Lois Lerner's Hard Drive "Crashed" Ten Days After House Ways & Means Chairman David Camp Made His First Inquiry About Targeting Conservatives

The timing is not merely suspicious, it is damning.

[T]he alleged disappearance of Ms. Lerner's hard drive—and the fact that the missing conversations are those the former IRS director had with people outside the IRS—has suddenly resurrected, with force, the explosive possibility that she was chatting with Democrats who mattered.

There's plenty of reason to believe she was. Just last week Congress discovered (via a subpoena to the Justice Department) emails showing that Ms. Lerner had conversations with Justice prosecutors about investigating conservative nonprofits. Who else in the Obama administration was Ms. Lerner talking to?

I'm omitting all of the correspondence between Lerner and Congressional Democrats -- but check the piece to refresh your memory.

Here's the chronology of this "crash:"

As to Ms. Lerner's behavior, consider that House Ways & Means Chairman Dave Camp first sent a letter asking if the IRS was engaged in targeting in June, 2011. Ms. Lerner denied it. She engineered a plant in an audience at a tax conference in May 2013 to drop the bombshell news about targeting (maybe hoping nobody would notice?). She has subsequently asserted a Fifth Amendment right to silence in front of the only people actually investigating the affair, Congress. Now we learn that her hard drive supposedly defied modernity and suffered total annihilation about 10 days after the Camp letter arrived.

Is there something in those lost emails? The fact that they are "lost" at all probably answers that question.

This isn't the only issue of suspicious timing in BOLOGate. IRS Commissioner John Koskinen knew in February that Lois Lerner's hard drive had "crashed" -- but did not inform Congress until last week.

Worse yet, he has repeatedly told media outlets that he only knew of the crash in "late spring."

Furthermore, a Treasury letter from April (repeatedly referenced by Rep. Brady) states that that department agreed with the IRS that Congress should be informed as soon as possible. And yet Koskinen did not inform Congress until last week.

Koskinen's defense for what appears to be perjury or at least withholding critical information from Congress is this: I knew about the hard drive crash, but I didn't know that emails would be irretrievable (and he maintains he doesn't know if they can't be retrieved), so I didn't tell you because I didn't want you jumping to unwarranted conclusions.

"So why did the IRS inform the Executive Branch agencies, the White House, the administration, but kept it secret from the Congress, who was conducting an investigation?" Camp asked.

"We were not keeping it a secret," Koskinen said. "It was our public report to you that has in fact provided you this information, there’s been no attempt to keep it a secret. My position has been, when we provide information, we should provide it completely. If we provide you incomplete information, people sometimes are tempted to leap to the wrong conclusion, not based on any facts, so we thought it would be important to give you the full description--"

That is so perfect! That is a perfect encapsulation of the Ruling Class mentality. That's why the media refuses to report on Gosnell's house of horrors, or the ethnicity of a terror suspect: Because we don't want You, those of inferior minds and low impulse control, to draw the Wrong Conclusions, so we shelter your tiny, emotional, violent brains from information that might cause you to Think Wrong Things.

"It’s okay for the White House and Treasury to leap to a conclusion six weeks before the Congress," Camp shot back.

But of course it is! The White House and Treasury, being staffed by those correctly-educated in The Right Conclusions, and fully fluent in the habits and preferences of the Ruling Class, can be trusted with information that might lead to Dangerously Wrong Ideas if permitted to be exposed to The Lesser.

At the Fiscal Times, Ed Morrissey writes of another case of suspicious timing.

The closest insinuation between the IRS targeting scandal has been an unusual meeting between the IRS' chief counsel, William Wilkins, and Obama on April 23, 2012. The chief counsel for the IRS would have no discernible reason for a private meeting with the president; his job would be to brief the IRS commissioner --at the time Douglas Shulman --who met with Obama the very next day.

The day after that, Wilkins sent a revised set of guidelines to Lois Lerner for the tax-exempt unit to use when applying extra scrutiny. To this day, no explanation for this meeting has been made public, even though records show that Wilkins spent hours at the White House with "POTUS" as his host.

Nor was this the first time that Wilkins appears in the targeting narrative. Carter Hull, a retired high-ranking IRS official with 48 years’ experience at the agency, testified that after he approved a Tea Party-related tax-exempt application, it got routed to Wilkins rather than finalized.

The day after an unusual meeting of a mid-level manager and the President, the mid-level manager issues revised targeting guidelines to the IRS, and we're supposed to believe those guidelines were not the subject of discussion between the President and the manager?

This is outrageous. It is outrageous that Obama refuses to appoint a special prosecutor, and it is even more outrageous that only one member of the leftist media that I know of (National Journal's Ron Fournier) has troubled himself to call for one.

Most email servers have automatic backups every night. They've have to go around with a sledgehammer to server farms all over the East Coast if they REALLY wanted to extirpate the evidence.

