Immigration Bill
Today is supposed to be the vote on the Kennedy-StupidMorons Immigration Bill. They'll claim it's only the "cloture" vote, but this is it. If the bill passes this vote, it's as good as done. Bush loves it, so it's got a real good chance at passing.
On Friday, Steph provided me with a link to the actual text of the bill. It's 790 pages long. Anyone care to guess if YOUR Senator actually sat down and read all 790 pages? I'd be less than 2 have read the damn bill -- but they're supposed to vote today. I've heard lots about what's in the bill. I've heard nothing good at ALL about the bill. But I decided to try and do what the Senators won't -- I wanted to read the entire bill. So if you don't want to read the whole 790 pages, I'll attempt to provide the cliff notes version here. Keep in mind -- the original is 790 pages so this is NOT going to be short. Also note the format: I will list the section number and then provide what's in the bill. I'm not making those parts up. I'll save my comments for the next lines where you'll see "O:" (that's for 'Ogre'). If you don't see the "O:," that means it's really in the damn bill. Subtitle A:Sec 101 - Adds 2,500 port inspectors, 200 custom investigators, 1,000 smuggler investigators, 250 US Marshalls, 11,600 Border Patrol agents (2,320 of them to the Canadian border). O: Nothing like adding huge piles of government employees. This would be the Democrat part of the bill. Sec 102 - Establish a "virtual fence." O: I'd prefer a 12' tall stone wall with moats with sharks with lasers on their heads. Sec 103 - Construct a border. O: Really, it says the secretary should obtain "operational control of the international borders of the United States. Well, at least they admit we current have NO border. Sec 104 - Add border checkpoints. O: I couldn't make this up. That part actually allows the government to put up border entry checkpoints. Sec 105 - Same as Sec 104, but they're called "ports of entry."
Sec 106 - Build a fence near Naco, AZ; another near Tucson, AZ; Yuma, AZ; and 870 miles of other fencing anywhere else. Subtitle B:
Sec 111 - Develop a plan to watch the border. O: Again, it really says this. Don't DO anything, just make a plan to watch the border. Sec 112 - Develop a strategy for "border security." O: This is a long section. Again, don't DO anything, just make plans. Sec 113 - Write a report on "improving information exchange" about "the Security of North America." O: Note it didn't say the security of the United States, but the Security of "North America." Sec 114 - Secure the borders of Mexico, Guatemala, and Belize. Give those countries money to help them secure their borders. O: Yeah, screw the US. Seriously. Did you see anything that said secure the borders of the United States? IT'S NOT IN THERE. Sec 115 - Attempt to reduce human smuggling.
Sec 116 - Collect data about deaths at the US-Mexico border. O: Excuse me, what border? Sec 117 - Cooperate with the government of Mexico. O: Oh, there's a great idea. Again, this has nothing to do with securing the borders of the United States. Subtitle C:
Sec 121 - Fingerprint those who enter the country legally. O: And this helps stop ILLEGAL immigration how? Sec 122 - Have the border patrol use satellite communications. O: What, while they're talking from one station to the other? They're not allowed to touch illegals, so they can't be doing much else. Sec 123 - Review border patrol training procedures. O: I'll bet to include telling the border patrol not to actually enforce the border or the law. Sec 124 - Implement the US-VISIT system at all entry points. O: Except at the border where the illegals are crossing. Sec 125 - Train the border patrol to identify forged documents. O: What for? They're not going to DO anything if they see any forged documents. Heck, if they ask someone for their papers, they're likely to be sued or put in jail. Sec 126 - Puts the Secretary of Homeland Security in charge of something the US Attorney General used to do. That's great -- the Secretary of Homeland Security is the one man in this entire country that can't seem to locate a single illegal alien. Sec 127 - Technical changes to previous laws
