Why then would Bush sign that? Remind yourself that Bush was an enormous amnesty proponent from even before he was in office, and he tried to sneak amnesty through every single year he was in office, without fail. So, when this bill showed up on his desk, literally in the last three weeks of his Presidency, when everything was quiet, half the staff had left already, and no one was paying attention to him any longer (media focus having shifted to the ridiculous "Office Of The President-Elect"), it appears that Bush had a moment. A moment where he realized that, yep, this was a stealth amnesty enabling bill. But it was one last chance for him to contemptuously flip the bird to the anti-amnesty people who had been blocking him for eight straight years. So he went on and signed the thing. What needs more focus is the role of Mexico in this. The illegals in question are crossing Mexico's southern border and travelling 1,000 miles. This couldn't be happening without Mexico letting it happen, and it's been escalating over the last two years. From what I hear, Mexico is usually strict in how it handles illegals. So why hasn't our President been calling Mexico to account? This puts the lie to the spin that this isa human refugee problem. The law Bush signed didn't apply to Mexican illegals and presupposed that the White House and Mexico wouldn't conspire to open the floodgates from the rest of Central America.

Answer is pretty easy to this one: it's the difference between not enforcing a law, and taking an affirmative action contrary to law. Deportation is a legal procedure and an immigrant would have the right to petition a judge if Obama was deporting someone in violation of a law. There's no standing for the rest of us taxpayers when Obama fails to enforce the law regarding the border.

The way I read (skimmed over) the law is that they have 48 hrs to determine if they're the victims of "severe" trafficing, but if they are unable to do so the non-Mexican minors are placed into HHS custody. It's not just that Obama has the de facto power not to enforce the asylum hearings law, it is that he has to positively violate the supreme law of the land in order for this even to be an issue. Beyond his general duty to "take Care that the Laws be faithfully executed" (Article II section 3), he is also required by the Article IV section 4 "guarantee clause" to enforce the borders, at least from any large scale illegal incursion:
"The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence." It is only because of Obama's refusal to enforce the border that these unaccompanied children are here in the first place. By granting "permisos" to asylum hearings he is actually encouraging the invasion that he is enabling and he might be successfully sued by the invaded states. At the least they ought to undertake their own border enforcement and use Obama's refusal to enforce the laws and protect them from invasion as their justification. AZ was semi-successful in its legal defense of previous measures to enforce the border and Obama's collapse-the-border gambit changes the legal circumstances much in their favor. Keep in mind that in the past, a typical year usually saw no more than 5,000 UACs cross the border. Yet somehow the Obama administration began planning, years ago, for a dramatic, unprecedented, and sudden flood of illegal alien kids.

Initially, over 90% of the illegal aliens were reporting that they had come here because they'd been told they'd get amnesty ("permisso") if they did. Only after there was a public backlash did they start claiming that they'd come here because they were "afraid." They have been coached by the people responsible for this invasion (LaRaza, Obama admin., etc.). It's the same as when the illegals were marching in the streets a few years ago, waving Mexican flags and demanding amnesty. The coverage pissed off Americans, and the word went out to carry American flags instead. Now every amnesty march/parade features lots of illegals carrying American flags. Daily Caller has interesting commentary on a Major Garrett story about a recent private meeting Obama and ValJar had with immigration advocacy groups. A close reading shows that Garrett was used to spin that Obama was pissed at Republicans and would use his executive powers to fix all the problems including "to secure the border." As if the Republicans are responsible for not securing the border. Mehthinks Obama's plan is to say that if the Republicans don't give Obama $2 billion (which will be used to permanently resettle recent illegals) he'll say that he was denied the funds necessary to secure the border.
What's interesting is the groups that were at the meeting. Center for American Progress! Which just posted to its website a glossy 42 page report on "What the President Can Do on Immigration If Congress Fails to Act." Also present were the SEIU and the AFL-CIO. I would have thought that an open Mexican border is not in the interest of the dues-paying members of these unions. What am I missing? La Raza was not invited only because its President had dissed Obama by publicly calling him the Deporter-in-Chief for not having acted unilaterally without Congress back in March. I took a quick look at the Center for American Progress paper "What the President Can Do on Immigration If Congress Fails to Act." This was obviously co-ordinated with the White House and is a road map to what we can expect from Obama. In addition to just not enforcing laws ( "The executive branch has virtually unfettered discretion in deciding how and whether to enforce the law against individuals.") it promises to expand "deferred action" beyond DACA "to other individuals with compelling equities ... as the lawful, just, and necessary response to a crisis."So never waste a crisis, and if you need to .... create a crisis. The CAP paper also pointedly repeats the misleading Homeland Security statistic that over 2 million have been deported under Obama's watch. That's because Homeland Security started counting those turned back at the border as deportations.
