Lois Lerner's Hard Drive "Crashed" Ten Days After House Ways & Means Chairman David Camp Made His First Inquiry About Targeting Conservatives
The timing is not merely suspicious, it is damning.
[T]he alleged disappearance of Ms. Lerner's hard drive—and the fact that the missing conversations are those the former IRS director had with people outside the IRS—has suddenly resurrected, with force, the explosive possibility that she was chatting with Democrats who mattered. There's plenty of reason to believe she was. Just last week Congress discovered (via a subpoena to the Justice Department) emails showing that Ms. Lerner had conversations with Justice prosecutors about investigating conservative nonprofits. Who else in the Obama administration was Ms. Lerner talking to?I'm omitting all of the correspondence between Lerner and Congressional Democrats -- but check the piece to refresh your memory. Here's the chronology of this "crash:"
As to Ms. Lerner's behavior, consider that House Ways & Means Chairman Dave Camp first sent a letter asking if the IRS was engaged in targeting in June, 2011. Ms. Lerner denied it. She engineered a plant in an audience at a tax conference in May 2013 to drop the bombshell news about targeting (maybe hoping nobody would notice?). She has subsequently asserted a Fifth Amendment right to silence in front of the only people actually investigating the affair, Congress. Now we learn that her hard drive supposedly defied modernity and suffered total annihilation about 10 days after the Camp letter arrived. Is there something in those lost emails? The fact that they are "lost" at all probably answers that question.This isn't the only issue of suspicious timing in BOLOGate. IRS Commissioner John Koskinen knew in February that Lois Lerner's hard drive had "crashed" -- but did not inform Congress until last week. Worse yet, he has repeatedly told media outlets that he only knew of the crash in "late spring." Furthermore, a Treasury letter from April (repeatedly referenced by Rep. Brady) states that that department agreed with the IRS that Congress should be informed as soon as possible. And yet Koskinen did not inform Congress until last week. Koskinen's defense for what appears to be perjury or at least withholding critical information from Congress is this: I knew about the hard drive crash, but I didn't know that emails would be irretrievable (and he maintains he doesn't know if they can't be retrieved), so I didn't tell you because I didn't want you jumping to unwarranted conclusions.
"So why did the IRS inform the Executive Branch agencies, the White House, the administration, but kept it secret from the Congress, who was conducting an investigation?" Camp asked. "We were not keeping it a secret," Koskinen said. "It was our public report to you that has in fact provided you this information, there’s been no attempt to keep it a secret. My position has been, when we provide information, we should provide it completely. If we provide you incomplete information, people sometimes are tempted to leap to the wrong conclusion, not based on any facts, so we thought it would be important to give you the full description--"That is so perfect! That is a perfect encapsulation of the Ruling Class mentality. That's why the media refuses to report on Gosnell's house of horrors, or the ethnicity of a terror suspect: Because we don't want You, those of inferior minds and low impulse control, to draw the Wrong Conclusions, so we shelter your tiny, emotional, violent brains from information that might cause you to Think Wrong Things.
"It’s okay for the White House and Treasury to leap to a conclusion six weeks before the Congress," Camp shot back.But of course it is! The White House and Treasury, being staffed by those correctly-educated in The Right Conclusions, and fully fluent in the habits and preferences of the Ruling Class, can be trusted with information that might lead to Dangerously Wrong Ideas if permitted to be exposed to The Lesser. At the Fiscal Times, Ed Morrissey writes of another case of suspicious timing.
The closest insinuation between the IRS targeting scandal has been an unusual meeting between the IRS' chief counsel, William Wilkins, and Obama on April 23, 2012. The chief counsel for the IRS would have no discernible reason for a private meeting with the president; his job would be to brief the IRS commissioner --at the time Douglas Shulman --who met with Obama the very next day. The day after that, Wilkins sent a revised set of guidelines to Lois Lerner for the tax-exempt unit to use when applying extra scrutiny. To this day, no explanation for this meeting has been made public, even though records show that Wilkins spent hours at the White House with "POTUS" as his host. Nor was this the first time that Wilkins appears in the targeting narrative. Carter Hull, a retired high-ranking IRS official with 48 years’ experience at the agency, testified that after he approved a Tea Party-related tax-exempt application, it got routed to Wilkins rather than finalized.The day after an unusual meeting of a mid-level manager and the President, the mid-level manager issues revised targeting guidelines to the IRS, and we're supposed to believe those guidelines were not the subject of discussion between the President and the manager? This is outrageous. It is outrageous that Obama refuses to appoint a special prosecutor, and it is even more outrageous that only one member of the leftist media that I know of (National Journal's Ron Fournier) has troubled himself to call for one.

Depsite The White House attempts to physically destroy any disk which contained the bits and bytes of those emails, you just KNOW they still exist somewhere. Most email servers have automatic backups every night. They've have to go around with a sledgehammer to server farms all over the East Coast if they REALLY wanted to extirpate the evidence.

I would write up a few dozen fake emails that say everything that we think they are saying, and release them to the media. Claim that a computer whiz was hired, and was able to retrieve some emails off a server somewhere, and more were to follow. If Lerner and the other twits exclaim that they never wrote those emails, then make them prove it.

The media I ignoring the IRS story no matter what new evidence comes up. The IRS is stonewalling and will continue to do so because no one has the balls to lead a decent investigation. The only way a hard drive crash would cause the loss of her e-mail is if she was using a personal account and storing them in a personal file like an Outlook .pst file and not going through IRS servers. I don't believe that IRS has only a 6 month retention period. Congress needs to get some IT experts to help them. They also need to get the IRS IT staff under oath.