Sec 128 - Collect Biometric Data from aliens leaving the country. O: Sure, just put up a sign and I'm sure they'll all comply without question. After all, they obeyed the law on the way in, right? Sec 129 - Write a report about the southern border. Determine the impact of a fence on the global climate, ozone, etc. O: Who writes this crap? Did they consider the impact of a border fence on the price of rice in China? I bet it's in there. Sec 130 - Ensure that women and blacks get contracts O: Yes, we wouldn't want the best person to do the job to get all of this huge pile of government handouts, would we? No, we're going to be racist and sexist and give out government handouts soley on the sex and race of the person applying. I guess that's only illegal if you're NOT government. Sec 131 - Beginning Oct 1, 2008, an alien OTHER THAN A NATIONAL OF MEXICO shall be detained when trying to illegally enter the country. O: Go ahead, read that again. It says we're not going to stop ANYONE from entering the country until Oct 1, 2008. And then we'll BEGIN to stop only non-Mexicans. Sec 132 - People who evade inspection AT CHECKPOINTS shall be punished. O: No word about those who simply ignore or avoid checkpoints. Sec 133 - If a governor asks the Secretary of Defense, he shall be permitted to use the National Guard to train in their state. O: Seriously. This law actually makes it an apparent crime for the governor of Arizona to train his own national guard troops in the state of Arizona. Can you say, "Unconstitutional?" Sec 134 - Write a report about incentives used to encourage former armed forces members to join the border patrol. O: Writing papers and reports is "doing something" about the border, right? Sec 135 - Extends the deadline for US Citizens to get passports to cross the Canadian and Mexican border. Expand the REALID act. O: Of course, nothing about requiring NON-citizens to have ANY documentation to cross any border. Subtitle D:
Sec 141 - Title of the act: Border Law Enforcement Relief Act of 2007.
Sec 142 - Congress finds that they're supposed to enforce the border and aren't. O: Shocking. They actually admit that it's their job to enforce the border. Too bad their numbers of estimates of illegal in the country is WAY, WAY low. Sec 143 - Authorizes $250 million in funds for local law enforcement groups at the border to enforce the border.
Sec 144 - This law shall not authorize any state or local agencies to enforce the law. O: Typical government crapholery. Give $250 million to law enforcement, but then tell them they're not allowed to actually use that money to enforce ANY border law at all. Subtitle E:
Sec 151 - If a state governor declares a "border emergency," they get 1,000 union border agents for free. O: Gee, do you think ANY state governor won't? Danger, Will Robinson! Sec 152 - The border patrol gets total control over the border. No one else is allowed to assist in any way, shape, or form. Adds 100 helicopters and 250 boats to the border patrol and cars -- lots of new cars.
Sec 153 - Equips all border patrol cars with laptops, radios, GPS systems, and Night Vision equipment.
Sec 154 - Border patrol agents shall have body armor, guns, and uniforms.
Sec 155 - Blank check to provide all of the above. O: Again, nothing about enforcing the law or reducing illegal alien entry into the country. Lots of spending, though. Title II - Interior Enforcement
Sec 201 - Apparent technical changes to current laws
Sec 249 - Total Amnesty for anyone who entered the country illegally before Jan 1, 1972.
Sec 202 - Gives control of deportations to Homeland Security instead of the Attorney General; gives permission to hold violent criminal illegal aliens for more than 90 days. O: Apparently we're not allowed to hold them now. Sec 203 - Technical changes to the definition of aggrevated felony
Sec 204 - Defines moral character? Prohibits those who are a danger to national security from being naturalized. O: Again, what the hell? You mean right now, without this law, if you're a threat to national security, you CAN become a citizen? Great system you morons are running there in Washington. Sec 205 - Increases penalties for gang activity and makes being a member of a criminal gang a deportable offense O: Gee, that might work if we actually deported, well, ANYONE, wouldn't it? Sec 274 - Makes smuggling illegal aliens a crime -- ONLY allows federal agents to enforce any part of this law. O: Do we have ANY laws about the border right now (before this bill)? Any at all? Sec 275 - Makes it illegal to enter the US without asking permission of the Dept of Homeland Security. Punishments: 1 time = 6 mos in jail; 2nd+ time = 2 years in jail; if a felon = 10-15-20 years O: So, we HAVE been wrong calling them "illegal aliens." If they're just now making this law, apparently it's not against the law now. What a load of you know what. Sec 276 - If a deportee tries to re-enter, that's not allowed. If they're criminals who try and re-enter, that's 10-15-20 years in jail. Sec 208 - Changes Chapter 75 of the US Code -- Passport, Visa, and Immigration Fraud.
