Everyone I know knew government health care would be a film flam from the start without all of his clever machinations. Gruber is an economist criminal by his own admission. If he really wrote this law and wrote in such a way as to intentionally deceive, can he be sued in a class action?

2. Deny knowing the guy.

3. Defend the statement by saying the statement doesn't say what the statement says. Gruber wasn't calling the voters stupid, he was calling some few senators stupid and that was the only way they could get the bill passed.

4. Deny defending the statements made by changing the subject. The Democrats didn't know what was going to be in the bill until everyone had finally agreed to what would be in the bill and they wouldn't know what was going to be in the bill until the bill actually passed.

4. Once the bill has passed, no one knows how it is actually going to work, so blame the computer programmers for bad code. Don't blame the bill for logical inconsistencies because once the bill passes the politics don't matter.

5. If you get stuck, admit that you knew the guy and thought he was pretty smart, but that was like five years ago and people and situations change and if you had known back then what you know now you wouldn't have done it that way, but since you did, now all you can do is what is best to make the program work and stop worrying about how it was passed.

This law was written a long time ago and it's been sitting in a drawer somewhere just waiting for the right circumstances. What they were all cramming and fumbling over were all the tweaks and edits to bring it up to modern times.

Hence all the errors like the lack of a severability clause.

These evil cockroaches plot and wait and wait and plot until they can do the damage, for which the GOP never undoes but merely "manages better."

Jen - two corrections re CA concealed carry case (guess that would be "CACCC"!). One, 9th Circuit may still re-hear Peruta case (case in question), and has already been petitioned to hear appeal on two other cases that incorporated Peruta decision, thus opening up chance that Peruta will be reversed in the course of those appeals (this also leaves out possible upward appeal of all these cases to SCOTUS). Two, Peruta case didn't challenge constitutionality of CA statute, but instead constitutionality of San Diego County application of same (basically, definition of "good cause" to carry).

So - as I said in last night's ONT comments, be careful of spiking the ball on the 5 yard line. I believe that's what we'd be doing if we assume Peruta (good decision) is over.