Being unable to access the HQ comments from work has been very frustrating as I watch this play out.
At work, I'm saddled with some networking of minimal competency infrastructure, which I am officially supposed to use for as much work as possible. Unlike Ms. Lerner, I don't have the luxury of a 500 MB mailbox, but am allowed only 25 MB; when my Inbox nears that size, I start to get nasty messages warning me that I either need to delete or archive e-mails, should I ever wish to receive an e-mail again.
So, I have to pull my e-mails out to a local file.
Now, the NetMinCompInf folks have a little mercy on me, and give me a space on a network server where I can stash files secure in the knowledge that they are backed up.
I have a whole 700 MB of network storage that is backed up and maintained by the IT folks.
Which is a joke. I looked at my working directory the other day, and see that I have about 30GB of stuff that I need on hand for work. 700 MB is nothing.
Couple that with a draconian policy against removable storage and I have no effective way of backing up the machine on which I am officially supposed to do as much of my work as possible.
Fortunately, I have an out. As a developer, I have an alternate seat that is managed by local IT folks. That machine is backed up and I have a much larger network storage playground to securely stash things. But I can't get my e-mail there.
Consequently, I use my NetMinCompInf station for e-mail, because I have no choice, but do all my other work on my alternate machine.

But I do want to know why someone has not brought up the failure to abide by federal law (on several levels) here as noted above. You failed to back up your data as required? I suggest you get your vehicles converted to run on natural gas. If shit goes sideways it is likely the only way you will be able to get fuel.
If shit doesn't go sideways, it will still save you a lot of money on fuel costs.

Perhaps other people have said this, but IRS employees with a computer problem normally submit a help request to desktop support (a "MITS ticket"). It would be interesting to see that paperwork and interview the MITS persons who handled Ms. Lerner's help request.

The hard drive issue is certainly a head fake. Emails are stored principally on a server. You can download them to your hard drive, which can become corrupted. Hard drives fail and be tossed. But the emails are still on the server, and can be downloaded again. This is how a company protects its data.
If they used Google servers, Google presumably has the data. If they used in-house servers, ditto. The NSA may have metadata at least and content at max. Subpoena all of this.
Am I missing something? This seems straightforward.

Hard drives still crash. Some last forever, and some don't. This is why all servers have redundant drives, hot swappable drives, and tape back up.
There has been a LOT of work on improving them, but to me it still seems like the luck of the draw as to when it will crash. Maybe you have just been lucky.

Hard drives still crash. Some last forever, and some don't. This is why all servers have redundant drives, hot swappable drives, and tape back up.
There has been a LOT of work on improving them, but to me it still seems like the luck of the draw as to when it will crash. Maybe you have just been lucky.

Hammering the IT department is probably the way to go. Woodward had a point, that Lerner is locked down tight and won't talk; you have to start going after people around her.
The IT guys are not being paid anywhere near enough to be infamous. They will want future employment, as IT guys. They will not raise their right hand and swear they just sucked at their jobs.
The whole cover up at this point is, "we can't comply with the law because our IT is just usually, regularly careless and third-rate". Get IT under oath and on camera, and have the bosses try to explain why they ordered IT to destroy rather than save.

Standard settings in an Exchange server limit your mail box size in Message Store.
When you hit your limit, Mail is then archived via your Outlook, to a PST or OST file, on your local hard drive. Outlook can be set to do this automatically, via a 'rule', for mails older than a certain time period... or you can do it manually.
In a good IT environment, that PST or OST is on a network drive.... or share... and thus stored on the server for backup.
Sounds like that was not done.
Now.... in my IT company? we only limit low level employees as to storage on the server mail store... if we are archiving we always use a network share for those files... so we can recover...
The real problem, is that there is also supposed to be a 'paper' copy of all important emails... but the IRS apparently left that up to the individual user to do.... by policy.
Thus... its entirely plausible to me (35 years in IT) for a very sloppy IT dept, ruled by very bad Policies from above... to have allowed the only copy of her emails to be on a single drive....
Now... to totally destroy that drive? Almost impossible.... unless you hit it with a hammer, or a very large magnet...
We can recover files that have been overwritten a few times... rebuild format and file tables...and even if needed move the disk itself into another Case...
Problem is, that they say the disk is now gone, after they tried to recover the data... which is very sloppy if they KNEW people were going to be looking at this issue.

I worked for a hosting company a few years back and we were responsible for backing up and archiving data for medical and financial firms (among others), and I can tell you that what the IRS says happened to their data would have been absolutely impossible under our data management model. Officials in Campbell, Wisconsin, have placed police chief Tim Kelemen on leave after he admitted using a Tea Party activist's name and email address to create accounts on pornographic, dating and insurance websites from both his home and work computers. Kelemen was apparently upset that Tea Party activists have protested and filed a federal lawsuit over the city's decision to bar political protests on a pedestrian walkway on Interstate 90.

For these people the law is what they say it is. Not for you, but for them, they are above the law.

Because the IRS is in court in every state in the union on every day of court. IF the laxity described were true, those cases would have been blowing up for the past two years.
All it would have taken is for one instance of failed discovery to not only reveal the poor management, it would have given every tax lawyer a cause for dismissals.
Those rules and regs that the IRS and other agencies have to follow are to make sure their prosecution and regulation of us peons sticks in the courts.
Permanent self-interest here guarantees that what they describe is bullshit.
