No, DSS is waiting for OPM to finish my 5 year clearance re-up. Thanks to Snowden and USIS, OPM's backlog is apparently ridiculous. But CFPB balked, telling the court that the bureau has an inherent right to "nondisclosure" and that "even the disclosure of purely factual material may be protected by deliberative process privilege."

The CFPB added that "requiring the bureau to designate any individual to appear at deposition would only serve to annoy, oppress, and cause undue burden on the bureau."

Morgan Drexen fired back, telling the court that "as a civil litigant, CFPB cannot hide behind privilege to avoid basic discovery."


Of course, I'm sure the CFPB wanted to shoot back with, "Why not? The DOJ did it with those Fast and Furious docs for YEARS."

The Electronic Frontier Foundation has published a remarkable letter this morning in which the Department of Justice admits its lawyer misled a panel of judges during oral arguments last month over the legality of National Security Letters, or NSLs.


To the surprise of some observers, during his rebuttal, Justice Department lawyer Douglas Letter told the three judges that recipients of NSLs could, in fact, speak about the letters in general terms. They could discuss the fact that they had received a letter and could engage in public debate about the "quality" of the NSLs they had received, he said.


But actually, they can't. Letter's statements contradicted longstanding policy, and EFF apparently asked the DOJ for clarification. The result is that DOJ has sent a note to the Clerk of Court for the 9th Circuit to correct the error, clearing up "an inadvertent misstatement by government counsel during the rebuttal portion of the argument."


Companies are only allowed to talk about their receipt of NSLs and other "national security processes" in "bands." For instance, Google reports having received between 0 and 999 NSLs each year. Alternatively, a company can say it's in a "band" of 0 to 249 if it uses a more vague description category. [...]

I'm pretty sure the vast majority of applicants had no moral compunction about that. (Nor did I, I just don't want to be disbarred.)

I'm pretty sure the government did its usual stellar job in vetting the applicants and the vast majority of CFPB lawyers have a year of document review experience at best, but lied about their experience and it is common knowledge within the agency that they are winging it.

This would make an interesting FOIA request.

The patient is a Sierra Leonean national who is a permanent resident of the United States and lives in Maryland, AP reported, citing an anonymous source. He reportedly was working at Kissy United Methodist Hospital in Freetown, Sierra Leone, when he came down with Ebola symptoms on Nov. 6.


He tested negative for the virus at that time, AP reported. When he was tested again on Monday, the results came back positive.

My wife is Danish and has always worn a Thor's hammer pendent, but that's not uncommon in Scandinavia. Her view on people who call themselves Asatru is a little dubious, especially non-Scandis.

I used to love when the tourists left in the Fall, and I'd go down to the General Store in the morning to grab my coffee and a paper. Then off to the beach to check out the gulls.

I certainly love the idea of it, but it doesn't make a whole lot of sense to me in modern times. I'm guessing Asatru don't think Thor is angry when it storms out, or that he is going to be killed be Jörmungandr the world-serpent, kicking off Ragnarok.

The pond that my house was on connected to a tidal marsh and then to Cape Cod Bay. Go there are 5 am on any given day and you'd think that the earth was made only for you.

The great thing about any polytheistic religion is that it makes the gods subservient to Nature, which means they can't really Judge you like the God of the Jews and Christians will.

The gods of polytheistic religions tend to be Human only more so- they do all the dark things we *wish* we could get away with. Even the Aesir (the Norse gods) would be considered scum of the earth if we knew them as people. Constantly lying to each other, cheating, stealing...

It's nice to be able to look at (say) a sunset or a thunderstorm and think of "the works of the gods," and then turn around and cheat on your taxes or renege on a promise and not have any nasty God who's going to judge you.

Bayside is also lovely. I'm a fly fisherman, so I've crawled around pretty much every inlet on both sides. Jeebuz, salt marshes are beautiful.

One thing MA has in rare abundance is access to the water, which means you can get away from crowds. This summer, before the endumpening, the Evil Sex Queen and I walked a couple of miles from Head of the Meadow and had the place to ourselves for a frolic in the middle of the day.

I'm in CT now. No way that happens here or in RI.
