25 I missed the thread yesterday evening regarding the loss of free speech by Mark Steyn. I did want to make a comment as to exactly what constitutes "free speech" in the US. This is one of the most misunderstood areas of Constitutional law in the US.


First off, the first amendment to the Constitution only applies to government bodies. Originally this was only the federal government, but since then it has gradually morphed into all government bodies. It does NOT apply to private individuals or companies. It also does not apply to ALL speech. So what does this all boil down to as a practical matter?


No government body can censor your speech, or in most cases punish you for it, except for limited cases in public schools where the need to maintain a school environment outweighs the speech.


Speech which is NOT protected from government interference are things like threats, illegal activities, incitement to riot, obscenity, divulging classified info, and a few other categories.


As for free speech at work and among other non-government entities, it is not protected at all. Someone can sue you at will for just about anything, as Mark Steyn is finding out from he who shall not be named. And if you call your boss vile names get ready to collect your pink slip and you have no recourse.

Problem 1: Dr's office moved across town to a location it took me 45 min to find.
Problem 2. After finally finding the correct building office was locked.
Problem 3: Called Dr and got nurse. My appointment had been moved to the 24th at 2:30 pm. With this Dr that means I may get to see him at 5:30 pm.


Problem 4: After waling all over the huge medical complex to find the office, it took me another hour of walking to find my car in one of the many parking garages.

I was PISSED when I got home from this wasted trip that is an hour in each direction from my house.

That's the closest you've ever been on getting a Common Core story right. SC is not dropping out of the Common Core. Smarter Balance is one of two testing consortia. PARCC is the other. All they do is develop and administer the tests required under the Common Core. Just like Georgia before them, SC has decided that it is cheaper to develop their own test than to pay Smarter Balance to develop one for them. That's not the same as dropping out of Common Core.

63 Re: Adopted children. I have known two couples in the last 30 years who gave adopted children up. The reason for both was the children weren't up to their standards. One was an asshole who worked for the feds and the kid wasn't smart enough for his (non)genius IQ household. I'm not sure how this was assessed on an four year old from China but they did. The "father" was run over and killed on the side of the road changing a tire in Dallas a few years later. He didn't pull over far enough and the person who hit him was found not at fault. The other couple didn't like the way their Russian federation boy looked. He was funny looking or some crap. They gave him back and then no other agency would let them have another child. They remain nasty and childless. Making creeps like this keep a kid they don't want is not good for the kid.

Sometimes they didn't go through that much trouble (in some places they'll let literally anyone adopt from foster care) sometimes the kid has severe problems that the parents are too selfish to deal with properly.

There was a story about this "rehoming" nightmare running around the internets a few months back, Reuters "The Child Exchange". One of the adoptive parents who rehomed her kid (left him with a convicted child pornographer) was a professional foster parent from Chicago. She went and retrieved her son when she heard that a social worker was coming to check on them, and her "rehoming" might cause them to remove her other paychecks, er, foster kids.

OK, it wasn't lame duck. What it was was the special election that put Scott Brown in causing the Democrats to lose their "supermajority" in 2010. So they had to pass it before the end of 2009, Dec 24th was the last day for that.

Mine was 5 minutes long. I know what I need and told the receptionist over the phone that I know what my pain doctor had to do. I was 100% correct. My car has trip counter. It took me 2 hours and 45 minutes round trip to go 30 miles. I got to doctors new office fine, I used navigation system. I dont usually use it when Im familiar with where Im going. He used to be in Spine Clinic at Newton Wellesley Hospital, now he has his own practice. System got me there easier than I would have gone on my own.

I made the mistake of letting it tell me how to get home. I got out of there at 4:45 and hit tons of traffic. I didnt get home until almost 7.

Im getting two injections in C5 for my shoulder pain. There is nothing wrong with my shoulder, its all from pinched nerves in neck. One is next Friday at noon & the next is May 9 a three.

Im calling today to reschedule the 3 oclock appointment to earlier in the day so I do not end up in traffic again. Ill be there at least an hour and at best Id be out of there at 4.

I just bought one of those Omron 7 Series Wrist Blood Pressure Monitor's. I'm amazed at how good it works.

It blows up around the wrist versus the upper arm. Easy to use and pretty accurate. (based on previous dr appts. or drugstore checks). Most of the commenters on amazon feel the same. They checked it after coming home from the dr.

If you aren't attached to the oncologist, you should seriously consider getting one closer to your home. Especially after you wasted hours you can't get back yesterday.

Mine was pretty far away in 2002 & a few times I tried others closer to my home. They didn't do what she did 12 years ago as standard follow up. Regular MRIs & blood work. Dana Farber only did mammograms & I called mine back & said she was stuck with me, plus it like her.

My two lumps didn't show up on mammogram & under ultrasound looked like nothing. I made doctor doing ultrasound do biopsy & he said he would if someone would stay to help & she did.