Sec 209 - Adding commas and semicolons to previous laws.
Sec 210 - Develop a plan to identify removable criminal aliens already in state and federal prisons. O: About time, huh? Sec 211 - Allow aliens to self-deport instead of actually deporting them. O: It really says that. Instead of forcing them out, if they're convicted of a crime, or found where they're not supposed to be, we can just ask them really, really nicely to leave. I'm sure a lot will jump at this chance. Sec 212 - Deters aliens by making firm dates of legal petitions within 5, 10, or 20 years of the ordered removal of the illegal.
Sec 213 - Prohibits selling firearms to some illegals; makes it illegal for some illegals to possess firearms. O: What a damn joke. Gee, they didn't obey they pesky border law, but I'm sure they'll obey this firearm law. Sec 214 - Limits prosecution for illegal aliens to 10 years (statute of limitataions set).
Sec 215 - Allows the state department to help investigate illegals.
Sec 216 - Ensures at least 55 ICE agents are in every state -- except states with a population of less than 2 million. Allot $15 million for this. O: I'm sure Vermont is thrilled. Sec 217 - Says that the dept of Homeland Security is not required to do things for illegal aliens.
Sec 218 - Give $2 billion to states who provide stuff for illegals. Plus $3.5 billion more. O: I'm not tracking all these numbers, but can you see why Democrats and today's Republicans would LOVE this bill? There's more spending than the entire Pacific Fleet could spend after visiting the Anheisuer-Busch brewery on free sample day. Sec 219 - Blank check to pay for providing transportation for all illegals. O: presumably to and from jails. Sec 220 - Blank check to any and all "Indian lands" who want to have free cash to prevent, detain, and arrest illegals on their lands.
Sec 221 - Study alternatives to detention (supervising, electronic monitoring, etc).
Sec 222 - More technical changes.
Sec 223 - Aliens must provide actual addresses, and not PO Boxes or other people's addresses.
Sec 224 - If local agencies train their people for border enforcement, the feds will pay for it.
Sec 225 - 3rd-time drunk illegal alien drivers shall be deported. O: Nothing like treating the illegals better than the citizens, eh? Sec 226 - technical change somewhere else
Sec 227 - Deport exceptionally violent illegal aliens quickly.
Sec 228 - "Protect Immigrants from Sex Offenders." O: Okay, this one makes no sense. Let's protect illegal immigrants from being sexually assaulted? Once again, why the special rules for the non-citizens? Sec 229 - Permits state law enforcement to "Assist" federal law enforcement in enforcing immigration law -- at the expense of the feds
Sec 230 - Allows Homeland Security to investigate and prosecute forced labor and human trafficking.
Sec 231 - Adds immigration violators to the NCIC database
Sec 232 - Homeland Security will set up cooperation with at least 1 law enforcement agency in every state.
Sec 233 - Build 20 new federal jails to house at least 20,000 illegal aliens. Use as much money as desired.
Sec 234 - In 2 years, all suspects charged with federal crimes will be checked to attempt to determine their residence status. O: Yes folks, that's right, the federal government isn't doing that now. Don't you feel safe? Sec 235 - Increase the prisoner transport system to add more busses. And maybe planes. Title III - Unlawful Employment of Aliens
Sec 301 - Modify US Code to make it illegal for an employer to hire "unauthorized aliens" or to continue to employ them (if already employed). There shall be ZERO cost to the employer. Homeland Security will spend at least $400 million for this system. Employers who do not obey will be fined $500 - $4,000 per illegal. 2nd offense is $4,000 - $10,000 fine; and third is $6,000 - $20,000 per illegal. The feds may not contract with agencies that break these laws (unless they really want to and get a wavier). Give Social Security to illegals. O: All the laws in the world are meaningless when we refuse to enforce them. Sec 302 - All employer fines go into a pool that's used to enforce these laws.