The follow-up questions to Koskinen's laughable explanation could take days just to ask:
Provide the written IRS protocols and federal regulationsregarding document retention describe in detail how IRS documents are to be backed up and stored, and providethe names of all IRS employees (2009--present)responsible to ensure such protocols are followed.
Describe in detail how the IRS protocol was followed (or not followed) vis a vis the "crashed" hard drives. Provide the names of everyone whowas informed about the "crashes"; the date and time each was informed; and describe/provide all communications with them regarding the "crashes."
Describe every step taken to retrieve the data from the "crashed" hard drives.
Identify everyone involved with "recycling" the hard drive; describe when,Describe in detail when, where, and how the hard drives were"recycled" and provide alldocumentsreferring to the destruction or recycling of the hard drives.
Just the tip of the iceberg.

The Law was written with no teeth.

The only penalties for not keeping the data? During Discovery for a Trial, a Judge can sanction you, with Fines, or contempt of court..

But a fine to the IRS??? and we've seen what Contempt of Court, or Congress, means to this admin...

Otherwise? there is no penalty within those laws...

And the IT guys were most probably following Policy written by those above them... who are of course other faceless Government workers...

At work, I'm saddled with some networking of minimal competency infrastructure, which I am officially supposed to use for as much work as possible. Unlike Ms. Lerner, I don't have the luxury of a 500 MB mailbox, but am allowed only 25 MB; when my Inbox nears that size, I start to get nasty messages warning me that I either need to delete or archive e-mails, should I ever wish to receive an e-mail again.

So, I have to pull my e-mails out to a local file.

Now, the NetMinCompInf folks have a little mercy on me, and give me a space on a network server where I can stash files secure in the knowledge that they are backed up.

I have a whole 700 MB of network storage that is backed up and maintained by the IT folks.

Which is a joke. I looked at my working directory the other day, and see that I have about 30GB of stuff that I need on hand for work. 700 MB is nothing.

Couple that with a draconian policy against removable storage and I have no effective way of backing up the machine on which I am officially supposed to do as much of my work as possible.

Fortunately, I have an out. As a developer, I have an alternate seat that is managed by local IT folks. That machine is backed up and I have a much larger network storage playground to securely stash things. But I can't get my e-mail there.

Consequently, I use my NetMinCompInf station for e-mail, because I have no choice, but do all my other work on my alternate machine.

They can't fall for every focus group tested catchphrase that let's them maintain the status quo after each failure and scandal. Or worse, use failure as a perverse incentive to collect more of our money.

Until people understand that the incentives and accountability are not the same in a system where the customers are forced into it, we can't get anywhere positive.

Of course these guys are going to brazenly crap on defenseless citizens. Because they can.

The hard drive issue is certainly a head fake. Emails are stored principally on a server. You can download them to your hard drive, which can become corrupted. Hard drives fail and be tossed. But the emails are still on the server, and can be downloaded again. This is how a company protects its data.

If they used Google servers, Google presumably has the data. If they used in-house servers, ditto. The NSA may have metadata at least and content at max. Subpoena all of this.

Am I missing something? This seems straightforward.

So 2009 - Q3 2010 would still be gone.

* A laptop makes a crashing sound when it hits the floor, so this probably doesn't need scare quotes.

Hard drives still crash. Some last forever, and some don't. This is why all servers have redundant drives, hot swappable drives, and tape back up.

There has been a LOT of work on improving them, but to me it still seems like the luck of the draw as to when it will crash. Maybe you have just been lucky.

When I visited Palermo last year, I took it for granted that there would be a Chabad House in Palermo. They are pretty much everywhere.

There wasn't. But there is an old Synagogue there that dates back to the 15th century. A large beautiful, historic building. It too, is now a mosque.

Standard settings in an Exchange server limit your mail box size in Message Store.

When you hit your limit, Mail is then archived via your Outlook, to a PST or OST file, on your local hard drive. Outlook can be set to do this automatically, via a 'rule', for mails older than a certain time period... or you can do it manually.

In a good IT environment, that PST or OST is on a network drive.... or share... and thus stored on the server for backup.

Sounds like that was not done.

Now.... in my IT company? we only limit low level employees as to storage on the server mail store... if we are archiving we always use a network share for those files... so we can recover...

The real problem, is that there is also supposed to be a 'paper' copy of all important emails... but the IRS apparently left that up to the individual user to do.... by policy.

Thus... its entirely plausible to me (35 years in IT) for a very sloppy IT dept, ruled by very bad Policies from above... to have allowed the only copy of her emails to be on a single drive....

Now... to totally destroy that drive? Almost impossible.... unless you hit it with a hammer, or a very large magnet...