I wouldn't be here if I had listened to him. I had two & I was right about both, one I had in 1995 & removed came back in same exact spot & it was nothing. I wasn't worried about that one, a second one showed up within a week & I had bad feeling.

This country has been needed tort reform for a very long time. If it was left up to me there would be no tort lawyers except in the case of a written contract under dispute. You should go see doctor near you, if you like him switch. He'll be able to get CT scan results.
My mother started losing it in 2002-2003. Quack doctor had her have MRI on brain. She went into a diabetic come & we had to call 911. I can be a bully, my older brother called quack to tell him about it & he had nurse give my brother my mother's insulin dose! I called Joslin Clinic, got an appointment for her right away. I told doctor quietly about MRI, he called & got results while we were there.

My mother had MRI on brain to see if she was having tiny strokes, she wasn't & it was beginning go Alzheimer's.

It was done at one of the many Mass General test sites. I'm sure Joslin Clinic was probably in network, but I don't know.

Rush blabs about their constitutional courses. My family settled the area about 180 years ago. I left to find a woman I was not already related to.
The college was the useless liberal arts hole too expensive with only zero value educational subjects only offered.
It is good they have found a mission that could help America regain it's founding. It amazes me that this is not part of K-12.
Liberal Arts, waking up late for the party.
It's hard to find even an engineering college that is focused on factual needed subjects today.

The American Legion is suddenly a player in the immigration fight because it has come out in opposition to a minor, but critical amendment to the draft 2015 defense bill. The amendment would broaden the existing rules allowing illegal immigrants to get slots in the U.S. military that are sought by American volunteers.

If the amendment is added to the bill, and then passed by the full House, it would allow the Senate and House to include a large immigration rewrite in the must-pass defense bill.

That immigration rewrite could consist of a small amnesty for younger illegals, or a copy of the Senates June 2013 bill, which would triple the inflow of legal immigrants and guest-workers to 40 million over the next decade. That huge inflow is roughly equal to the number of Americans youths who will join the workforce by 2024 in search of decent jobs.

The amendment maneuver would allow top GOP leaders to push an immigration bill past their caucus.

Did you not see yesterday?

I got word that it has been kitted (ready to be built) and they called to go over the engraving stuff. I was originally quoted 12-18 months, but this is unreal! I just placed the order 3 months ago and now it will be another 2-3 months before it is finished and ready for delivery. I am stoked!!!!! I am now able to give it to him for Christmas before he deploys early next year. This is all sorts of awesome news as I didn't think I would be able to get it to him on time.

My brother first pressed The Urantia Book upon me and my best friend over forty years ago. At the time, we were the only people we knew who had ever heard of it. I enjoy it, but I'm the kind of oddball who wakes his wife up at night laughing out loud reading Moby Dick.

My nic on this comment links to a comic I did a year ago, looooosely based on the Urantia Papers' descriptions of Easter week. Note that I let it simmer a year before mentioning it among this nest of opinions. The comic might be like those later Harry Potter movies, a/k/a "scenes similar to some in the books," where if you're not familiar with the source, you won't get some of it, but I try for generally enjoyable regardless. It's the basic Easter week story as alt universe SF where they had tv and cell phones in 30AD.

332 I went to an Easter play presented in a black church last Saturday. It has weighed on my heart, since. I know, these things happen for a reason.

This play was eye opening to me. Because the story is the story - the source material is the same. But watching how this was presented, to hear what was emphasized, I learned a lot. About the community that was the audience, and about the story itself.

I'll point to just one thing. The Sanhedrin brought Jesus to Pilate and asked Pilate to put him to death. In all the years of seeing and hearing the Easter story, here was something I had never heard - it has always been there, I have somehow missed it.

From the KJV, John 19:6:

...Pilate saith unto them, Take ye him, and crucify him: for I find no fault in him.

I always understood that Pilate was a reluctant player in the Easter story, that he did not want to be drawn into the local politics of the temple, and afterward, he washed his hands of the consequences. But I had missed that Pilate himself thought that Jesus was innocent.

This was a new view to me. Rome is always the heavy in The Greatest Story Ever Told. We hear it every time in the Nicene Creed, that He "was crucified under Pontius Pilate." Which is true -but....

It was enlightening to me. Rome and Pilate are not exonerated here - far from it. And that this African American congregation made a big deal of that explains a lot to me.

Rome does not crucify Jesus because they are trying to stomp out the burgeoning following around Christ - they do it capriciously, to quell local unrest, a part of a literal conspiracy to kill an innocent man. Their evil is not that are acting with bad intent, but rather that they are acting in the full knowledge that what they are doing is wrong, but do it anyway.

Now, Morons don't come here for theology, even on Good Friday. How does this apply to the current crisis?