Sec 303 - Hire 11,000 new ICE agents.
Sec 304 - Technical change
Sec 305 - Grants civil rights to illegals -- you cannot discriminate against someone for employment based on "the verification of the individual's work authorization through the Electronic Employment Verification System." Spend $200 million for an illegal alien "information campaign." O: Doesn't that match so well with Sec 301? You can't hire illegals, or you'll be fined. You can't NOT hire them, or you'll be sued. Title IV - Nonimmigrant and Immigrant Visa Reform
Sec 401 - Write a report that describes the impact of making all illegals legal overnight. O: This has already been done, you morons. Sec 402 - Allows illegals to enter if they're doing temporary work. And allows them to bring spouses, children, and anyone else who "is accompanying or following." O: Yeah, you read that right. One illegal comes to pick lettuce, they can bring quite literally any number of people with them, completely legally under this law. Sec 403 - Amends USC 1181 Sec 218: Allows more H-2C Visas to allow more non-citizens to enter the country legally.
Sec 404 - Amends USC 1201 Sec 218: Specific requirements that employers must follow to advertise jobs before they can use foreign H-2C Visa workers.
Sec 405 - Amends USC 1151 Sec 218: Develop a system to "manage and track alien employment" (regarding H-2C employment Visas).
Sec 406 - Do the above within 6 months.
Sec 407 - US Secretary of Labor should crete a job site. O: Yeah, Monster needs some competition, so let's have government do that. Is there anything government can't do? Sec 408 - Create a "Temporary Worker Task Force." They will write more reports. O: And it says that no more than 5 members can be from the same political party. Does "claiming to be independent" count as one? Sec 409 - The US shall make agreements with foreign countries to ensure they will accept their illegals back. O: Note it does NOT say, "The US shall inform foreign countries." No, it says, "negotiate and be nice to them." Ballless freaks. Sec 410 - Expand S Visas -- and allows those immigrants to bring their entire extended family with them as well.
Sec 411 - If an employer wants to employ L Visa immigrants, they have to submit to tons of paperwork.
Sec 412 - Hire 2,000 new bureaucrats for the Department of Labor each year -- FOREVER.
Sec 413 - Grant exemptions to various legal requirements to any country that is helping in Iraq with at least 300 troops. O: Gee, does that mean when the Democrats pull out that we'll have stiffer requirements for ourselves? Sec 414 - Blank check to fund all the above.
Subtitle B
Sec 421 - Title: Fairness in Immigration Litigation Act of 2007 O: Oh, this is SO going to suck. The word "fair" should never, ever appear in any legal document. Sec 422 + 423 - Pages of rules about when illegals sue the government. O: Don't you love it when the government gets to make the rules when they're the guilty party? Blind justice? Not in this country. Title V, Subtitle A
Sec 501 - Allows 650,000 immigrant Visas a year -- but only one counts per family. O: So one person can get a Visa and literally bring their entire extended family along for free. How is that a numerical limitation again? Sec 502 - Limits a single foreign state to 10% of the total. O: Can someone help me? My calculator skills are weak -- what's 10% of infinity? Sec 503 - Families of citizens; families of permanent resident aliens; and married children of citizens shall be automatically given visas. O: There's more numbers and percentages, but they'll all based on that infinity number above, so they're really meaningless. Sec 504 - All widows and children of citizens are invited in.
Sec 505 - If the Secretary of Labor says so, any illegal who wants to work in special, government-selected industries may enter the country at will. The Secretary of Health and Human Services shall find a way to employ MORE nurses and physical therapists. O: Gotta stick pork in there, or it's not a Congressional Bill. Sec 506 - Do not allow widows or orphans to be deported.
Sec 507 - Allow student visas to never expire if the secretary gives a wavier.
