfire.

Two problems with that one, methinks: 1) Gruber was a mere henchman, not the head Red, so it's a bit inappropriate, and 2) in speech it's impossible to tell who you meant.


Semi-OT: At a dinner a German academic who didn't know my background was getting snotty about his university, which I'd never heard of. After he went on for a while, I asked him how he liked Schicklgruber University.

Turns out German academics (and Germans generally) don't have much of a sense of humor. Who knew?

You know...that reminds me of a poll that came out during my 1L year.

Someone did a survey of law professors on the subject of which were the most egregiously wrong con law decisions the Supremes ever made. Surprisingly, even among liberal profs, Roe v. Wade was #1, even above Bush v. Gore (#2) and Dredd Scott.

They all agreed that it had no grounding whatsoever in the the actual Constitution, but they followed up by saying that they would never want it overruled. Apparently, the country was sooo used to it and it was sooo central to the daily life planning of sooo many people, that it had to stay. Because they love the result so much.

Tells you everything you need to know about these smug, lawless asshats. *rant off*

I won't agree that adherence to the Constitution, as written is a losing bet. They are the rules. If the very idea of written law is dead, political differences will just have to be solved the traditional way: by murder. I'm not going to agree with that yet. I was (perhaps too cryptically) trying to say that we should be very, very leery of saying that we are no longer hopeful of enforcing the written Constitution, as a justification for embracing extra Constitutional (outside the law) solutions.
One reason for this, I think, is that if our Republic as constituted fails, it may be a very long shot to get anything even close to its values again, however much our Constitution and laws are being trampled on today.
In other words, I'm still a member of the Dont Let It Burn faction