It helps me understand how African Americans look at the American Experience as something alien to them. That the US Government is in many ways like Rome - capricious, and doing what is wrong even when they know it is wrong. And part of the - wait for it - "fundamental transformation of America" is that we are all getting a taste of that. I don't think that Obama and Holder consciously are saying, hey, let's give white people a taste of their own medicine, but I don't doubt there is some amount of their experience informing them.

Listening to Glenn Beck over the past few days, he has made some points about this whole Nevada ranch thing. His main deal over it is that people showed up with guns to face down the government, and he is pushing non-violent resistance. And he asks many times - are you facing attack dogs and fire hoses? Is it anything like what African Americans faced? (An aside - my mother was in a restaurant in St. Augustine, Florida when there was a disturbance. Black people were trying to get in, there were police with dogs and cattle prods. Dr. Martin Luther King, Jr. was arrested and jailed. This is living memory. Hard to believe that the Mustang is 50 years old? Well, same year.)

I think this is one reason why people try to say that reaction to Obama policies is racist. I know, it is a default and is used by white liberals to mau mau people - but I think that there are many people, many African Americans, who are thinking - well, now that the government is capricious and unfair to you you say something about it.

There may be something to it. I used to be a "law and order" (not the TV show) guy - crack down on criminals. But after having my own tangles with the legal system (divorce and traffic tickets!) I know it isn't like you see on TV. It is a capricious and unfair system. It isn't about finding the truth. And cops lie, and nobody cares. Judges I am sure know that the cops are lying on the stand, but they go along with it. Coming into contact with the "justice" system opened my eyes. I didn't complain about it until it affected me. Did it just suddenly become bad, or is not just no longer deniable to me?

I don't know. I didn't turn into some bleeding heart liberal. But I can see why people might think and say the things they do. And it makes me think that there is something to, this, too:

345 If you google some of those names you see other people who have given their kids up adopted kids illegally. It's disgusting. One couple said the 5 year old Guatamalean kid failed to adjust after a couple of months. Well, yeah! You take him away to a new country, a new language, new people. What do you expect? At least get treatment and put in more than a couple of months before you pawn him off on child abusers.

I met an elderly couple who told me their daughter worked for a high powered female executive who adopted a kid from Russia. She was always leaving her with the daughter while she went away on business. She pretty much became a part of their family and the adoptive mother relinquished control but they did it legally and she was adopted by the daughter. The grandparents were thrilled. So, that was a situation that ended happily.

2) When you're typing up your notes from interviewing a convicted murderer and rapist, it probably helps to either A) make it very clear that that is what you're doing (perhaps with a header that says, very clearly, "NOTES FROM INTERVIEW WITH MURDERING PSYCHOPATH, APRIL 2014", or B) not type them on a frigging plane where Nosy Nellies are staring over your shoulder.

Levy Thamba Pongi, 19, consumed more than one cookie purchased by a friend even though a store clerk told the friend to cut each cookie into six pieces and to eat just one piece at a time, said the reports obtained Thursday.

Pongi began shaking, screaming and throwing things around a hotel room before he jumped over a fourth-floor railing into the hotel lobby March 11. An autopsy report listed marijuana intoxication as a "significant contributing factor" in the death.

I was on a plane once and there was a guy sitting across the aisle from me who was typing up notes about missiles and various military related things about the middle east. It was a very colorful and eye catching report he was working on, so I assume it wasn't anything confidential, but I considered leaning across the aisle and asking him if that wasn't something that should be kept under wraps.

The privacy regs as they apply to researchers probably don't have a "unless a person is in prison" part. They'd also be different from treating physician rules.

Usually any data like that has to be kept and worked on "private" location. (I forget what the technical term is.)

Ah, but you see, the erroneous belief out there in the zeitgeist is that pot IS harmless, or at least that the worst it will do to you is make you zone out and crave Funyuns. Hence why there's been such a push for legalization all over the country. "It's less dangerous than alcohol or cigarettes, and THEY'RE legal!" There's very little public knowledge about the fact that marijuana can and does effect different people differently, and sometimes very badly.

It's like kids who think popping prescription meds or OTC cough syrup is totally safe because they're "medicine" and medicine is supposed to make/keep people healthier. They pay no attention to warning labels or the common sense advice to not take anyone else's prescription medication, because they're after a quick, "safe" high. They're exactly the same people who would buy pot cookies and then ignore the warning labels, because "pot's totally safe."

You can talk morality or incentives. This law creates incentives to leave US born children unadopted.

I suppose that we can build more orphanages and potential adoptive parents can adopt from overseas where they are more likely to find healthy infants who were not born crazy or abused for their first few years of life. Or, many potential adoptive parents might well decide not to adopt after all, especially if they already have children who could be put at risk by playing the adoption version of Russian roulette. That is the entirely predictable consequence of this law making it impossible to give back adopted children.

But you are correct, it has a certain moral argument in its favor.