Sec 508 - Aliens who have advanced degrees can stay O: I wonder if learning to drive a bus, truck, or airplane fits in this category. Sec 509 - Alien Children of Filipino WWII Vets can stay.
Sec 510 - Alien Artists can stay.
Sec 511 - Alien Powerline workers can stay.
Sec 512 - Alient Haitian Refugee children can stay. Subtitle B - SKIL Act of 2007 O: These idiots can't even spell "Skill." Fools. Sec 521 - Title: "Securing Knowledge, Innovation, and Leadership Act of 2007." O: Yeah, government is SO good at innovation. Oh, this is going to be really bad, too. If you REALLY wanted to increase knowledge, innovation, and leadership, you'd cut government about 90% so people could actually DO things instead of spending all their time complying with government regulations. Sec 522 - H1-B Visa technical corrections
Sec 523 - Appears to add 115,000 student Visas for advanced degree-seeking students
Sec 524 - Aliens who have advanced degrees, or that work in a government-preferred industry get waviers for these laws. Oh, and their entire families, too.
Sec 525 - We love alien students. But they can't work off-campus full-time.
Sec 526 - L-1 Visas shall not be expedited.
Sec 527 - If an illegal is working without a green card, but they asked for one, then they won't be bothered.
Sec 528 - Spend money to make a system to speed up employer requests from the government.
Sec 529 - If a company really wants good service from the government, they can buy premium processing services. O: With crap like this, I seriously believe there is zero hope of ever seeing freedom or a representative government on this planet ever again. Did you read that? The government, that is supposed to be "by the people," is going to charge certain people extra cash to get good service while the others are told to suck eggs. It's hopeless folks, really it is. This government is gone. It is completely and totally out of control and cannot be stopped. Sec 530 - The secretary of Labor shall determine if employers are paying aliens the "correct" amount. O: See previous note. Sec 531 - Visa applications shall have background checks included. O: Guess that's just optional now. That explains a lot. Sec 532 - Visas may be renewed. Subtitle C
Sec 541 Title: "Hurricane Katrina Victims Immigration Benefits Preservation Act." O: Okay, that's it. I can't take any more. I've been reading this for about 6 hours now on 3 different days. This is only 427 pages into this 790-page pile of horse doo-doo. This last section is to give "special status" to illegal bastards because they happened to be somewhere below sea-level when a hurricane hit? This government seriously sucks. Any Senator who votes for this bill seriously hates freedom. Supporters of this bill, no matter their political party, are voting for complete and total government control of, well, everything. And notice -- I haven't even gotten to the part that gives total and complete amnesty to the 30 million illegals already in the country (and allows them to bring in another 120 million free). I'm sorry, I know some of you were looking for the entire bill here. I just couldn't do it. The damn thing is so full of crap that even I cannot stand it any more. If this bill passes, and I'm not just blowing smoke here, say goodbye to America -- at least as a free country and a representative republic. If this passes, you will be able to tell your grandchildren that you were able to witness the fall of America. We had a good run, but I guess this is it.

I couldn't read the whole thing. I got to about 144/151 and couldn't go on. They're giving the cops a bunch of money to help...but...not...letting them....now my brain hurts.
I guess the good news is that anybody who wants 1,000 union workers (This must make union bosses happy) gets them!...wait....how are unions good again? I forgot.

The above quotes from the WaPo, of all places.
About the length of the bill...A hundreds-of-pages-long bill is ludicrous. One reason that this bill is so long is that exception after exception is being made.
Making a law doesn't guarantee enforcement thereof, particularly when that law is so convoluted as to be unrecognizable as sane.

SEC. 114 Give money to the governments of Belize, Guatemala and Mexico to secure their borders...
Q1) Is there any requirement that they actually use the money for that purpose?
Q2) Does it specify that they secure their NORTHERN borders?
SEC. 235 Increase prisoner transport system by buying additional buses. Why do I fear that it directs the DHS to only purchase buses from the City of New Orleans?
Don't know if this is in the bill or just implied but do 20 million suddenly legal aliens now qualify for taxpayer subsidized in-state college tuition rates?