We can recover files that have been overwritten a few times... rebuild format and file tables...and even if needed move the disk itself into another Case...

Problem is, that they say the disk is now gone, after they tried to recover the data... which is very sloppy if they KNEW people were going to be looking at this issue.

The last time I encountered a failing hard drive I was able to boot the machine from a USB thumb drive into linux. The drive was still readable enough to extract files from it.

In fact, I have a hard drive to USB cable, so if worse comes to worse, I can remove the failing drive and hook it up to another machine to do diagnostics and run the check disk on it, and recover files that way.

What I'm reading from this, no only is the IRS IT crew incompetent, they're so very incompetent that they're not doing routine backups of very important people's computers.

I have a number of windows machines. I don't back them up, but users understand that, and that they should keep copies on USB drives, and I also encourage them to sync that up with the main file server (which IS routinely backed up). But there are some people who are Very Important, and their windows machines get backed up routinely.

Maybe I'm just paranoid. Maybe I'm just super competent. Maybe I should be the IRS' next CIO?

IT will just say they were following SOP; which was to keep a data tape for 6 months before rotating them back into use, there by recording over the data.

That LT back-up for reporting purposes was suppose to be done voluntarily by each IRS employee on their local HDD. Which was somehow "lost" completely because of a bad sector... BS in it's own right.

The IT angle left to pin down why they couldn't recover any data from the HDD -- what seemed to be wrong with it. Very few things outside of a several pass random wipe (think DBAN) or magnetic degaussing can remove all the data entirely from an intact HDD platter beyond any part being retrievable.


Realistically, I think they successfully burnt the 16-minutes so to speak. We need another, perhaps unexpected angle to come into play here. This will be fuel that hopefully turns enough new eyes on the topic that maybe an email leaked from the administration or campaign comes to light, etc.

Also: a disk doesn't fail all at once, with no warning. If you're paying attention, you'll know when you're having disk issues.

The best and most noticeable symptom is that suddenly your computer is ridiculously slow. Barring a large infestation of malware, this is usually caused by the drive trying to read a file, and then trying and trying and trying, and your application seems like it's hung.

If you were found by the IRS to be destroying evidence to cover up a crime you would be in prison.

That would be comforting, because it means it could be fixed within a few years. I'm afraid this is so entrenched in the culture that it kinda just happens unless someone in leadership wants it to stop.



There may be coordination, but all that would be needed is a wink and nod, an even that isn't necessary.



When there is corruption or waste in a business, a leader might just lay down a task. A normal scenario for a business, when margins are shrinking or a rough quarter is coming, is to have a leader say "you're tasked to save X million dollars". Then it quickly funnels down the hierarchy and people implicitly understand the savings is going to happen the nice way or the not so nice way, and people start challenging the ways things are done. There might have been things that bothered people before, but there was never a compelling need to change until now.

They have outside pressures.


These bureaucrats don't have that. They can lay booby traps any time someone sniffs around and questions their value. It's on the taxpayers dime anyway, and where are the gonna go? They can screw up, screw people over, go over budget, or whatever and actually say it's messed up because they were underfunded.

That describes almost everybody, and in the public sector incompetence is 10x what you find in private sector, we all know this.

It's a designed in buffer, truly. And for those who understand technology, rules and congressional investigations such as this, easy to design a defense strategy.

My problem with believing this is that they are constrained by law to ensure that this data is protected, and I'm not away of a time limit on that constraint, but if there is a limit, my bet it is not less than 50 years.

I can't imagine that they would not be in compliance with this constraint especially in the IRS where data management is a key function of their existence.

Sorry, but having been up close and personal with my own special IRS agent the past several months - I believe as easily as they can find a receipt of mine from 2009 and try to trick me into saying something different about it - they can just as easily make anything to do with those emails disappear.

Their jobs - which they pride themselves on is knowing where everything is, and how to get it.

Will it be damning that there's a chain of coincidence that makes winning the lotto look like a morning shower? You bet. So what are we going to be able to do about it? They're daring us knowing we're completely impotent.

But not as much as the NAS software not reporting SMART error codes. Or not turning on SMART as the default.

That's a problem with complex systems, it is so easy to turn of or not turn on the right bits that otherwise would say "hey, there's a problem with node 0, disk 0".

I was just doing some one-off research and came across FreeNAS. Oh, my, verrrrry nice. Based on FreeBSD, includes Sun's ZFS file system. Note to self: build a FreeNAS system at work, and probably at home, too.

Because the IRS is in court in every state in the union on every day of court. IF the laxity described were true, those cases would have been blowing up for the past two years.

All it would have taken is for one instance of failed discovery to not only reveal the poor management, it would have given every tax lawyer a cause for dismissals.

Those rules and regs that the IRS and other agencies have to follow are to make sure their prosecution and regulation of us peons sticks in the courts.