With the state college tuition rates, the states still have a tiny bit of power left, and that's one of the very few things that states are still allowed to do -- until the federal government decides to force them to do otherwise.

I am Mexican.
Part of my family lives in USA, part of my family is in Mexico. Some of my uncles fought in the Second World War. A cousin of mine went to VietNam. One of my nephews has been to Irak (twice). Other nephew is presently in Afghanistan. Both of my nephews joined the Marines.
Did you know that President carter gave pardon for those that did not join the war in Vietnam? Many went to Canada, and others flew to Mexico.
You sure know that President Ford Gave full pardon to Nixon because of the Watergate scandal.
And according to what it is known, Nixon violated blatantly the law in many issues and in a great scale. This does not mean that therefore, others must violate the law. But what I am saying is that in your own history there are some examples of amnesty or whatever you want to call it.
The Rule of law during liquor prohibition was zero alcohol and looked what happened. The black market prevailed and Mafia’s rings sprout all over the country.
“Rule of law” means enforcing laws that are capable of enforcement, otherwise people merely learn disrespect for the law. Obviously, immigration laws that refuse to recognize the inevitable attraction of a lack of unskilled labor on one side of the border and a lack of employment for unskilled labor on the other is not workable no matter how much of the taxpayers' billions get poured down a rathole of “enhanced enforcement
Why are you claiming the rule of law against people that came here to work? Work that many of you don’t want to perform.
Why do you hate us so much, why do you want to harm us? We are not terrorists.? Do you believe in God? Do you have a religion?
What does it prove to the valuable and strained military resources to round up all the indocumentados if radical Muslims manage to pull off another 9-11 or worse?. Let me remind you that some of the terrorists and all failed attempts came through Canada not through Mexico. Let’s concentrate in chasing our real enemies. Not us.
Canada is changing and becoming more accepting and tolerant of the Islamic culture, which not always but sometimes does include violent extremes which we have seen far too often. In Canada there are greater concentration of Islam followers than in all the countries together south of the border.
Let me point out that our countries in north and South America belong to the only continent in the world, besides Europe, with common origins in religion and cultural heritage. No other continent in the world has such homogeneity. Our countries are not in war against neighboring countries. There are no conflicts because of religious differences. But, one thing is sure, we are not your enemies, we are not terrorists. As a matter of fact, down the road, we are your only potential allies against international terrorism.
I do not understand why you cannot see who our common enemy is, nor why you would have us waste time and effort chasing down immigrant workers, instead of chasing terrorists, such as the Fundamental/ radical Islam followers that hate the West, us included.
Please do not forget what happened with Hitler and Jews in Europe.
Your arguments sound familiar. Similar to the attacks made to Jews that escalated until deport them to concentration camps and exterminate a great deal of innocent people. All based in hate. Hate against other race. Hate against other people.
Not so long ago, the biggest dictator on earth came to power driven by anger and hate.
Everything started little by little in Germany. Jews started to be blamed for everything. Just take a look to some of the movies made by Hitler about Jews. In these films, they are depicted as criminals, thieves, a disgrace to Germany, they are filthy, they bring diseases, they are greedy, they should be removed, they should be deported, etc.
America had to go and rescue Europe from Hitler and his fanatics. Maybe some of your relatives fought abroad. Maybe some or many died in this fight against hate.
The hate against Jews made Hitler to climb to his actual position. As a result of his ascent and silence and approval of the German population, the killings and destruction were countless. This is also what the Ku Klux Klan tried to do against African Americans in USA, luckily without success. The white supremacists, Nazis, and the KKK are closely related.
Perhaps unknowingly or unwittingly you are helping them.
Don't make the mistake that Germans made with Hitler.

The immigration laws can be enforced -- the United States is making NO attempt to enforce them. Read the post above and the Congress openly admits that they are currently NOT making any attempt to have a border.

I love immigrants -- who obey the law and actually have some interest in JOINING this country and it's heritage, NOT those who want to bring their own culture with them.
